DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>This<br \/>\n\tapplication is filed under Section 439 of the Code of Criminal<br \/>\n\tProcedure in connection with first information report registered at<br \/>\n\tCR No.I 31 of 2010 with &#8220;C&#8221; Division Police Station,<br \/>\n\tBhavnagar for the offences punishable under Sections 302 etc. of the<br \/>\n\tIndian Penal Code and 135 of the Bombay Police Act.\n<\/p>\n<p>Learned<br \/>\n\tcounsel appearing for the applicant submits that charge sheet is<br \/>\n\tfiled.  It is further submitted that considering the nature of<br \/>\n\tdispute and initially applicant suffered serious injury of knife<br \/>\n\tblow hurled by the deceased and by snatching the said knife in<br \/>\n\tself-defence the applicant gave blow and the victim succumbed to the<br \/>\n\tinjuries.  It is further submitted that there was no intention on<br \/>\n\tthe part of the applicant to commit the crime.  It is further<br \/>\n\tsubmitted that considering the overall facts and circumstances of<br \/>\n\tthe case, the applicant is required to be enlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused coupled with the fact<br \/>\n\tthat charge sheet is filed,  without discussing the evidence in<br \/>\n\tdetail, at this stage, I am inclined to grant anticipatory bail to<br \/>\n\tthe applicants.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith first information report registered at C.R. No.I 31 of 2010<br \/>\n\twith &#8220;C&#8221; Division Police Station,  Bhavnagar  on<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five thousand only) with one<br \/>\n\tsurety of the like amount to the satisfaction of the trial Court and<br \/>\n\tsubject to the conditions that he shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\tpresence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>The<br \/>\n\tAuthorities will release the applicant only if not required in<br \/>\n\tconnection with any other offence for the time being.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbond to be executed before the lower court having jurisdiction to<br \/>\n\ttry the case.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the<br \/>\n\tobservations of preliminary nature, qua the evidence at this stage,<br \/>\n\tmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
