The prayer is sought to be sustained primarily on the<br \/>\nground that on the same subject matter land, civil suit is filed by<br \/>\nthe petitioners which is pending.\n<\/p>\n<p>\tLearned<br \/>\nadvocate for the petitioner submitted that the suit has been<br \/>\ninstituted by the petitioners in which interim injunction is also<br \/>\ngranted.  In that view of the matter, Chapter Case should not be<br \/>\npermitted to proceed.  Learned counsel for the petitioners has relied<br \/>\non following decision of the Apex Court:-\n<\/p>\n<p>Ram<br \/>\n\tSundar Puri  v. State of U.P., AIR 1985 SC 472.\n<\/p>\n<p><a href=\"\/doc\/944049\/\">Amresh<br \/>\n\tTiwari  v. Lalta Prasad Dubey, AIR<\/a> 2002 SC 1504<\/p>\n<p><a href=\"\/doc\/1027285\/\">Ranbir<br \/>\n\tSingh  v. Dalbir Singh,<\/a> (2002) 3 SCC 700.\n<\/p>\n<p><a href=\"\/doc\/255541\/\">R.C.Patuck<br \/>\n\t v. Fatima A. Kindasa, AIR<\/a> 1997 SC 2320.\n<\/p>\n<p>\tOn<br \/>\nthe other hand, learned counsel Mr.Gandhi appearing for respondent<br \/>\nNo.2 pointed out that  the chapter case is not lodged against the<br \/>\npresent petitioners and even the properties involved in the chapter<br \/>\ncase as well as in the civil suit are not identical.  He submitted<br \/>\nthat unauthorized entry and trespassing is sought to be prevented<br \/>\nthrough the chapter case and the cases are at the stage of final<br \/>\narguments at which stage, the petitioner has approached this Court<br \/>\nand obtained stay.\n<\/p>\n<p>\tHaving<br \/>\nheard the learned advocates for the parties and having perused the<br \/>\nmaterial on record, I find that the chapter cases lodged by<br \/>\nrespondent No.2  are not against the present petitioners.  Even the<br \/>\ndescription of property in the chapter case as well as in the civil<br \/>\nsuit are not identical.  Considering all these aspects of the matter,<br \/>\nit is not necessary to await  the outcome of the civil suit before<br \/>\nthe chapter case can be concluded.   The petition is therefore<br \/>\ndismissed.  Rule is discharged.
