Acts  y_compen's.ati'on\": of \" it\n\n?'18,00,000\/-, on accountof they.de:ath'ofntheldeceasped in the\n\nroad traf\ufb01c accident. eo\ufb01t\u00e9ndin_gf~}ir.la{\u00a3;7\u00a7'j an 23.12.1998 at\n\nabout 2:30   deceased  coming on his motor\ncycle bearing  with one Subramani as\n\npillionrider and 'when? he came near Hunasamaranahalli\n\n'' V' \u00abmist Lorry b\u00e9\u00e9fihg Reg.l\\To. CAS-- 1526 belonging to first\n\nr_espionde\"11thand_ insured with 2115 respondent driven by its\n\ndrive camelifrom opposite side in a rash and negligent\n\n \"manner sand tried to over take and dashed to the motorcycle\n\nithefdeceased. Due to which, he fell down and sustained\n\n injuries and at th time, another Lorry bearing\n\n{_M__IW_\u00a2_,_,,_,_,.\n\n\n\nReg.No.MYU--8880 belonging to third respondent and insured\nwith 4\"' respondent came and dashed to his motor cycle, due\nto which, he died on the spot. it is the further case of the\n\nappellants that, the deceased was aged about 26 years,_--hale\n\nand healthy, Goldsmith by Profession, and earning A'\n\nto ?12.000\/- per month and looking after the  \"\n\nfamily and due to his untimely death\"\"they lot.'  it\n\nsaid claim petition had come up for 'consideration' \n\nTribunal. The Tribunal after\u00bb appreciatingi the and\ndocumentary evidence and other\"v-tn'a.terial\"'available on\n\n\ufb01le, has allowed the claiirr  and awarded\n\na sum of ?_3.,:  -the liability in the ratio of\n\n50:50   2 and 4, with interest\n\n at  fronithe date of petition till its deposit. Not\n\n   the quantum of compensation, the\n\n  presented this appeal seeking\n\n' V gapprlopzriaatev reliefs.\n\n\"    have heard the learned counsel appearing\n\n for the appellants and learned counsel for Respondent\n\n  2 and 4. 6%\n\/\"MM\n\n\/\n\n\n\n5. After careful perusal of the materials available\non record, including the impugned judgment and\naward passed by the Tribunal, it emerges that, the\n\noccurrence of the accident and the death offgbthe\n\ndeceased in the said accident are not in dispute;  \n\nthe case of the appellants that, decease.d_u_:wasljaged'\n\nabout 26 years, Goldsmith by \n\n'&lt;&#039;300\/- per day. The Tribunal&#039; has assessed \n\nof the deceased at ?70\/-- perlzdaly and at: l_?&#039;:2,1V(;?0\/- per\nmonth and the same is lower  it needs to be\n\nenhanced?&#039; &quot;i&#039;It,5\u00bbvis  that, the accident was\noccurred&#039;\u00abin&quot;the&#039;yeaif&#039;&quot;and deceased was aged about\n\n26 years and by profession and there are\n\n &quot;fcur&quot;&quot;dep&#039;e&#039;ndants. Hence, we re--assess the income of the\n\n E100\/w per month. Out of which, if 1 \/491 is\n\n _ deducted&quot; toyvards the personal expenses of the\n\n~ .. .,  .jdece_aseVd,.. as per the law laid down by the Apex Court in\n\nth_Ve&quot; &#039;case of Sarla Verma and others Vs. De-Ihi\n\n\/\/f__,_,,,.,\u00bb.\n\nT  &quot;Transport Corporati%\u00a71nd another reported in 2009\n\n\n\n7\nACJ 1298, since there are four dependants, the net\nincome comes to ?&#039;2,250\/~.per month. The Tribunal has\nadopted the Multiplier of &#039;l7&#039; , as the deceased was aged\n\nabout 26 years at the time of his death and the sarnepis\n\njust and proper. Therefore, we re--deterrnine V.\n\ndependency at %4,59,000\/-{\u20ac2,250\/-- x 12 x &#039;.t7)l&#039;&#039;~._i:nst:eead &#039;\n\n$2,535,600\/-- awarded by the Tri.bun2ilmMand ._aceo:rding.I_y,_&#039;it7isl.&quot;1\n\nawarded.\n6. The Tribunal has awarded at surrxa. --\ntowards conventional heads andltnei is inadeqnate and\n\nit needs to be enhanced. l  regardio the facts and\n\ncircumstances of  and the appellant No.1 has lost\n\nher husbandat yot1ng7f1ge.,:_ll..the Appellant No.2 has lost her\n\n..v..&amp;father.i.and appxellant_____l&amp;\\los.3 and 4 has lost their son, we\n\naviirpardp   \u20ac10,000\/~ towards loss of consortium,\n\n loss of estate, \u20ac15,000\/-towards loss of\n\n--V love uand&quot;&#039;--aAi\u00b0fection at the rate of ?5,000\/~ to each of the\n\n luujappe-l_lants~ 1,2 and 3 and a sum of 310,000\/-- towards\n\n _ transportation and fune\ufb01expenses.\n\n\/3&quot;&quot;\n\nL\n\n\n\n8\n7. For the foregoing reasons, the impugned\njudgment and award passed by the Tribunal is liable to\nbe modified. The total Compensation payable Comes to\n\n?5,04,000\/-- and the break-- up is as follows:\n\nTowards Loss of dependency 4,59,000-\/   \n\nTowards loss of consortium 10,-0&#039;00,f--._ &#039; *- T &quot;\n\n55 .\nTowards loss of estate 7:&#039; l~G.Q(:3O\/&#039;{ \nTowards loss of love and affection&quot;  &#039;(&quot;4 . A &#039;.l5,_:0O0&#039;,\/&#039;-- &#039;\n\nTowards funeral and 3 1&#039;0.000,\/Hf-e..___ \n\ntransportation expenses\n\nTotal it 5.o4;o0\u00a5m.e.VVp \n\n8. Accordingly, tlaedifappealld-_ appellants is\n\nalloweddvinllv _  t1\u20ac1le~ judgment and award\npassed by&#039; MVC No.67\/1999 is hereby\n\nmodified, Ta&quot;awardii--1gA&quot;v_the&#039;l compensation of ?5,04,000\/w\n\n  golf  awarded by the Tribunal. The\n\n _eri1fianee&#039;d,_oornpensation comes to ?1,85,400\/w with interest\n\nat 6f\/:5 p.a_.  the date of petition till its realisation.\n\n Respondent Nos. 2 and 4 shall deposit the\n\n&quot;:l.lenhai*..ced compensation with interest in the ratio of 50:50\n\n within a period of four weeks from the date of receipt of a\n\n copy of this judgment and award.\n\nAM\n\n1&#039;\n\n\n\nOut of the enhanced compensation of ?1,85,4-O0\/--, a\nsum of &#039;&lt;&#039;50,000\/-with proportionate interest Shall be\n\ninvested in the Fixed Deposit in any Nationalized or\n\nScheduled Bank, in the name of the appe11ant..&#039;I\\v\u00a5oV;&#039;:ip:&#039;\n\nshe attains majority with liberty to the appeiiant.
