Justice THOMAS P.JOSEPH\n\n Dated :08\/09\/2010\n\n O R D E R\n                   THOMAS P.JOSEPH, J.\n           ====================================\n                    W.P(C) No.27831 of 2010\n           ====================================\n         Dated this the 08th  day of September,   2010\n\n\n\n\n                        J U D G M E N T\n<\/pre>\n<p>      Heard learned counsel for petitioners and respondent Nos.7<\/p>\n<p>to 9.\n<\/p>\n<p>      2.   Petitioners along with others filed O.S.No.39 of 2005 in<\/p>\n<p>the court of learned Sub Judge, North Paravur for a decree for<\/p>\n<p>prohibitory injunction and other reliefs. That suit was withdrawn<\/p>\n<p>and transferred to the court of learned First Additional District<\/p>\n<p>Judge, Ernakulam and renumbered as O.S.No.28 of 2005.<\/p>\n<p>Respondent Nos.7 to 9-contesting defendants raised a contention<\/p>\n<p>that the suit is not maintainable since leave of the court under<\/p>\n<p>Section 92 of the Code of Civil Procedure was not obtained.<\/p>\n<p>Learned Additional District Judge accepted that contention and<\/p>\n<p>dismissed O.S. No.28 of 2005 as per judgment and decree dated<\/p>\n<p>04.09.2010. Grievance of petitioners is that until disposal of the<\/p>\n<p>suit there was an arrangement between the parties in the matter<\/p>\n<p>of conduct of Holy Mass and other religious functions in the Church<\/p>\n<p>involved but that has come to an end by the dismissal of the suit<\/p>\n<p>W.P(C) No.27831 of 2010<br \/>\n<span class=\"hidden_text\">                                 -: 2 :-<\/span><\/p>\n<p>and there is possibility of dispute between the parties arising in<\/p>\n<p>the conduct of Holy Mass and other religious functions in the<\/p>\n<p>Church. Petitioners have not obtained a copy of judgment and<\/p>\n<p>decree to challenge the same before appropriate court. In the<\/p>\n<p>circumstances petitioners seek direction in the matter of conduct<\/p>\n<p>of   Holly Mass and other religious functions in the Church.<\/p>\n<p>Learned counsel for respondent Nos.7 to 9 contended that since<\/p>\n<p>suit has been dismissed remedy of petitioners is to prefer appeal<\/p>\n<p>and seek appropriate relief or seek appropriate relief from the trial<\/p>\n<p>court which dismissed the suit.\n<\/p>\n<p>      3.    It is not disputed that suit was dismissed on<\/p>\n<p>04.09.2010. Normally it will take some time for petitioners to get<\/p>\n<p>copy of the judgment and decree and challenge the same in the<\/p>\n<p>appropriate court. But some arrangement has to be made in the<\/p>\n<p>meantime     to preserve peace in the Church. Having regard to<\/p>\n<p>the circumstances stated above and considering           the views<\/p>\n<p>expressed by counsel on both sides I am inclined to make the<\/p>\n<p>following arrangements in the matter of conducting Holly Mass<\/p>\n<p>and other religious functions in the Church until appropriate<\/p>\n<p>orders are passed by the court considering the appeal against<\/p>\n<p>dismissal of the suit.\n<\/p>\n<p>W.P(C) No.27831 of 2010<br \/>\n<span class=\"hidden_text\">                                  -: 3 :-<\/span><\/p>\n<p>    Resultantly, Writ Petition is disposed of in the following lines:<\/p>\n<pre>           (i)     Both sides are directed not to commit\n\n     waste in the suit property.\n\n           (ii)    Parties are directed to    conduct Holly\n\n<\/pre>\n<p>     Mass and other religious functions in the Church on<\/p>\n<p>     alternate weeks. Accordingly Holly Mass and other<\/p>\n<p>     religious functions if any in the Church will be<\/p>\n<p>     conducted by respondent No.5 from 5.00 p.m., on<\/p>\n<p>     11.09.2010 till 5.00 p.m., on 18.09.2010. The next<\/p>\n<p>     turn will be of contesting respondent Nos.7 to 9<\/p>\n<p>     beginning from 5.00 p.m., on 18.09.2010 onwards<\/p>\n<p>     and similar turn will follow and be observed by the<\/p>\n<p>     parties.\n<\/p>\n<p>           (iii)   The above arrangement will continue<\/p>\n<p>     until the appellate court passes appropriate orders in<\/p>\n<p>     the appeal that may be preferred by the petitioners.<\/p>\n<p>           (iv)    In case filing of the appeal is delayed or<\/p>\n<p>     for any other justifiable reasons it will be open to<\/p>\n<p>     respondent Nos.7 to 9 to approach this Court for<\/p>\n<p>     cancellation\/modification of the above arrangement.<\/p>\n<p>                                   THOMAS P.
