No.44945 of 2010\n                 DAYANAND THAKUR, son of late Rambhajo Thakur\n                                      Versus\n                               THE STATE OF BIHAR\n                                   -----------\n<\/pre>\n<p>2   28.01.2011            Heard         learned        counsel       for        the<\/p>\n<p>                 petitioner as well as learned P.P. for the<\/p>\n<p>                 State.\n<\/p>\n<p>                           Petitioner seeks bail in connection<\/p>\n<p>                 with     Banka     P.S.        Case     No.440      of        2009<\/p>\n<p>                 (Corresponding          to    S.T.     No.741       of        2010)<\/p>\n<p>                 registered       for    the    offence      under    Sections<\/p>\n<p>                 397, 398 of the Indian Penal Code.<\/p>\n<p>                           Petitioner          is     not    named        in     the<\/p>\n<p>                 F.I.R., but it appears from submission of<\/p>\n<p>                 the learned counsel for the petitioner that<\/p>\n<p>                 one    Banka     P.S.    Case      No.441    of     2009        was<\/p>\n<p>                 registered and the petitioner was remanded<\/p>\n<p>                 in this case from the aforesaid Banka P.S.<\/p>\n<p>                 Case No.441 of 2009. He further submitted<\/p>\n<p>                 that the petitioner was arrested at the spot<\/p>\n<p>                 in connection with above stated Banka P.S.<\/p>\n<p>                 Case No.441 of 2009, but nothing had been<\/p>\n<p>                 recovered      from      his       possession.       He       also<\/p>\n<p>                 submitted that no offence under Section 397<\/p>\n<p>                 and 398 of the I.P.C. is made out in the<\/p>\n<p>                 present case.\n<\/p>\n<p><span class=\"hidden_text\">                              2<\/span><\/p>\n<p>                Although,               petitioner                carries<\/p>\n<p>     criminal      antecedent           of    several       cases,      but<\/p>\n<p>     considering the facts and circumstances of<\/p>\n<p>     the     present             case        petitioner,          namely,<\/p>\n<p>     Dayanand Thakur is directed to be released<\/p>\n<p>     on     bail        on       furnishing         bail     bonds       of<\/p>\n<p>     Rs.10,000\/-(ten thousand) with two sureties<\/p>\n<p>     of the like amount each to the satisfaction<\/p>\n<p>     of     learned          Sri     Satish         Ch.    Srivastava,<\/p>\n<p>     Additional District Judge, F.T.C.-IV, Banka<\/p>\n<p>     in connection with above stated Banka P.S.<\/p>\n<p>     Case No.440 of 2009 (Corresponding to S.T.<\/p>\n<p>     No.741 of 2010). It is made clear that the<\/p>\n<p>     release       of    the       petitioner       in     the    present<\/p>\n<p>     case    would       not      affect      the    merit       of   Banka<\/p>\n<p>     P.S.
