Shah learned advocate for the applicant has submitted that<br \/>\n\tthe only reason why the applicant seeks to bring the heirs of the<br \/>\n\tdeceased respondent No.7 on record is to bring to the notice of the<br \/>\n\theirs that the decree passed in their favour by the appellate court<br \/>\n\tis a nullity.\n<\/p>\n<p>On<br \/>\n\tthe other hand, Mr. Anshin H. Desai learned advocate for the<br \/>\n\trespondents No. 1 to 6 states that the appeal before the lower<br \/>\n\tappellate forum has abated not only qua deceased respondent No.7 but<br \/>\n\tall the respondents therein.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tJ.M.Malkan learned advocate for the respondents No.13 and 14<br \/>\n\treiterates the submission made by Mr. Anshin H.Desai.\n<\/p>\n<p>A<br \/>\n\tperusal of the averments made in the application indicates that the<br \/>\n\tdeceased respondent No.7 has expired on 26th July, 2007;<br \/>\n\twhereas, the impugned judgment and decree passed by the lower<br \/>\n\tappellate court is dated 21st October, 2010. In the<br \/>\n\tcircumstances, it is evident that deceased respondent No.7 has<br \/>\n\texpired during the pendency of the appeal before the lower appellate<br \/>\n\tcourt. In the circumstances, in the absence of the heirs and legal<br \/>\n\trepresentatives of deceased respondent No.7 being brought on the<br \/>\n\trecord of Regular Civil Appeal No.106 of 2006, it was the said<br \/>\n\tappeal which stood abated qua respondent No.7.
