Opposite Party\/s<br \/>\n                 ======================================================<br \/>\n2   19-10-2011          Heard learned counsels for the petitioners and the State.<\/p>\n<p>                        The petitioners are apprehending their arrest in a case<\/p>\n<p>                  registered under Section 33(1) (B) of the Forest Act.<\/p>\n<p>                        A tractor, loaded with bolder, was seized. It is alleged that<\/p>\n<p>                  the said tractor belongs to the petitioner no.1 (Anil Sao) whereas<\/p>\n<p>                  petitioner no.2 (Dharmendra Ravidas) who was seen fleeing away<\/p>\n<p>                  from the place of seizure and alleged to have been carrying the<\/p>\n<p>                  bolder.\n<\/p>\n<p>                        It is submitted by learned counsel for the petitioners that the<\/p>\n<p>                  petitioner no.1 is not the owner of the tractor in question whereas<\/p>\n<p>                  the petitioner no.2 was not involved in the offence and only on<\/p>\n<p>                  suspicion they have been implicated in the present case.<\/p>\n<p>                         Considering the aforesaid facts, let the above named<\/p>\n<p>                  petitioners be released on anticipatory bail in the event of their<\/p>\n<p>                  arrest or surrender before the learned court below within a period<\/p>\n<p>                  of twelve weeks from today, on furnishing the bail bond of Rs.<\/p>\n<p>                  10,000\/- (ten thousand) each with two sureties of the like amount<\/p>\n<p>                  each to the satisfaction of learned Judicial Magistrate, 1st Class,<br \/>\n                    Gaya in connection with Forest Case No. 88\/2006 subject to the<\/p>\n<p>                   conditions as laid down under Section 438(2) of the Cr.P.C.<\/p>\n<p>                         The bail bond of the petitioners will only be accepted on<\/p>\n<p>                   verification within a period of one month from the local transport<\/p>\n<p>                   authority as well as from the forest officials that the tractor in<\/p>\n<p>                   question is not registered in the name of the petitioner no.1.<\/p>\n<p>                                      (Dinesh Kumar Singh, J)<\/p>\n<p>Amrendra Kumar\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anil Sao &amp; Anr. vs The State Of Bihar on 19 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.35319 of 2011 ====================================================== 1.
