RAVIKUMAR, JJ.\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                       W.P.(Crl)No.36 OF 2009-S\n             - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 9th day of February, 2009\n\n                                  JUDGMENT\n<\/pre>\n<p>Basheer, J:\n<\/p>\n<\/p>\n<p>      Petitioner has filed this writ petition alleging that his<\/p>\n<p>mother Smt. Leelamma Varghese has been in illegal detention of<\/p>\n<p>respondent Nos. 5 to7.            It is on record that the petitioner had<\/p>\n<p>been looking after his mother ever since she came back from<\/p>\n<p>Dubai where she was employed.                          But, according to the<\/p>\n<p>petitioner, on May 25, 2008, &#8220;respondents 5 to 7 and their<\/p>\n<p>associates had forcibly removed the petitioner&#8217;s mother from<\/p>\n<p>his home against her wish to an undisclosed location and<\/p>\n<p>from that day onwards, the petitioner&#8217;s mother is under the<\/p>\n<p>illegal detention of respondents 5 to 7&#8221;. It is further alleged<\/p>\n<p>in the writ petition that he had approached the Vicar of the<\/p>\n<p>local church and also had sought assistance of the police in<\/p>\n<p>tracing out his mother.\n<\/p>\n<p>      2.  Smt. Leelamma Varghese                     is present in court.      She<\/p>\n<p>submits that she has not been under                            any kind of illegal<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><br \/>\nWPCrl.NO.36\/09<\/p>\n<p>confinement    or  detention as   alleged in the writ petition.<\/p>\n<p>According to her, she had been living with her brother and his<\/p>\n<p>family at Chengannur. She further asserts that all along she<\/p>\n<p>had been in the care and custody of her brother       and his<\/p>\n<p>family.   She further stated before us that she had gone to<\/p>\n<p>Chengannur on her own free will in an auto rickshaw. She<\/p>\n<p>had some tiff with her son at that time and because of that<\/p>\n<p>reason she had left his company.       In the course of our<\/p>\n<p>interaction with Smt. Leelamma Varghese, she stated before us<\/p>\n<p>that she is now prepared to go with her son.       The above<\/p>\n<p>submission is recorded. She is free to live with her son, if she<\/p>\n<p>chooses to do so.\n<\/p>\n<p>     3. Admittedly Smt. Leelamma Varghese had left the<\/p>\n<p>company of the petitioner in May, 2008. But, this writ petition<\/p>\n<p>has been filed in January, 2009    alleging that    respondent<\/p>\n<p>Nos.5 to 7,who are none other than his uncles and aunt, had<\/p>\n<p>illegally detained his mother against her wish after removing<\/p>\n<p>her   forcibly from his  custody.  Petitioner goes on to state<\/p>\n<p>further that his mother had been detained in an undisclosed<\/p>\n<p>location ever since May, 2008. The above allegations made in<\/p>\n<p><span class=\"hidden_text\">                               3<\/span><br \/>\nWPCrl.NO.36\/09<\/p>\n<p>the writ petition are undoubtedly too far fetched  and totally<\/p>\n<p>unbelievable, to say the least. In that view of the matter, we<\/p>\n<p>are satisfied that the petitioner has to be mulcted with costs.<\/p>\n<p>Petitioner shall pay Rs.1,000\/= each to respondents 5 to 7,<\/p>\n<p>who shall be entitled  to execute the order and recover the<\/p>\n<p>same from the petitioner, if he does not pay the same within<\/p>\n<p>one month from today.\n<\/p>\n<\/p>\n<p>                                  (A.K.BASHEER, JUDGE)<\/p>\n<p>                                (C.T.
