(2) 605 JT 1990 (4)\t265\n 1990 SCALE  (2)853\n\n\nACT:\n    Hindu Succession Act, 1956--Section 15(1)(a)--Succession\nto   estate  of\t Hindu\twidow--Daughter\t of   the   deceased\nson--Preferential heir--Entitled to succession.\n\n\n\nHEADNOTE:\n    Santi married Kisso and gave birth to a son, the  father\nof  the appellant. On the death of Kisso, Santi married\t his\nbrother, Ditto, who died issueless.\n    On\tthe death of Ditto, the mutation of his\t estate\t was\nsanctioned  in\tSanti's name, being his widow.\tShe  was  in\npossession of the same as life-Estate holder. She executed a\ngift-deed in favour of her grand daughter, the appellant  on\nDecember 27, 1955 and she died on October 6, 1956, after the\ncommencement of the Hindu Succession Act.\n    Kissi,  the sister of Santi's husbands flied a suit\t for\npossession  contending that she was a preferential  heir  of\nthe suit property, and that the property had been  illegally\nmutated in the name of the appellant.\n    The trial Court dismissed the suit holding that  without\nchallenging  the gift deed, the suit for possession was\t not\ncompetent.\n    Meanwhile  Kissi, the plaintiff, having died, her  heirs\nthe  respondents  preferred an appeal  before  the  District\nJudge.\tAn application to amend the plaint, so as  to  chal-\nlenge the validity of the gift was also flied. The  District\nJudge  allowed the application and the appeal, and  remanded\nthe case for fresh trial.\n    Holding  the  gift to be invalid, the Trial\t Court\tdis-\nmissed\tthe  suit  on the ground of  limitation,  which\t was\naffirmed by the District Judge, in appeal.\n    The\t Respondents' Second Appeal to the High\t Court,\t was\nallowed\t by a Single Judge who reversed the findings of\t the\nCourts below on the issue of limitation.\n476\n    The Letters Patent Appeal against the aforesaid judgment\nwas dismissed.\n    The appellant in this Court has contended that the\tgift\nbeing  invalid,\t Santi,\t the grandmother  of  the  appellant\ncontinued  to be a limited owner till the date of  the\tcom-\nmencement of the Hindu Succession Act, 1956, and  thereafter\nby  virtue  of the provisions of the Act,  she\tbecame\tfull\nowner  of  the\tsuit-property and the  appellant  being\t the\ndaughter of a predeceased son of Santi was the\tpreferential\nheir  under section 15(1)(a) of the Act and was entitled  to\nsucceed\t to  the  property. The\t respondents  contended\t the\nappeal\tcontending that unless it was factually proved\tthat\nappellant's father was the son of Santi, the appellant could\nnot get the benefit of section 15 of the Act.\nAllowing the appeal, this Court.\n    HELD:  1. The appellant being daughter of a\t predeceased\nson  was  entitled to succeed to the property  of  Santi  in\npreference to the respondents-plaintiffs. [479D]\n    2.\tSanti  held the property as limited owner  till\t the\ncoming into force of the Act. She became full owner thereaf-\nter.  When  she died on October 6, 1956\t succession  to\t her\nproperty  was to be governed by the Act. Santi\thaving\tdied\nintestate, succession to her property was to be governed  by\nSection 15 read with Section 16 of the Act. Appellant  being\nthe daughter of a predeceased son of Santi she had the first\npreference  to\tsucceed under Section 15(1)(a) of  the\tAct.\n[479B-C]\n    This  Court found sufficient material on the  record  to\nprove  that  the appellant's father was the  son  of  Santi.\n[479B]\n\n\n\nJUDGMENT:\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mst.
