 Heard Mr. Rawal, learned Senior counsel
\n     for the applicant.     This application is filed by one
\n     Balubhai Bhagabhai Rada, municipal councillor of Junagadh
\n     Municipality seeking an order of this Court to implead
\n     him as a party in the Special Civil Application no.1227
\n     of 1997.\n<\/p>\n
     2.Special Civil Application No.     1227 of
\n     1997 is filed by one Satishkumar Ahir under Articles 226
\n     and 227 of the Constitution of India to challenge the
\n     order passed by the Director of Municipalities, State of
\n     Gujarat on 3rd February, 1997 under section 37 of the
\n     Gujarat Municipalities Act,1963.      The proceeding under
\n     section 37 of the Gujarat Municipalities Act,1963 was
\n     initiated    against    the petitioner in Special Civil
\n     Application no. 1227 of 1997 by issuing a notice dated
\n     6\/13.2.1996.    The provisions of section 37 will have to
\n     be considered here in order to consider the claim of the
\n     petitioner    and    that   section  37   of the Gujarat
\n Municipalities Act,1963 is running as under:\n<\/p>\n
“37 (1) The State Government may remove from office-\n<\/p>\n
(a)any councillor of a municipality, (on its own
\nmotion    or on receipt of) a recommendation of the
\nmunicipality in that behalf supported by a majority of
\nthe    total   number of the then councillors of the
\nmunicipality, or\n<\/p>\n
(b)any    president   or   vice-president    of    a
\nmunicipality,<\/p>\n
if, after giving the councillor, president or as the case
\nmay be, vice-president an opportunity of being heard and
\ngiving due notice in that behalf to the municipality and
\nafter making such inquiry as it deems necesssary, the
\nState Government is of the opinion that the councillor,
\npresident or as the case may be,vice president has been
\nguilty of misconduct in the discharge of his duties or of
\nany disgraceful conduct or has become incapable of
\nperforming his duties under this Act.\n<\/p>\n
(2)A   president or vice-president removed under
\nsub-section (1) shall not be eligible for re-election as
\na president or vice president during the remainder of the
\nterm of the municipality.”\n<\/p>\n
If the above provisions of section 37 are
\nconsidered, then it would be quite clear that the action
\ntaken against the petitioner in Special Civil Application
\nNo. 1227 of 1997 is initiated by the State Government
\nand   it   is not initiated either by the municipal
\ncouncillor or by any individual. Therefore, the claim of
\nthe applicant that proceeding under section 37 of the
\nGujarat Municipalities Act, 1963 was initiated against
\nthe petitioner in Special Civil Application No. 1227 of
\n1997 at his instance could not be believed and accepted.\n<\/p>\n
3.The main claim of the applicant to allow
\nhim to join in this petition is on account of his filing
\nSpecial Civil Application No.     9972 of 1996.       The
\npetitioner in Special Civil Application no. 1227 of 1997
\nhas clearly stated as a fact in para 3.8 of his petition
\nthat the present applicant of this application, namely
\nBalubhai Bhagabhai Rada had filed that Special Civil
\nApplication No. 9972 of 1996 in the nature of a public
\ninterest litigation. The copy of the order passed in the
\nsaid   petition   annexed to this application by the
\napplicant also clearly indicates that that petition was
\nentertained in the public interest.       In that Special
\nCivil Application no. 9972 of 1996, a grievance was made
\nby the present applicant that though action was initiated
\n against the petitioner who is the President of Junagadh
\nMunicipality, in Special Civil Application No. 1227 of
\n1997, in the month of February,1996, the Director of
\nMunicipalities, Gujarat State has not given any final
\ndecision on the said show cause notice issued by him
\nunder section 37 of the Gujarat Municipalities Act, 1963.
\nTherefore, the Division Bench of this Court had directed
\nthe Director of Municipalities to give his decision on
\nthe said show cause notice issued by him under section 37
\nof the Gujarat Municipalities Act, 1963. Accordingly,
\nthe Director of Municipalities has passed his order dated
\n3.2.1997 and therefore, the President Satiskumar Ahir has
\nfiled this Special Civil Application no. 1227 of 1997 to
\nchallenge the order of Director of Municipalities passedo
\non 3.2.1997 by which he has been removed from the office
\nas a councillor of Junagadh Municipality.\n<\/p>\n
4.If the nature of proceedings which are
\ninitiated    against    the petitioner in Special Civil
\nApplication No.1227 of 1997 are seen, then it should be
\nquite clear that in the said proceedings, the present
\napplicant in this civil application no. 1689 of 1997 was
\nnot a party.       If the nature of the proceeding as
\ncontemplated    by    section    37    is    also taken into
\nconsideration, then it could not be said that he is
\neither a necessary or a proper party to the initiation of
\nproceedings against the petitioner in Special Civil
\nApplication no.1227 of 1997. It could not be said that
\nhe is a proper or necessary party for a proceeding to
\nchallenge the order passed under section 37 of the
\nGujarat Municipalities Act, 1963.           Merely because the
\napplicant happens to file the petition no. 9972 of 1996,
\nit could not be said that he is a necessary party to the
\nproceeding of Special Civil Application no. 1227 of 1997
\nwhich is   before     this    Court.      The nature of the
\nproceedings of Special Civil Application No.          9972 of
\n1996   was    quite    different     proceeding against the
\npetitioner. There as a citizen the applicant before me
\nhad moved the High Court to exercise the powers of the
\nHigh Court under Article 226 of the Constitution for
\nissuing the direction to the Director of Municipalities
\nto pass a final order in the proceedings initiated by him
\nunder section 37 of the said Act. The learned advocate
\nfor the applicant Mr.         Rawal urged before me that the
\napplicant had filed that petition no. 9972 of 1996 as a
\ncouncillor of Junagadh Municipality.           But if the said
\nproceeding is taken into consideration, then it would be
\nquite clear that no provisions of Gujarat Municipalities
\nAct, 1963 or any other Act had conferred upon him any
\npowers to move such an application before the High Court,
\nbut that application was entertained as an application by
\n a citizen seeking a writ of mandamus to direct the
\ndirector of Municipalities to pass an appropriate final
\norder.   Merely because the applicant happens to be a
\nmunicipal councillor, it could not be said that the said
\npetition by him was entertained or allowed. The said
\npetition was allowed because of inaction on the part of
\nthe Director of Municipalities in not passing the final
\norder in the proceeding initiated by him. Therefore, the
\nsaid Special Civil Application NO. 9972 of 1996 has no
\nbearing on the controversy which is involved in Special
\nCivil Application no. 1227 of 1997.      Therefore, merely
\nbecause the applicant was the petitioner in Special Civil
\nApplication NO. 9972 of 1996, he could not be permitted
\nto be joined as a party in          this    special  civil
\napplication.\n<\/p>\n
5.Thus, in view of the nature of the
\nproceeding of Special Civil Application no. 1227 of 1997,
\nthe present applicant could not be said to be either a
\nnecessary or a proper party to the said proceeding.
\nThere may be political rivalry between the parties. , But
\nthe existence of political rivalry between political
\nparties could not be a foundation allowing a party to
\nappear in a proceeding in which he could not be a
\nnecessary or proper party.      I therefore, reject this
\napplication with no order as to costs.\n<\/p>\n
