Mokhtar Khan\n      For the Respondents :        Mr.\n                          ------\n\n6\/ 17.03.2010<\/pre>\n<p>     By this application, under Articles 226 and 227 of the<br \/>\n            Constitution of India, the petitioner, the Union of India, has<br \/>\n            challenged the order passed by the Central Administrative Tribunal,<br \/>\n            Circuit Bench, Ranchi in O.A. No. 137 of 2006 whereby it has set<br \/>\n            aside the order of penalty of withholding one annual increment<br \/>\n            passed against the petitioner in a departmental proceeding.\n<\/p>\n<p>            2.    From perusal of the impugned order, it appears that the<br \/>\n            respondent No. 1, who is a teacher, was subjected to an enquiry on<br \/>\n            the charge of misconduct alleging that he had held the hand of lady<br \/>\n            teacher, Ms. Richa Srivastava. The enquiry was conducted by a<br \/>\n            committee which came to a conclusion that there was no substance<br \/>\n            in the allegation made against the respondent and the lady-<br \/>\n            complainant was instigated to file the complaint against the<br \/>\n            respondent. In the departmental proceeding the Enquiry Officer<br \/>\n            submitted his report holding that nothing was proved against the<br \/>\n            delinquent in the enquiry. The Enquiry Officer has recorded that<br \/>\n            since there are contradictions in the statements of Ms. Srivastava<br \/>\n            and also due to lack of direct and circumstantial evidences, the<br \/>\n            charges are not proved. In spite of these finding       recorded by<br \/>\n            Enquiry Officer the Disciplinary Authority imposed punishment of<br \/>\n            withholding one annual increment. The Tribunal after considering<br \/>\n            the entire evidence set aside the order of punishment passed by<br \/>\n            the disciplinary authority. The Tribunal, further directed that the<br \/>\n            case of the respondent-delinquent for promotion should be<br \/>\n            considered forthwith.\n<\/p>\n<p>            3.    Mr. Md. Mokhtar Khan, learned Senior Standing Counsel for<br \/>\n            the Central Government, assailed that part of the direction given by<br \/>\n           the Tribunal     for considering the case of the respondent for<br \/>\n           promotion. According to the learned counsel while issuing such<br \/>\n           direction the Tribunal has exceeded its jurisdiction. From the order<br \/>\n           passed by the Tribunal, it appears that during the pendency of the<br \/>\n           departmental proceeding the name of the respondent was<br \/>\n           recommended for promotion but in view of the pendency of the<br \/>\n           proceeding his name was kept in sealed cover.\n<\/p>\n<p>           4.             If that is the admitted position then no illegality has<br \/>\n           been committed in directing the respondent to open the sealed<br \/>\n           cover   and     implement   the   recommendation     made     by   the<br \/>\n           departmental promotion committee in accordance with law.\n<\/p>\n<p>           5.             With the aforesaid observation, this application is<br \/>\n           dismissed.\n<\/p>\n<p>                                                                 (M. Y.
