SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 02\/09\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner ?  original<br \/>\ndefendant has prayed for appropriate writ, order and\/or directions,<br \/>\nfor quashing and setting aside the order passed by the learned<br \/>\nChamber Judge, Court No.8, City Civil Court, Ahmedabad, below Exh.20<br \/>\nin Civil Suit No.616 of 2008 dated 04.04.2008, by which, the learned<br \/>\nChamber Judge, Court No.8 of the City Civil Court, Ahmedabad, has<br \/>\nrejected the application submitted by the petitioner ?  original<br \/>\ndefendant to appoint the Court Commissioner for preparation of<br \/>\nPanchnama and Map of the Chawl, more particularly to consider whether<br \/>\ntheir latrines in the properties were occupied by respondents No.1 to<br \/>\n7 or not.\n<\/p>\n<p>2.\tConsidering<br \/>\nthe impugned order, it appears that the learned Chamber Judge<br \/>\ndismissed the said application by holding that the dispute is not<br \/>\nregarding existence of toilets in the premises in the occupation of<br \/>\nthe plaintiffs and that the plaintiffs have come to the court with a<br \/>\ncase that they have a right of using the suit plot for various<br \/>\npurpose as mentioned in the suit. However looking to the<br \/>\ncounter-claim, the learned Chamber Judge was not right in observing<br \/>\nthat dispute is not regarding existence of toilets in the premises in<br \/>\nthe occupation of the plaintiffs. Under these circumstances looking<br \/>\nto their counter-claim, the impugned order passed by the learned<br \/>\nChamber Judge, Court No.8, City Civil Court, Ahmedabad below Exh.20<br \/>\nin Civil Suit No.616 of 2008 dated 04.04.2008  deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>3.<br \/>\n  At this stage, Shri A.I.Pathan, leraned advocate on behalf of<br \/>\nrespondents No.1 to 7 has submitted that as such the prayer of the<br \/>\npetitioner ?  original defendant for preparation of Panchnama and<br \/>\nMap of the premises was not only of the respondents No.1 to 7 but<br \/>\nother occupants also who are not before the Court. Miss N.N. Shaikh,<br \/>\nlearned advocate appearing on behalf of defendant has submitted that<br \/>\nPanchnama of the premises be restricted with regard to the existence<br \/>\nof the toilets in the occupation of the original plaintiff only.\n<\/p>\n<p>4.\tUnder<br \/>\nthese circumstances and for the reasons stated above, the petition<br \/>\nsucceeds and the impugned order passed by the learned Chamber Judge,<br \/>\nCourt No.8, City Civil Court, Ahmedabad below Exh.20 in Civil Suit<br \/>\nNo.616 of 2008 dated 04.04.2008  is hereby quashed and set aside and<br \/>\nthe learned trial Judge is directed to appoint the Court Commissioner<br \/>\nto prepare the Panchnama with respect to the existence of the toilets<br \/>\nin the premises in the occupation of the land of original plaintiffs<br \/>\n?  respondents No.1 to 7 herein only.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.\n<\/p>\n<p>\tIn<br \/>\nthe aforesaid facts and circumstances of the case, no order as to<br \/>\ncosts.\n<\/p>\n<p>[M.R.SHAH,<br \/>\nJ.]<\/p>\n<p>bddave<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Taj vs Iqbal on 2 September, 2008 Author: M.R.
