Justice KURIAN JOSEPH\n\n Dated :19\/07\/2007\n\n O R D E R\n                       KURIAN JOSEPH , J\n\n         ==================================\n\n                  W.P.(C) NO. 25565 OF 2006\n\n         ==================================\n\n           Dated this the  19th day of July, 2007.\n\n\n                             JUDGMENT\n<\/pre>\n<p>  The writ petition is filed with the following prayers:<\/p>\n<p>  i.     issue a writ of certiorari or other appropriate writ, order<\/p>\n<p>      or direction calling for the records leading to Exts.P9 and<\/p>\n<p>      P10 and quash the same to the limited extent they deny<\/p>\n<p>      inclusion of the name of the petitioner in the select list of<\/p>\n<p>      Scientific   Assistant   for   promotion   as   Assistant   Director<\/p>\n<p>      (Balistics) for the year 1995 towards the vacancy which<\/p>\n<p>      arose as per Ext.P1.\n<\/p>\n<p>\nii.     declare that the petitioner is entitled for inclusion in the<\/p>\n<p>      select   list   of   Scientific   Assistants   (Ballistics)   for<\/p>\n<p>      promotion   as   Asst.   Director   (Ballistics)   in   the   Forensic<\/p>\n<p>      Laboratory for the year 1995 and also for promotion in<\/p>\n<p>      the vacancy which arose as per Ext.P1.\n<\/p>\n<p>\niii.         issue   a   writ   of   mandamus   or   other   appropriate   writ,<\/p>\n<p>      order  or   direction  directing  the  respondents 1   and  3  to<\/p>\n<p>      include   the   petitioner&#8217;s   name   in   the   Select   list   of<\/p>\n<p>      Scientific Assistant (Ballistics) fit for promotion Assistant<\/p>\n<p>      Director   (Ballistics)   in   the   Forensic   Science   Laboratory<\/p>\n<p>      for the year 1995 and promote him as Assistant Director<\/p>\n<p>      (Ballistics)   with   effect   from   the   date   of   occurrence   of<\/p>\n<p>      vacancy   as   per   Ext.P1   with   all   consequential   benefits<\/p>\n<p>      including   arrears   of   salary,   seniority   and   consequential<\/p>\n<p>      retrospective promotion as Joint Director forthwith.<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 25565\/2006                  : 2 :<\/span><\/p>\n<p>2.     It   is   stated   in   the   counter   affidavit   that   the   suspension<\/p>\n<p>period has been regularised for all purposes as duty.   It is also<\/p>\n<p>stated   in   the   counter   affidavit   that   only   due   to   the   suspension<\/p>\n<p>followed by the disciplinary action, the D.P.C did not consider his<\/p>\n<p>name.     Now   that   snag   has   been   removed   as   per   Ext.P6,   the<\/p>\n<p>petitioner is entitled to be considered for retrospective promotion<\/p>\n<p>to   the   post   of   Assistant   Director   in   respect   of   vacancies   which<\/p>\n<p>arose as per  Ext.P1.   As  far as  further promotion  is  concerned,<\/p>\n<p>he should complete two years service from the date of his initial<\/p>\n<p>appointment as Assistant Director.   By the time of such deemed<\/p>\n<p>duty   also,   the   petitioner   cannot   stake   any   claim   over   the   4th<\/p>\n<p>respondent  since the 4th respondent had already been promoted<\/p>\n<p>before   the   petitioner   completed   two   years   of   deemed   duty   as<\/p>\n<p>Assistant Director.   Not only that, it is seen that there is Ext.R4<\/p>\n<p>(h)   select   list   of   Assistant   Directors   fit   for   promotion   as   Joint<\/p>\n<p>Directors.  There is no challenge on that though the petitioner is<\/p>\n<p>excluded   and   the   4th   respondent   is   included.     Therefore,   there<\/p>\n<p>arises   no   question   of   retrospective   promotion   of   the   petitioner<\/p>\n<p>over the 4th respondent in the cadre of Joint Director.  However,<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 25565\/2006                  : 3 :<\/span><\/p>\n<p>for   the   inclusion   of   the   petitioner   in   the   1995   list,   the   matter<\/p>\n<p>requires reconsideration.\n<\/p>\n<\/p>\n<p>3.
