Secretary, Vidhyalaya Siksha Samiti, Primary School Dalelganj, Gram\n                Panchayat Tarahagar, Block Bihta, District Patna.         -Respondents.\n                                        -----------\n<\/pre>\n<p>04   31.03.2011                     The petitioner was recruited as Shiksha Mitra and<\/p>\n<p>                     posted in the Primary School, Dalelganj Gram Panchayat Tarahagar,<\/p>\n<p>                     Block Bihta, Distrcit Patna. In 2004 Government took a decision that<\/p>\n<p>                     persons who had been attained Intermediate qualification with 45%<\/p>\n<p>                     marks within 33 months their services as Shiksha Mitra would be<\/p>\n<p>                     continued. Petitioner did obtain the qualification of Intermediate but<\/p>\n<p>                     with 44.70% marks.        In 2006 the Bihar Panchayat Teachers<\/p>\n<p>                     (Appointment and Service Condition) Rules, 2006 came in and all<\/p>\n<p>                     Panchayat Shiksha Mitra found working were automatically absorbed<\/p>\n<p>                     as Panchayat Teacher. Petitioner was also absorbed as Panchayat<\/p>\n<p>                     Teacher. She had by then cleared her Intermediate examination. All<\/p>\n<p>                     of a sudden in the year 2007 her salary was stopped on the plea of a<\/p>\n<p>                     direction from the Collector, Patna that those Panchayat Shiksha Mitra<\/p>\n<p>                     who had not passed Intermediate examination with 45% marks or<\/p>\n<p>                     above had to be discontinued and remuneration could not be paid but<\/p>\n<p>                     petitioner&#8217;s services were not dispensed with. It may be noted here<br \/>\n<span class=\"hidden_text\">                                  -2-<\/span><\/p>\n<p>           that subsequently this Court held that any Panchayat Shiksha Mitra<\/p>\n<p>           who cleared his Intermediate examination even though beyond 33<\/p>\n<p>           months could not be dismissed and if dismissed had been reinstated.<\/p>\n<p>           Upon passing the said examination the State Government subsequently<\/p>\n<p>           clarified that if a Panchayat Shiksha Mitra serving or dismissed<\/p>\n<p>           cleared the Intermediate examination without minimum marks of 45%<\/p>\n<p>           he would be continued as Panchayat Teacher and\/or if dismissed<\/p>\n<p>           reinstated.\n<\/p>\n<p>                          It appears that pursuant to the said Government<\/p>\n<p>           clarification petitioner has been continued as Panchayat Teacher and<\/p>\n<p>           now his only grievance subsists is with regard to arrears of pay for the<\/p>\n<p>           month for which in between she had not received her payment. The<\/p>\n<p>           same is specified as January, February and March 2007.<\/p>\n<p>                          Having considered the matter, in my view, the<\/p>\n<p>           grievance of the petitioner appears to be genuine.
