DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/05\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nthis petition under Articles 226 and 227 of the Constitution of India<br \/>\nread with Section 482 of the Code of Criminal Procedure, 1973 the<br \/>\npetitioner has made the following prayers :-\n<\/p>\n<p>&#8220;(A)\tAdmit<br \/>\nthis Special Criminal Application.\n<\/p>\n<p>(B)\tAllow<br \/>\nthis Special Criminal Application by quashing and setting aside the<br \/>\nimpugned FIR being CR NO.I-681\/2002 registered with Naranpura Police<br \/>\nStation, Ahmedabad and be further pleased to quash the supplementary<br \/>\ncharge sheet submitted against the petitioner, being charge sheet<br \/>\nNo.367\/2003 and be pleased to quash the proceedings arising out of<br \/>\nthe same, in the interest of justice.\n<\/p>\n<p>(C)\tAllow<br \/>\nthis Special Criminal Application by quashing and setting aside the<br \/>\norder dated 27.6.2006 passed by the Lt. Metropolitan Magistrate,<br \/>\nCourt NO.19, Ahmedabad below Ex.3 in Criminal Case No.1333\/2003 and<br \/>\nbe further pleased to quash and set aside the order dated 30.8.2007<br \/>\npassed by the Ld. City Sessions Judge and 4th Fast Track Court,<br \/>\nAhmedabad in Criminal Revision Application No.338\/2006, in the<br \/>\ninterest of justice.\n<\/p>\n<p>(D)\tPending<br \/>\nadmission hearing and till final disposal of this petition,<br \/>\nthis Hon&#8217;ble Court be pleased to grant stay of further proceedings in<br \/>\nCriminal Case No.1333\/2003 pending before the Ld. Metropolitan<br \/>\nMagistrate Court No.19, Ahmedabad, in the interest of justice.\n<\/p>\n<p>2.\tMr.Yogesh<br \/>\nLakhani, learned Senior Advocate appearing with Mr.Pravin Gondaliya<br \/>\nfor the petitioner submits that the petitioner has already paid up<br \/>\nthe entire outstanding dues of the bank with interest and no due<br \/>\ncertificate is issued by the bank since the account is settled by<br \/>\nmaking payment of all outstanding dues with 18% interest and even<br \/>\nLavad Suit No.63\/2003 filed by the bank against the petitioner came<br \/>\nto be withdrawn on 18.03.2004. In view of the above, it is submitted<br \/>\nthat this petition be allowed.\n<\/p>\n<p>3.\tUpon<br \/>\nissuance of notice, Mr.Bhargav Karia appears for the respondent-bank<br \/>\nand confirmed about issuance of no due certificate to the petitioner<br \/>\nand submits that no amount is due to respondent-bank by the<br \/>\npetitioner.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe above facts and circumstances of the case and on perusal of the<br \/>\nrecord, including no dues certificate issued by the respondent-bank<br \/>\nand order dated 16.06.2009 passed by this Court in Criminal Misc.<br \/>\nApplication No.4098\/09 in a similar case and in view of the decision<br \/>\nof the Apex Court in the case of Nikhil Merchant v. Central Bureau of<br \/>\nInvestigation and another, [(2008)9 SCC 677], I am of the opinion<br \/>\nthat ends of justice will be secured if the impugned complaint is<br \/>\nquashed and set aside by exercising powers under Section 482 of the<br \/>\nCode of Criminal Procedure, 1973.\n<\/p>\n<p>5.\tAccordingly,<br \/>\nthis petition is allowed.  The impugned complaint is hereby quashed<br \/>\nand set aside.  However, there shall be no order as to costs.\n<\/p>\n<p>[Anant S.
