\/>\nCPIO\u00a0replied\u00a0vide\u00a0letter\u00a0dated\u00a026.05.2010.\u00a0 \u00a0Not\u00a0satisfied\u00a0with\u00a0the\u00a0reply,\u00a0the\u00a0Appellant\u00a0<br \/>\nfiled\u00a0an\u00a0appeal\u00a0before\u00a0the\u00a0First\u00a0Appellate\u00a0Authority\u00a0(FAA).\u00a0The\u00a0FAA\u00a0vide\u00a0his\u00a0order\u00a0dated\u00a0<br \/>\n7.10.2010\u00a0decided\u00a0as\u00a0follows:\u00ad<\/p>\n<p>&#8220;As\u00a0the\u00a0appellant\u00a0has\u00a0\u00a0already\u00a0received\u00a0the\u00a0CPIO&#8217;s\u00a0letters\u00a0dated\u00a025\/26 th\u00a0May,\u00a02010\u00a0and \u00a0<br \/>\ndated \u00a027.07.2010 \u00a0and \u00a0in \u00a0view \u00a0of\u00a0submissions \u00a0made \u00a0by \u00a0appellant \u00a0in\u00a0his\u00a0appeal \u00a0dated \u00a0<br \/>\n19.08.20\u00a0no\u00a0separate\u00a0action\u00a0is\u00a0required\u00a0on\u00a0his\u00a0earlier\u00a0appeal\u00a0dated\u00a022.07.2010.\u00a0Further, \u00a0<br \/>\nin\u00a0order\u00a0to\u00a0consider\u00a0the\u00a0request\u00a0of\u00a0appellant,\u00a0the\u00a0CPIO\u00a0had\u00a0requested\u00a0the\u00a0appellant\u00a0to \u00a0<br \/>\nintimate\u00a0the\u00a0specific\u00a0information\u00a0sought\u00a0for\u00a0by\u00a0him\u00a0with\u00a0clarity\u00a0in\u00a0accordance\u00a0with\u00a0the \u00a0<br \/>\nprovisions\u00a0of\u00a0the\u00a0Act.\u00a0The\u00a0CPIO\u00a0has\u00a0not\u00a0turned\u00a0down\u00a0the\u00a0request\u00a0of\u00a0the\u00a0appellant.\u00a0\n<\/p>\n<p>        As \u00a0 regards \u00a0 to \u00a0 the \u00a0 request \u00a0 of \u00a0 appellant \u00a0 for \u00a0 supplying \u00a0 of \u00a0 information \u00a0 about \u00a0 the \u00a0<br \/>\ndocument \u00a0 in \u00a0 connection \u00a0 with \u00a0 Dr. \u00a0 Amarjyoti \u00a0 Barua, \u00a0 G. \u00a0 M., \u00a0 Brahmaputra \u00a0 Board, \u00a0 the \u00a0<br \/>\nappellant\u00a0has\u00a0requested\u00a0under\u00a0Para\u00a05(d)\u00a0of\u00a0letter\u00a0dated\u00a028.04.2010\u00a0as\u00a0below:\u00ad<\/p>\n<p>    (i)     Copy \u00a0 of \u00a0 the \u00a0 suspension \u00a0 order\/reversion \u00a0 order \u00a0 of \u00a0 Dr. \u00a0 Amarjyoti \u00a0 Barua \u00a0 as \u00a0<br \/>\n            mentioned\u00a0in\u00a0para\u00ad5(b)(4)(iii)\u00a0above.\n<\/p>\n<p>     (ii) Copy\u00a0of\u00a0the\u00a0appointment\u00a0letters\u00a0of\u00a0present\u00a0Chairman\u00a0and\u00a0G.M.\u00a0and\u00a0extension\u00a0of \u00a0<br \/>\n            appointment\u00a0if\u00a0any\u00a0as\u00a0mentioned\u00a0in\u00a0para\u00ad5(b)(3)(i)\u00a0above.&#8221;\n<\/p>\n<p>    The\u00a0CPIO\u00a0has\u00a0conveyed\u00a0to\u00a0appellant\u00a0that\u00a0his\u00a0letter\u00a0dated\u00a028.04.2010\u00a0did\u00a0not\u00a0contain \u00a0<br \/>\n    para\u00ad5(b)(4)(iii) \u00a0 &amp; \u00a0 para\u00ad5(b)(3)(i) \u00a0 which \u00a0 caused \u00a0 ambiguity. \u00a0 \u00a0 In \u00a0 response \u00a0 the \u00a0<br \/>\n    appellant\u00a0in\u00a0appeal\u00a0dated\u00a019.08.2010\u00a0has\u00a0stated\u00a0that\u00a0the\u00a0said\u00a0para\u00ad5(b)(3)(i)\u00a0&amp;\u00a0para \u00a0<br \/>\n    \u00ad5(b)(4)(iii)\u00a0are\u00a0contained\u00a0at\u00a0page\u00a01\u00a0&amp;\u00a02\u00a0of\u00a0his\u00a0RTI\u00a0application\u00a0and\u00a0highlighted\u00a0in\u00a0the \u00a0<br \/>\n    copy\u00a0of\u00a0his\u00a0letter\u00a0dated\u00a028.04.2010\u00a0enclosed\u00a0with\u00a0appeal.\u00a0\u00a0Para\u00ad5(b)(4)(iii)\u00a0\u00a0&amp;\u00a0para\u00ad<br \/>\n    5(b)(3)(i)\u00a0as\u00a0highlighted\u00a0by\u00a0the\u00a0appellant\u00a0in\u00a0the\u00a0copy\u00a0of\u00a0his\u00a0letter\u00a0dated\u00a028.04.2010 \u00a0<br \/>\n    enclosed\u00a0with\u00a0the\u00a0appeal\u00a0read\u00a0respectively\u00a0as\u00a0under:\n<\/p>\n<p>    (iii)   In\u00a0the\u00a0financial\u00a0year\u00a02009\u00ad2010,\u00a0what\u00a0was\u00a0the\u00a0budget\u00a0provisions\u00a0for\u00a0works\u00a0of \u00a0<br \/>\n            the \u00a0Board? \u00a0What \u00a0was \u00a0the \u00a0expenditure \u00a0against \u00a0Works? \u00a0Whether \u00a0full \u00a0budget \u00a0<br \/>\n            provision\u00a0for\u00a0works\u00a0was\u00a0exhausted?\u00a0If\u00a0not,\u00a0what\u00a0was\u00a0the\u00a0recorded\u00a0reason\u00a0for \u00a0<br \/>\n            failure\u00a0of\u00a0the\u00a0Board\u00a0of\u00a0utilize\u00a0the\u00a0allotted\u00a0fund\u00a0for\u00a0works?\n<\/p>\n<p>    (iv) As\u00a0to\u00a0whether\u00a0any\u00a0genuine\u00a0complaints\u00a0of\u00a0corruption\u00a0of\u00a0said\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Dr. \u00a0\n<\/p>\n<p>            Baruah\u00a0was\u00a0received\u00a0in\u00a0the\u00a0MOWR\u00a0before\u00a0he\u00a0was\u00a0caught\u00a0by\u00a0the\u00a0CBI?\u00a0If\u00a0so, \u00a0<br \/>\n            how \u00a0 many \u00a0 the \u00a0 complaints \u00a0 are \u00a0 received \u00a0 and \u00a0 when \u00a0 the \u00a0 complaints \u00a0 were \u00a0<br \/>\n            received?\n<\/p>\n<p>    After\u00a0going\u00a0through\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0letter,\u00a0it\u00a0is\u00a0observed\u00a0that\u00a0the\u00a0documents\u00a0sought \u00a0<br \/>\nfor\u00a0by\u00a0the\u00a0appellant\u00a0in\u00a0para\u00a05(d)(i)\u00a0and\u00a05(d)(ii)\u00a0do\u00a0not\u00a0tally\u00a0with\u00a0the\u00a0contents\u00a0of\u00a0the\u00a0paras \u00a0<br \/>\nas\u00a0stated\u00a0in\u00a05(b)(4)(iii)\u00a0&amp;\u00a05(b)(3)(i)\u00a0respectively\u00a0and\u00a0therefore\u00a0lacked\u00a0clarity\u00a0and\u00a0led\u00a0to \u00a0<br \/>\nambiguity\u00a0to\u00a0CPIO.\n<\/p>\n<p>    It\u00a0is\u00a0also\u00a0observed\u00a0that\u00a0the\u00a0information\/documents\u00a0as\u00a0sought\u00a0for\u00a0by\u00a0the\u00a0appellant\u00a0in \u00a0<br \/>\nhis\u00a0letter\u00a0dated\u00a028.04.2010\u00a0are\u00a0not\u00a0held\u00a0by\u00a0the\u00a0CPIO.\n<\/p>\n<p>    However,\u00a0the\u00a0information\/documents\u00a0as\u00a0requested\u00a0by\u00a0the\u00a0appellant\u00a0in\u00a0his\u00a0letter\u00a0dated \u00a0<br \/>\n28.04.2010 \u00a0 are \u00a0 closely \u00a0 related \u00a0 with \u00a0 the \u00a0 functions \u00a0 of \u00a0 Vigilance \u00a0 Section\/E\u00adIII \u00a0 (BBE) \u00a0<br \/>\nSection\u00a0of\u00a0Ministry\u00a0of\u00a0Water\u00a0Resources\u00a0and\u00a0Brahmaputra\u00a0Board.\u00a0As\u00a0such\u00a0the\u00a0information \u00a0<br \/>\n\/\u00a0documents\u00a0are\u00a0to\u00a0be\u00a0provided\u00a0by\u00a0them.\n<\/p>\n<p>        In\u00a0The\u00a0light\u00a0of\u00a0the\u00a0above,\u00a0the\u00a0first\u00a0appeal\u00a0is\u00a0decided\u00a0accordingly.\u00a0Let\u00a0a\u00a0copy\u00a0of\u00a0this \u00a0<br \/>\ndecision \u00a0 be \u00a0 sent \u00a0 to \u00a0 the \u00a0 appellant, \u00a0 the \u00a0 CPIO \u00a0 and \u00a0 CPIOs \u00a0 dealing \u00a0 with \u00a0 the \u00a0 matters \u00a0 of \u00a0<br \/>\n Vigilance\u00a0Section\/E\u00adIII\u00a0(BBE)\u00a0Section\u00a0of\u00a0Ministry\u00a0of\u00a0Water\u00a0Resources\u00a0and\u00a0Brahmaputra \u00a0<br \/>\nBoard.&#8221;\n<\/p>\n<p>         The \u00a0FAA \u00a0endorsed \u00a0copies \u00a0of\u00a0 his \u00a0decision\u00a0 to \u00a0Sh.\u00a0 K. \u00a0K.\u00a0 Shaw, \u00a0Section \u00a0Officer\u00a0<br \/>\n(Vig.)\u00a0&amp;\u00a0the\u00a0CPIO.\u00a0However,\u00a0Sh.\u00a0A.\u00a0C.\u00a0Trivedi\u00a0Section\u00a0Officer\u00a0\/\u00a0CPIO,\u00a0M\/o\u00a0Water\u00a0<br \/>\nResource,\u00a0and\u00a0to\u00a0Sh.\u00a0G.\u00a0P.\u00a0Singh,\u00a0Secretary\u00a0&amp;\u00a0CPIO,\u00a0Brahmaputra\u00a0Board\u00a0for\u00a0providing\u00a0<br \/>\ninformation\u00a0related\u00a0to\u00a0them.\u00a0\n<\/p>\n<p>    In \u00a0 compliance \u00a0 to \u00a0 the \u00a0 aforementioned \u00a0 directions \u00a0 of \u00a0 FAA, \u00a0 Sh. \u00a0 S. \u00a0 V. \u00a0 Singh, \u00a0 Dy.\u00a0<br \/>\nSecretary\u00a0(Vigilance)\u00a0\/\u00a0FAA\u00a0has\u00a0vide\u00a0his\u00a0letter\u00a0dated\u00a015.11.2010,\u00a0provided\u00a0information\u00a0<br \/>\nrelated \u00a0 to \u00a0 Vigilance \u00a0 Section \u00a0 of \u00a0 M\/o \u00a0 Water \u00a0 Resources. \u00a0 The \u00a0 Officials \u00a0 representing\u00a0<br \/>\nRespondent\u00a0 public\u00a0 authority \u00a0 during \u00a0 the\u00a0 hearing\u00a0 submitted\u00a0 that\u00a0they\u00a0 are \u00a0not\u00a0aware \u00a0of\u00a0<br \/>\ncompliances\u00a0to\u00a0the\u00a0directions\u00a0of\u00a0the\u00a0FAA\u00a0by\u00a0Section\u00a0Office\u00a0Establishment,\u00a0M\/o\u00a0Water\u00a0<br \/>\nResources \u00a0 or \u00a0 by \u00a0 The\u00a0Commission\u00a0also\u00a0observes\u00a0that\u00a0the\u00a0Dy.\u00a0Secretary\u00a0(Vig.)\u00a0\/\u00a0FAA\u00a0in\u00a0his\u00a0reply\u00a0<br \/>\ndated \u00a0 15.11.2010 \u00a0 has \u00a0 replied \u00a0 that \u00a0 any \u00a0 action \u00a0 against \u00a0 Sh. \u00a0 Trilochan \u00a0 Barwah, \u00a0 now \u00a0 on\u00a0<br \/>\ndeputation\u00a0with\u00a0M\/o\u00a0DONER,\u00a0is\u00a0to\u00a0be\u00a0taken\u00a0by\u00a0the\u00a0Brahmaputra\u00a0Board.\u00a0Therefore,\u00a0no\u00a0<br \/>\nsuch \u00a0 information \u00a0 is \u00a0 available \u00a0 with \u00a0 Vigilance \u00a0 Section, \u00a0 M\/o \u00a0 Water \u00a0 Resources. \u00a0 The\u00a0<br \/>\nCommission, \u00a0 therefore, \u00a0 hereby \u00a0 directs \u00a0 the
