Justice KURIAN JOSEPH\n\n Dated :19\/07\/2007\n\n O R D E R\n                           KURIAN JOSEPH , J\n\n             ==================================\n\n                       W.P.(C) NO.  547 OF 2005\n\n             ==================================\n\n               Dated this the 19th day of July, 2007.\n\n\n\n                                 JUDGMENT\n<\/pre>\n<p>      The writ petition is filed with the following prayers:\n<\/p>\n<p>        i.       Declare   the   provisional   service   of   petitioners   as<\/p>\n<p>           regularised   service   and   also   to   declare   that   they   are<\/p>\n<p>           entitled to get increment and other service benefits on<\/p>\n<p>           the   basis   of   the   regularisation   of   service   and   seniority<\/p>\n<p>           may be fixed on that basis.\n<\/p>\n<p>      ii.   issue a writ of mandamus or any other appropriate writ,<\/p>\n<p>           order   or   direction   directing   the   1st   respondent   to<\/p>\n<p>           consider and dispose of Ext.P25 to 44.\n<\/p>\n<p>      iii.     direct   the   2nd   respondent   to   consider   and   dispose   of<\/p>\n<p>           Ext.P45.\n<\/p>\n<p>2.    It   is   stated   that   in   the   case   of   similarly   situated   persons,<\/p>\n<p>regularisation has already been effected pursuant to Ext.P22 and<\/p>\n<p>P23 judgment.   If that be so, there is no point in discriminating<\/p>\n<p>the petitioner.  There will be a direction to the 1st respondent to<\/p>\n<p>consider Exts.P25 to P44 and 2nd respondent to consider Ext.P45<\/p>\n<p>and take appropriate action in the light of Exts. P22 and P23 and<\/p>\n<p>extend   the   benefits   given   to   the   similarly   situated   persons<\/p>\n<p>covered by the judgment to the petitioners herein also.  It is also<\/p>\n<p>made   clear   that   the   petitioner   shall   be   granted   eligible<\/p>\n<p><span class=\"hidden_text\">W.P.(C). NO. 547\/2007                : 2 :<\/span><\/p>\n<p>consequential   service   benefits.
