Respondents\n\n\n\n\tPetition filed under Article 226 of the Constitution of India, praying this Court for the issue of a Writ of mandamus directing the 1st and 3rd respondent herein to consider and pass appropriate orders on merits, in accordance with law on the petitioner's representation dated 31.8.2006 regarding exclusion of persons those who have already been appointed and working as Secondary Grade Teacher, in time scale of pay in Government aided and private schools from attending the selection for appointment to the post of Secondary Grade Teacher in all ensuing selections, within a time frame.\n\n\tFor Petitioner       ... Mr.P.Gopi Raja, GA \n\t\t\t \n\n\nORDER\n<\/pre>\n<p>\tThe petitioner is qualified to be appointed in the post of Secondary Grade teacher and he has registered himself in the Employment Exchange.  The grievance of the petitioner is that when the counseling was going on, the persons who were already appointed and working as Secondary Grade teachers in the time scale of pay in the Government Aided and private schools and who have not intimated about their employment in the above said schools to the Employment Exchange, by canceling the registration, have also appeared for counseling.  In view of the same,  the petitioner has made a representation to the 3rd respondent on 31.8.2006 bringing out the fact that the persons who have already employed, also attended the counseling.<\/p>\n<p>\t2. If that be true, it requires a serious consideration and the 3rd respondent has got the duty to investigate and prevent such persons from participating in the counseling.<\/p>\n<p>\t3.I have heard the learned counsel for the petitioner and the learned Government Advocate taking notice on behalf of the respondents.<\/p>\n<p>\t4.In view of the fact stated above, the 3rd respondent is directed to consider the representation of the petitioner dated 31.8.06 regarding exclusion of persons who are already appointed and working as Secondary Grade Teachers in time scale of pay in the Government aided and private schools and pass appropriate orders within a period of eight weeks from the date of receipt of a coy of this order.<\/p>\n<p>\t5.With the above direction, the writ petition is disposed of. No costs.
