The Government of India,\n   rep.by its Secretary,\n   Home Department,\n   Lok Nayak Bhavan,\n   New Delhi-3.                               ..Respondents\n\n        Petition filed under Article 226 of the Constitution of India  praying\nfor the issue of writ of mandamus as stated therein.\n\nFor Petitioner :  Mr.Ravichandrabaabu\n\nFor respondents :  Mr.S.T.S.Murthy, Spl.GP.\n\n:ORDER\n<\/pre>\n<p>(The order of the Court was made by R.JAYASIMHA BABU , J.)<br \/>\n                                                        The prayer in the writ<br \/>\npetition is for issue of a writ of mandamus to the Government of India as also<br \/>\nto  the Government of Tamil Nadu to have national flags affixed on the cars of<br \/>\nthe Hon&#8217;ble Judges of this High Court and to restrain  them  from  giving  any<br \/>\nimpediment  to  the use of the national flag on the cars of the Hon&#8217;ble Judges<br \/>\nof this High Court.\n<\/p>\n<p>        2.  When the matter was taken up for hearing, learned counsel for  the<br \/>\nState  Government  placed before us the Flag Code of India, 2002 issued by the<br \/>\nGovernment of India, which took effect from the 26th of January  2002.    That<br \/>\nCode,  in  Para  3.44  sets  out  the  persons to whom the privilege of flying<br \/>\nnational flag on motor cars is limited.  It reads thus:-\n<\/p>\n<p>        &#8220;3.44 The privilege of flying the  National  flag  on  motor  cars  is<br \/>\nlimited to the:-\n<\/p>\n<blockquote><p>        (1) President;\n<\/p><\/blockquote>\n<blockquote><p>        (2) Vice-President;\n<\/p><\/blockquote>\n<blockquote><p>        (3) Governors and Lieutenant Governors;<\/p><\/blockquote>\n<p>        (4)  Heads  of  Indian Missions\/Posts abroad in the countries to which<br \/>\nthey are accredited;\n<\/p>\n<blockquote><p>        (5) Prime Minister and other Cabinet Ministers;\n<\/p><\/blockquote>\n<blockquote><p>        Ministers of State and Deputy Ministers of the Union;<\/p><\/blockquote>\n<p>        Chief Minister and  other  Cabinet  Ministers  of  a  State  or  Union<br \/>\nTerritory;\n<\/p>\n<p>        Ministers of State and Deputy Ministers of a State or Union Territory;\n<\/p>\n<p>        (6)  Speaker  of  the  Loke Sabha; Deputy Chairman of the Rajya Sabha;<br \/>\nDeputy Speaker of the Lok Sabha; Chairmen of Legislative Councils in States<\/p>\n<p>        Speakers of Legislative Assemblies in States and Union territories.\n<\/p>\n<p>        Deputy Chairmen of legislative Councils in States;\n<\/p>\n<p>        Deputy  Speakers  of  Legislative  Assemblies  in  States  and   Union<br \/>\nterritories;\n<\/p>\n<p>        (7)  Chief Justice of India; Judges of Supreme Court; Chief Justice of<br \/>\nHigh Courts; Judges of High Courts.&#8221;\n<\/p>\n<p>Therefore, the position as of today  is  that  the  privilege  of  flying  the<br \/>\nnational  flag  on  motor  cars  is  limited  to  persons  holding the offices<br \/>\nmentioned in Clauses (1) to (7) of paragraph 3.44.\n<\/p>\n<p>        3.  We may also notice here paragraph 3.45  of  the  same  Flag  Code,<br \/>\nwhich  provides  that  the dignitaries mentioned in Clauses (5) to (7) of para<br \/>\n3.44 may fly the national flag on their motor cars whenever they  consider  it<br \/>\nnecessary or  advisable.    It  is,  therefore,  a matter of discretion of the<br \/>\nholders of the offices mentioned in Clauses (5) to (7) of paragraph 3.44.\n<\/p>\n<p>        4.  Honourable Judges of this Court  are  thus  entitled  to  fly  the<br \/>\nnational  flag  on  their  motor  cars  whenever they consider it necessary or<br \/>\nadvisable.\n<\/p>\n<p>        5.  The respondents being bound by the Flag Code they shall give  full<br \/>\neffect to the same.\n<\/p>\n<p>        6.  The writ petition is disposed off accordingly.\n<\/p>\n<p>Copy to<\/p>\n<p>1.
