{"id":72919,"date":"2010-02-02T00:00:00","date_gmt":"2010-02-01T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/union-of-india-through-general-vs-jogeshwar-prasad-and-another-on-2-february-2010"},"modified":"2015-06-17T04:37:25","modified_gmt":"2015-06-16T23:07:25","slug":"union-of-india-through-general-vs-jogeshwar-prasad-and-another-on-2-february-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/union-of-india-through-general-vs-jogeshwar-prasad-and-another-on-2-february-2010","title":{"rendered":"Union Of India Through General &#8230; vs Jogeshwar Prasad And Another on 2 February, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Union Of India Through General &#8230; vs Jogeshwar Prasad And Another on 2 February, 2010<\/div>\n<pre>                                      -1-\n\n                                                               Court No. - 24\n\n\n        Case :- FIRST APPEAL FROM ORDER No. - 364 of 2002\n\nPetitioner :- Union Of India Through General Manager N.R.New Delhi\nRespondent :- Jogeshwar Prasad And Another\n\nPetitioner Counsel :- Anil Srivastava\nRespondent Counsel :- A.K.Srivastava\n\n\n                                  *********\nHon'ble Rajiv Sharma,J.\n<\/pre>\n<p>Hon&#8217;ble Dr. Satish Chandra,J.\n<\/p>\n<p>       This appeal is filed under Section 23 of the Railway Claims Tribunal<\/p>\n<p>Act, 1997 against the judgment and award dated 15.04.2002 passed in<\/p>\n<p>Claim Case No. O.A. 9800147 by the Railway Claims Tribunal, Lucknow<\/p>\n<p>awarding the compensation to the tune of Rs.4,00,000\/- along with interest<\/p>\n<p>@9%.\n<\/p>\n<p>       The brief facts of the case are that one Sri Ranjeet Kumar aged about<\/p>\n<p>18 years of age was travelling by 377-Up Triveni Express from Rai<\/p>\n<p>Bareilly to Lucknow on 17.09.1996. Near the signal of Harchandpur<\/p>\n<p>Railway Station, the victim fallen down and died on the spot. He was<\/p>\n<p>holding a valid ticket no.51865 which was on record. So, he was a<\/p>\n<p>bonafide passenger. For the negligence, the Tribunal has awarded statutory<\/p>\n<p>compensation of Rs.4.0 lacs against the appellant-railway. Not being<\/p>\n<p>satisfied, the appellant &#8211; railway has filed the present appeal.<\/p>\n<p>       None appeared on behalf of the opposite party. However, Sri Anil<\/p>\n<p>Srivastava, learned counsel for the appellant-railway submits that the<\/p>\n<p>deceased had fallen down due to his own negligence. He was travelling on<\/p>\n<p>the foot board of the train which is prohibited in view of the Section 156 of<br \/>\n<span class=\"hidden_text\">                                      -2-<\/span><\/p>\n<p>the Railways Act, 1989 read with section 154. He also submits that in<\/p>\n<p>Railways, travelling on roof, foot board and engine is prohibited. Section<\/p>\n<p>124-A of the Act provided the exception for the self injury and Criminal<\/p>\n<p>Act. However, on the specific quarry from the Bench, he accepted that the<\/p>\n<p>deceased was the bonafide passenger of the train no. 377 -Up, Triveni<\/p>\n<p>Express. Lastly, he submits that since the deceased alone was responsible<\/p>\n<p>for the aforesaid negligence, as such, the claimants are not entitled to any<\/p>\n<p>compensation.\n<\/p>\n<p>      By considering the arguments and the material available on record, it<\/p>\n<p>appears that the deceased was the bonafide passenger. No material was<\/p>\n<p>brought on record to prove that this is the case of death or suicide or death<\/p>\n<p>resulting from any criminal Act. The deceased was returning from a Rally<\/p>\n<p>organized by Bahujan Samajwadi Party. So, he was having a political<\/p>\n<p>affiliation and aspiration. There was no question for committing suicide.<\/p>\n<p>The accident occurred when suddenly the driver of the train applied the<\/p>\n<p>break near the signal of Harchandpur Railway Station. The deceased who<\/p>\n<p>was travelling on the foot board of the train fallen down on the track and<\/p>\n<p>died on the spot.\n<\/p>\n<p>      This Court in the case of Smt. Akhtari v. Union of India (FAFO No.<\/p>\n<p>100 of 2003) observed that there is no restriction with regard to sale of<\/p>\n<p>ticket for unreserved compartment. Railway does not provide any<\/p>\n<p>mechanism for the automatic closer of the doors of the compartment when<\/p>\n<p>a train leaves the platform like Metro train. In the absence of appropriate<\/p>\n<p>safeguard unreserved compartments are over crowded compelling the<\/p>\n<p>people to stand in front of the door of the compartment.<br \/>\n<span class=\"hidden_text\">                                       -3-<\/span><\/p>\n<p>       It is settled law that right to life is fundamental right, guaranteed<br \/>\nunder Article 21 of the Constitution of India, Once the Railway issues the<br \/>\ntickets to board the train, then it is the duty of the Railway to take<br \/>\nnecessary measures for safety and security of the passengers. It is for the<br \/>\nRailway to take steps or provide appropriate measures or infrastructures, so<br \/>\nthat whenever the train moves from the platform, the doors are closed.<br \/>\nWhether it is reserved or unreserved compartment, the life of citizen<br \/>\ncannot be put to risk. Lives of people travelling in reserved compartment<br \/>\ncannot be treated superior to the people travelling in unreserved<br \/>\ncompartment. So far as security measures are concerned, that should be<br \/>\ntaken by the Railway uniformly for the reserved and unreserved<br \/>\ncompartments. Necessary steps must be taken by the Railway through<br \/>\nmechanical device or by appointment of appropriate staff, so that<br \/>\nwhenever, train moves from the platform, the doors must be closed and on<br \/>\narrival of train on platform, it may be opened. The Railway or the<br \/>\nGovernment cannot shirk from its responsibility with regard to the safety<br \/>\nand security of the passengers travelling by train or using the platform.<br \/>\nNeedless to mention that as per legal maxim- Salus Populi Est Supreme<br \/>\nLex means &#8220;regard for the public welfare is the highest law&#8221;\n<\/p>\n<p>       Needless to mention that the lives of the people travelling in second<br \/>\nclass or upper class are equally precious for the respective family and<br \/>\nnation. It does not make any difference as to whether the passengers are<br \/>\ntravelling in the second class or upper class. The burden lies on the railway<br \/>\nto make necessary arrangements by mechanical \/ electronic \/ manual<br \/>\ndevice so that the even to departure of the train from platform, the doors<br \/>\nare shut and on arrival at the station, it may be open. Further, it is the duty<br \/>\nof the railway to make necessary arrangements to regulate the safe entry of<br \/>\nthe passengers in the compartments.         Section 57, 58 and 59 have been<br \/>\nprovided in the Act to secure safety measures and welfare of the people at<br \/>\nlarge. The burden lies on the Railway to give effect the statutory provisions<br \/>\nin its letter and spirit.\n<\/p>\n<p>       We expect that railway shall look into this aspect of the matter for<br \/>\nsafety and security of the passengers by taking necessary steps at the<br \/>\nearliest.\n<\/p>\n<p><span class=\"hidden_text\">                                      -4-<\/span><\/p>\n<p>      In the light of the above discussion and by considering the facts and<br \/>\ncircumstances of the case, we do not find any illegality or perversity in the<br \/>\norder of the Tribunal. The impugned order of the Tribunal is hereby<br \/>\nsustained along with the reasons mentioned therein.\n<\/p>\n<p>      The appeal filed by the Railway department is devoid of merit.
