ORAL JUDGEMENT
\n #. Rule.    Mr.P.K.Pancholi, learned Additional Public
\nProsecutor, waives service of Rule on behalf of State.\n<\/p>\n
#.   This is a post-chargesheet application praying for
\nbail by the applicant following his arrest on 15th July,
\n2003 in connection with Himmatnagar Police Station vide
\nC.R.No.I-204\/2003 for offences punishable under sections
\n392 and 114 of the Indian Penal Code.\n<\/p>\n
#. Learned advocate for the applicant contended that
\nexcept identification by victim and the complainant,
\nthere is no other evidence against the applicant. There
\nis   no recovery from him. Co-accused – Bhukhanbhai
\nKarsanbhai Parmar is already released on bail by this
\nCourt vide order dated 19.2.2004 in Criminal Misc.
\nApplication No.951 of 2004, and therefore, the applicant
\nmay be enlarged on bail.\n<\/p>\n
#.    The   application is opposed by learned A.P.P.
\nMr.Pancholi. He submitted that role attributed to the
\napplicant is totally different than the role attributed
\nto Bhukhanbhai Karsanbhai Parmar and therefore, parity
\ncannot be claimed by the applicant. He submitted that the
\napplication may be rejected considering the nature of
\noffence.\n<\/p>\n
#. Having regard to the contentions raised before this
\nCourt, it would be appropriate to briefly state the
\nmanner in which the incident has occurred. Complainant –
\nRajeshbhai and his fiancee Falguniben were sitting on the
\nbank of canal near highway at about 3:30 p.m. when it is
\nalleged that at around 5:00 p.m., the applicant, along
\nwith co-accused persons, arrived there and on tip of
\nknife, robbed Falguniben of a gold chain worn by her
\naround her neck and Rs.850\/= from the purse and then fled
\naway on their vehicles.\n<\/p>\n
#. It was vehemently contended that there is no recovery
\nfrom the applicant, but it cannot be overlooked that the
\napplicant has been identified by the victim Falguniben as
\nwell as the complainant who is an eye-witness to the
\nincident.    The case of parity also cannot be accepted
\nbecause as observed by this Court in order          dated
\n19.2.2004, Criminal Misc. Application No.951 of 2004, it
\nis clear that the said co-accused Bhukhanbhai Karsanbhai
\nParmar was enlarged on bail considering the fact that he
\nwas not identified and there was no recovery from him. It
\nwas also observed that the role of that accused was quite
\ndifferent than the role of the present applicant –
\nKamleshbhai.\n<\/p>\n
 #.   The order of the Sessions Court also indicates that
\nconsidering involvement of the applicant and role played
\nby him, the Sessions Court was not inclined to exercise
\ndiscretion in favour of the applicant.    This Court is
\nalso not inclined to exercise its discretion in favour of
\nthe   applicant considering the manner in which the
\nincident has occurred and the role attributed to.\n<\/p>\n
#.   It was argued that as per the statement of victim
\nFalguniben as well as the complainant, it is stated that
\nthe applicant was wearing handkerchief on his face. It
\nwould be appropriate to not that in that very statement,
\nFalguniben has given description of the assailants and
\nhas stated that she can identify the assailants.    Under
\nthe circumstances, at this stage, the Court cannot enter
\ninto the arena of evaluation of evidence and          the
\ncontention cannot be accepted. The application must fail
\nand is rejected. Rule is discharged.\n<\/p>\n
