SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 18\/10\/2011 \n\n \n\n \n\t\t\t\t\n ORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>1.\t\tBy<br \/>\nway of this Appeal, the appellant has challenged the judgment and<br \/>\norder dated 3.3.2011 passed by the learned Single Judge in Special<br \/>\nCivil Application No. 2521 of 2011 whereby the award dated 14.12.2010<br \/>\npassed by the Labour Court, Rajkot in Reference (LCR) No. 176 of 2000<br \/>\nhas been confirmed.\n<\/p>\n<p>2.\t\tMs.R.V.Acharya,<br \/>\nlearned counsel appearing for the appellants submitted that the<br \/>\nrespondent employee was appointed as a meter reader through<br \/>\ncontractor and he was never the employee of the<br \/>\nappellants-petitioners. However, while considering the case of the<br \/>\nappellants, the learned Single Judge has observed in paragraphs 5.1<br \/>\nto 5.6 as under:\n<\/p>\n<p>&#8220;5.1 It<br \/>\nappears that all of the documents mentioned in the application were<br \/>\nnot produced and that therefore the labour Court was requested to<br \/>\ndraw adverse inference.\n<\/p>\n<p>5.2 It also<br \/>\ncomes out from the record that the labour Court, after having<br \/>\nconsidered the pleadings and material on record, had farmed four<br \/>\nissues including the issue as to whether there was<br \/>\nemployment-employee relationship between the petitioner board and the<br \/>\nrespondent workman or not.\n<\/p>\n<p>5.3 The<br \/>\nfindings recorded by the labour Court with regard to the issues<br \/>\nframed by it, are finding of facts.\n<\/p>\n<p>\tThe said<br \/>\nfindings have been recorded by the Court on the basis of the evidence<br \/>\nplaced before it. The petitioners seem to challenge such findings.<br \/>\nThe re-appreciation of the evidence and that too with a view to<br \/>\nsetting aside finding of facts and\/or arriving at different<br \/>\nconclusion in respect of factual aspects, is neither within the scope<br \/>\nof petition under Article 226 and 227 of the Constitution of India<br \/>\nnor permissible.\n<\/p>\n<p>5.4 In the case<br \/>\nbetween <a href=\"\/doc\/26503\/\">Mohd. Yunus, v. Mohd. Mustaqim (AIR<\/a> 1984 SC 38) the Apex<br \/>\nCourt has observed as follows:-\n<\/p>\n<p>&#8220;A  mere<br \/>\nwrong  decision  without anything more is not  enough to attract the<br \/>\njurisdiction of the High  Court under Article 227. The supervisory<br \/>\njurisdiction conferred on the High Courts under Article 227 of the<br \/>\nConstitution is limited &#8220;to seeing that an inferior Court or<br \/>\nTribunal functions within the limits of its authority&#8221; and not<br \/>\nto correct an error apparent on the face of the record much less an<br \/>\nerror of law. In exercising the supervisory power under Article 227,<br \/>\nthe High Court does not act as an Appellate Court on Tribunal. It<br \/>\nwill not review or re-weigh the evidence upon which the determination<br \/>\nof the inferior court or tribunal purports to be based or to correct<br \/>\nerror of law in the decision.&#8221;\n<\/p>\n<p>5.5 Even<br \/>\notherwise, on perusal of the award it emerges that the labour Court<br \/>\nhas taken into account cross-examination of the petitioner&#8217;s witness<br \/>\nwho, during his cross-examination admitted that it was true that<br \/>\nduring November 1991 the respondent workman had carried out the Job<br \/>\nof Meter Reading in Aaji         sub-division and Sorathiya Vadi,<br \/>\nsub-division and that he nowhere stated that the respondent workman<br \/>\nwas engaged as independent contractor.\n<\/p>\n<p>5.6 The labour<br \/>\nCourt has also recorded the admission of the witness that it was true<br \/>\nthat the respondent was paid his renumeration and not commission.&#8221;\n<\/p>\n<p>3.\t\tNo<br \/>\ndocument is produced before the Labour Court as well as before the<br \/>\nlearned Single Judge. Therefore, the view taken by the learned Single<br \/>\nJudge is just and proper. No interference is called for. The Appeal<br \/>\nis devoid of merits and it is accordingly dismissed.
