JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;[A]\t&#8220;YOUR<br \/>\nLORDSHIPS TO admit and allow this petition.\n<\/p>\n<p>[B]\t&#8220;YOUR<br \/>\nLORDSHIPS may be pleased to issue a write of mandamus or writ in<br \/>\nthe nature of mandamus or any other writ order and or direction u\/s<br \/>\n226 of the constitution of India appropriate writ and or order, your<br \/>\nLordships may be pleased to hold and declare that the petitioner was<br \/>\ndirectly appointed as Agricultural-sayonjak from 01\/03\/1980 and that<br \/>\nhe is entitled for revised pension and revised pay and other<br \/>\nretirement benefits on the post of Agricultural-sayonjak carried at<br \/>\nthe relevant time.\n<\/p>\n<p>[C]\t&#8220;YOUR<br \/>\nLORDSHIPS To issue direction to the respondents to releases all<br \/>\nconsequential retrial benefits taking the entire service of the<br \/>\npetitioner from 01\/03\/1980 to 30\/11\/2006 as continuous on the basis<br \/>\nof judgment and order has passed in special civil application no.6992<br \/>\nof 2002 in order passed on 09\/03\/2006 here it is also marked as<br \/>\nannexure &#8211;\n<\/p>\n<p>[D]\t&#8220;YOUR<br \/>\nLORDSHIPS may be pleased to Any other relief which is suitable<br \/>\nand necessary in the circumstances of this case be granted.\n<\/p>\n<p>[E]\t&#8220;YOUR<br \/>\nLORDSHIPS may be pleased to the cost of this petition be<br \/>\ngranted.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Ms. Tejal K.
