J .. delivered the following:\n\nJ U D G M E N T\n<\/pre>\n
One Bibijan is the deceased. One Akbar is the
\nneighbour of the deceased. The accused is the friend of one
\nBabu~PW3 who is the son of the deceased. On 14.3.2003 at
\n5 p.m., the accused visited the house of the deceased. PW3
\nand his Wife had gone to Shivajinagar market; the deceased
\nWas alone in the house. CW3 Shahira and CW4 Yasrneen
\nneighbours were present at the house. The accused came
\nand enquired about PW3. The deceased told that PW3 had
\ngone to market. The accused abused that the deceased
\nob}ects his visit to the house, therefore, pushed her inside.
\nCW3 and CW4.\u00bb object the accused for his misbehavior. The
\naccused with the knife threatens CW3 and CWQ and they go<\/p>\n
away from the place. The accused took the deceased inside<\/p>\n
%\/<\/p>\n
the house throttled her neck, also fisted and assaulting her.
\nThereafter the accused \ufb02ed away from the scene. PW2 and
\nPW3 come to the house, they found the deceased iying
\nunconscious. PW3 sprinkled water, the deceased become
\nconscious. The deceased informs the incident and she is take
\nto PS. The statement of the deceased is recorded at E:-::.P.1.
\nThereafter the deceased is taken to the hospitai. The
\ndeceased had sustained only some simple injuries on the
\nface. The doctor after examination sent her back to the<\/p>\n
house. The deceased died on the next day at 11.55 p.rn.\n<\/p>\n
The PM report discioses that there was extensive
\nhaemorrhage and congestion in the kidney and death is as a<\/p>\n
result of cardiac failure on account of the injuries sustained.\n<\/p>\n
The accused is charged for committing offences
\npunishable u\/ s 302 IPC.\n<\/p>\n
The prosecution has projected PW1–grand son of the
\ndeceased as eye witnesses to the incident. His evidence
\ndiscloses that when he returned home at 5 p.m. he finds the<\/p>\n
accused was sitting on the chest of the deceased and<\/p>\n
%\/<\/p>\n
throttling her neck. CW3 and CW4 were also present at the
\nscene. The presence of PW1 at the scene at the time of the
\nincident is not mentioned in the FIR. The FIR version
\ndiscloses that later on PW2 and PW3 came and found the
\ndeceased lying unconscious and they sprinkled water, the
\ndeceased become conscious, thereafter complaint is lodged.
\nThe FIR Version discloses that CW3 and CW4 are eye
\nwitnesses to the incident. The said witnesses are not<\/p>\n
examined by the prosecution. PW2 and PW3 are not<\/p>\n
witnesses to the incident. They at the best would be
\nwitnesses for oral dying declaration. The complaint of the
\ndeceased marked at Ex.P1 assumes the character of dying
\ndeclaration. The trial court on the basis of the evidence
\nconvicted the accused for the offence punishable u\/ s 302
\nIPC. The accused is in appeal.\n<\/p>\n
The dying declaration at EXP} is credible and
\nclinchingly establishes the incident. However, the nature of
\ninjuries caused on the deceased mentioned in the PM report
\nis as under:\n<\/p>\n
” i} Left black eye present.\n<\/p>\n
\u00a3O\/<\/p>\n
ii} Contusion present just above the middle of the
\nleft eye brow measuring 3 Cm X 2 cm.\n<\/p>\n
iii) Contusion present over left cheek prominence
\nmeasuring 4 cm X3 CM.\n<\/p>\n
iv} Contusion present over right side of neck 8 cms
\nBelow eight angle of jaw measuring 4Cm X 2
\nCM.\n<\/p>\n
The doctor–PW1l who conducted the PM was not able to
\ngive opinion immediately after the RM. the organs i., Heart,
\nPieces of lungs, pieces of liver, spleen, half of each kidney
\nand brain were sent to Histopathological examination. The
\nPM report discloses that the kidney shows extensive
\nhaemorrhage and congestion. The brain, lung, liver, heart
\nfound to be normal. The doctor has stated that the death is
\ndue to cardiac failure as a result of the injuries sustained.
\nThe medical report does not clinchingly establish that the
\ninjury caused by the accused has resulted in the death. The
\ninjuries caused by the accused on the face and at the neck
\nare all simple in nature. A} the vital organs are intact. The<\/p>\n
death takes place almost 18 hours after the incident. The<\/p>\n

deceased was also examined some time immediately after the
\nincident and she was found normal. The injuries caused by
\nthe accused have no propencity to cause damage to the
\nkidney. resulted cardiac failure. The deceased is an old lady,
\naged about 85 years. It is quite natural that on account of
\nkidney failure, the deceased died of cardiac failure and not
\non account of the injuries in\ufb02icted by the accused. The death
\nis a natural death. in that view of the matter, the conviction<\/p>\n
of the accused u\/s 302 IPC is bad in law. the same is set<\/p>\n
aside. However, the prosecution has proved that the injuries
\ncaused on the deceased are simple in nature, hence, the
\naccused is convicted for an offence punishable u\/ s 323 IPC.\n<\/p>\n
The appeal is partly allowed. The order of conviction of
\nthe accused for an offence punishable u\/s 302 IPC is
\nmodi\ufb01ed to Sec. 323 IPC. Hence, the accused is convicted
\nfor an offence punishable 21\/ s 323 IPC.\n<\/p>\n
The accused is in detention for over a period of five
\nyears. Hence, the accused is deemed to have served the<\/p>\n
punishment prescribed to Sec. 323 IPC.\n<\/p>\n
