In his RTI application dt.24.4.08, the Appellant sought information<br \/>\n     about the letter that he had sent by speedpost to the University<br \/>\n     Institute of Information Technology in Shimla. The Appellant wanted<br \/>\n     to know the name and designation of the authority to whom this letter<br \/>\n     was delivered, if the letter was still undelivered then what would be<br \/>\n     the possible date of delivery and in case the speedpost letter failed to<br \/>\n     reach its destination, what would be the possible date of delivery. The<br \/>\n     CPIO in his reply dt.19.5.08 stated that the speed post letter was<br \/>\n     delivered to Mr.Surinder Kumar Bagri on 19.4.08 and that if the<br \/>\n     Department    is   found   responsible   for   non-delivery   then    liable<br \/>\n     compensation would be given to the sender of the letter. Not satisfied<br \/>\n     with the reply, Appellant preferred his first appeal before DDG,<br \/>\n     Department of Posts asking for the complete address of Mr.Surinder<br \/>\n     Bagri and the DDg&#8217;s authorization, as per the postal office records, to<br \/>\n     receive such letters on behalf of the Institute in Shimla.           On not<br \/>\n     receiving any reply from the Appellate Authority, the Appellant<br \/>\n     preferred the second appeal before CIC on 18.8.08.\n<\/p>\n<p>   2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,<br \/>\n       scheduled the hearing for October 17, 2008.\n<\/p>\n<p>  3. The Appellant was represented by his brother Mr.Surinder Kumar<br \/>\n       Bagri.\n<\/p>\n<p>  4.    Mr. Ram Babu Sharma, CPIO &amp; Supdt. New Delhi Stg. Division<br \/>\n  represented the Public Authority<\/p>\n<p>Decision<\/p>\n<p>  4. Mr.Bagri informed the Commission that the speed post letter, instead<br \/>\n       of being delivered at the Institute in Shimla, was returned to the<br \/>\n       residence of the Appellant in New Delhi, where Mr.Surinder Bagri (the<br \/>\n       Respondent waho is the brother of the Appellant) received it and that<br \/>\n       he was not aware of the reason for this non-delivery to the university.<br \/>\n       The Respondent submitted that due to non-delivery of speed post<br \/>\n       letter at the University, the Appellant underwent a lot of mental agony.<br \/>\n       He wanted to know who was responsible for the non-delivery of the<br \/>\n       letter at Shimla and demanded that CPIO give him in writing that the<br \/>\n       letter was returned to Delhi address of the Appellant and that the<br \/>\n       Department is responsible for the non-delivery.         CPIO agreed to<br \/>\n       provide such a letter to the Appellant.\n<\/p>\n<p>  5. The Commission directs the CPIO to provide a certified letter to the<br \/>\n       Appellant informing him that the responsibility of non-delivery of the<br \/>\n       letter to the Director, University Institute of Information Technology,<br \/>\n       Shimla lies entirely with the Dept. of Posts, O\/o The Director, New<br \/>\n       Delhi Sorting Division, within 10 days of receipt of this Order.\n<\/p>\n<p> 6.
