This Criminal Appeal is filed u\/s.378{1) of Cr.P.C., by
\nthe State RP for the State praying to grant leave to file an appeal
\nagainst the Judgement dt.6.2.2004 passed by the S.J, Mandya in<\/p>\n
S.C.No.~’~i6 \/ 2002, acquitting thegrespondentaccused for the’aofi7ence
\np\/u\/s.302 r\/w.34 XPC. ‘   <\/p>\n
This appeal coming on for hearing. this  <\/p>\n
RAD, J, delivered the following\u00bb<\/p>\n
JUDGMENT  A 3 ‘<\/p>\n
The Respondents 1 and 2 beforell<\/p>\n
the Trial Court {for short “Al  and  –$ikan1d’a’1A’ Khan is the<\/p>\n
deceased and he is the   is  to have illicit<\/p>\n
relationship with\n<\/p>\n
2.  case’  deceased was harassing
\nand insisting ‘A_2″to ._p’r’os’titution. A1 and A2 did not like<\/p>\n
the conduct of V_:dec.e’ased  this regard. On 10.12.2001, A1<\/p>\n
;_f5l(‘,\u00a7\u00a7_th\u00e9.c._dec:6:ased on”a”s’c’ooter towards Mahadevapura. He has<\/p>\n
killed and dead body was thrown in the jungle. The<\/p>\n
* v,,.,,__,.v.dead  was \ufb01\u00e9a\u00e9ed on the same day at about 4.45 pm. On the<\/p>\n
 of one”:MahashimrnadasiP.W.1 near whose farm, the dead<\/p>\n
 waslying, the police registered a UDR case. The identity of<\/p>\n
1′  the’ body was not known at that time. The photographs were taken<\/p>\n
 ._and the clothing of the deceased was preserved. The dead body<\/p>\n

was subjected to post mortem. The P.M. report chscloses that the<\/p>\n
death is due to shock and hemorrhage as a result of.-“injury<\/p>\n
sustained to the major necklblood vessels by a <\/p>\n
weapon. The photo of the deceased was published inxa’ <\/p>\n
P.W.5. P.W.6 and P.W.23, the I-e1a:1vgsAA\u00bb’ oftheldleceasled\ufb02haveu ”<\/p>\n
identified the photographs as that of   <\/p>\n
persons are charged for committing offence tinder  reads V L’<\/p>\n
with Section 34 IPC. The preo.sect1tion addticpedll following<\/p>\n

dead body. P.W.7 and P.W.8 support to testify to<\/p>\n
extra-judicial Eonfession.\n<\/p>\n

3. The weapons and the bl0od–stained clothing ig’of.gthe<\/p>\n
accused are seized. They are sent to FSL along with <\/p>\n
clothes of the deceased. The trial Court has <\/p>\n
deceased was insisting A2 to indulge inhlprostitutlon’ t.hat._appears<\/p>\n
to be a provocative circumstance to cau’s__e”the murder, 2 i~ience’,~_<\/p>\n
convicted the accused under Section x’1hel\u20ac3\u00bbtai}e<\/p>\n

4. On thorough considieratiior1V..  theleiriydence, We of the<\/p>\n
opinion that  ;;u1;i712\u20ac_xi%ho”:_’siip\ufb01oi~t–io testify to the last<\/p>\n
seen circumstance  anti  being together, have turned
\nhostile andjdo _not’f7si1pp3ortuthe’___prosecut1on case. P.Ws.7 and 8<\/p>\n
who support\/have giyenfieiitraijudicial confession, have turned<\/p>\n
hostile and. do  support the prosecution case. The blood-<\/p>\n
 “clothand..weaponhave been sent to FSL, but the serologz<\/p>\n
report is.’ to show that blood group on the blood-<\/p>\n
‘ l”=w\u00bbsta1nelci ,clothv_dolesnot tally with the blood group of the deceased.<\/p>\n

   the motive and that death is homicidal. On these two<\/p>\n
‘ f circumstances, the order of conviction recorded is bad in law. The<\/p>\n
