Considering<br \/>\nthe role attributed to the applicant as reflected in the FIR, police<br \/>\npapers, provisions of Sections 395, 397, 341 and 120(B) of the Indian<br \/>\nPenal code and Section 135 of the Bombay Police Act, quantum of<br \/>\npunishment etc., I am of the view that the applicant deserves to be<br \/>\nenlarged on bail. However, stringent terms and conditions are<br \/>\nrequired to be imposed while releasing the applicant on bail.\n<\/p>\n<p>\tFor<br \/>\nthe foregoing reasons, the application is allowed and the applicant<br \/>\nis ordered to be enlarged on bail in connection with C.R. No. I &#8211; 47<br \/>\nof 2009 registered with Vedavadar (Bhal) Police Station, on executing<br \/>\na bond of Rs.10,000\/- [Rupees ten thousand only] with one surety of<br \/>\nthe like amount to the satisfaction of the trial court and subject to<br \/>\nthe conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of first week<br \/>\nof every English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
