He has further submitted that the<br \/>\noffence in question was registered way back in the year 2009 and the<br \/>\napplicant-accused has been arrested just recently and this is<br \/>\nsuggestive of the fact that he was absconding.\n<\/p>\n<p>\tHaving<br \/>\nregard to the rival contentions of the respective counsel, I am<br \/>\npersuaded to exercise discretion in favour of the applicant accused<br \/>\ntaking into consideration the following aspects :-\n<\/p>\n<p>the<br \/>\n\toffences with which the applicant-accused has been charged are under<br \/>\n\tthe Bombay Prohibition Act and the same are magistrate triable<br \/>\n\toffences; and<\/p>\n<p>the<br \/>\n\tinvestigation is over and charge-sheet is filed.\n<\/p>\n<p>\tIn<br \/>\nthis view of the matter, the applicant accused is ordered to be<br \/>\nreleased on bail in connection with the offences registered with<br \/>\nJetpur Taluka Police Station being CR.No.5094\/2009 on his executing<br \/>\nbond in the sum of Rs.25,000=00 (Rupees Twenty Five Thousand Only)<br \/>\nwith one solvent surety of the like amount to the satisfaction of the<br \/>\nlower Court and subject to the conditions that he shall,<\/p>\n<p>(a)<br \/>\nnot take undue advantage of or misuse liberty;\n<\/p>\n<p>(b)<br \/>\nmaintain law and order and should co-operate with the investigating<br \/>\nofficer;\n<\/p>\n<p>(c)<br \/>\nnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(d)<br \/>\nsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>(e)<br \/>\nnot leave the revenue limits of the city of Vadodara without the<br \/>\nprior permission of the Sessions Judge, Vadodara;\n<\/p>\n<p>(f)<br \/>\nshall mark his presence twice in a month on every 2nd and<br \/>\n4th Sunday at Sayajiganj Police Station, Vadodara;\n<\/p>\n<p>(g)<br \/>\nfurnish the address of his residence at the time of execution of the<br \/>\nbond and shall not change the residence without prior permission of<br \/>\nthis Court.\n<\/p>\n<p>\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nany other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tRule<br \/>\nmade absolute.
