Justice M.SASIDHARAN NAMBIAR\n\n Dated :21\/08\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n              ------------------------------------------\n               CRL.M.C.NO. 2603 OF 2009\n              ------------------------------------------\n              Dated       21st     August        2009\n\n                           O R D E R\n<\/pre>\n<p>           Petitioners were the absconding accused 3<\/p>\n<p>and 5 in C.C.2856\/2002 on the file of Judicial First<\/p>\n<p>Class  Magistrate-I,      Aluva.        Out      of     eight  accused<\/p>\n<p>persons, presence of only the fourth accused could be<\/p>\n<p>procured at the time of trial. Therefore, the case as<\/p>\n<p>against the other accused were               split      up   and  re-<\/p>\n<p>filed  as   C.C.28\/2008.          Learned          Magistrate    under<\/p>\n<p>Annexure-A2 judgment,         found the fourth accused not<\/p>\n<p>guilty  and  acquitted        him      of     the      offences  under<\/p>\n<p>Sections 143, 147, 384 and 34 of Indian Penal Code.<\/p>\n<p>This petition is filed under Section 482 of Code of<\/p>\n<p>Criminal Procedure, to quash the case as against them<\/p>\n<p>contending that in the light                    of the       order of<\/p>\n<p>acquittal  of    fourth         accused          under     Annexure-A2<\/p>\n<p>judgment, even if      petitioners are to be tried, they<\/p>\n<p>cannot be convicted and therefore the case is to be<\/p>\n<p>quashed.\n<\/p>\n<p>         2.   Learned         counsel         appearing      for   the<\/p>\n<p>petitioners and learned Public prosecutor were heard.<\/p>\n<pre>         3.   Argument          of       the       learned     counsel\n\nCRMC 2603\/09\n<span class=\"hidden_text\">                             2<\/span>\n\n\nappearing for the petitioners is that Pws.1 to 3     the\n\n<\/pre>\n<p>police officials who were examined in C.C.2856\/2002, did<\/p>\n<p>not identify the accused and in such circumstances, even<\/p>\n<p>if they are to be examined       again, they will not<\/p>\n<p>identify the petitioners and if that be so, petitioners<\/p>\n<p>cannot be convicted and in such circumstances, in the<\/p>\n<p>interest of justice the case is to be quashed.<\/p>\n<p>          4.  On hearing the learned counsel, I cannot<\/p>\n<p>agree with  the  submission.   Because of  the acquittal<\/p>\n<p>of one of the eight accused, the case as against the<\/p>\n<p>petitioners who were then accused 3 and 5 and absconding<\/p>\n<p>cannot be quashed. Question     whether   witness would<\/p>\n<p>identify the petitioners herein at the time of trial can<\/p>\n<p>only be decided at the time of recording the   evidence.<\/p>\n<p>For the reason that when Pws.1 to 3 were examined<\/p>\n<p>earlier they did not identify the fourth accused, who<\/p>\n<p>alone was facing trial at that time, does not mean that<\/p>\n<p>petitioners  will  not  be  identified  when  they   are<\/p>\n<p>examined again. In such circumstances, based on the<\/p>\n<p>order of acquittal of one of the   co-accused, the case<\/p>\n<p>as against the petitioners cannot be quashed. Learned<\/p>\n<p>counsel appearing for petitioners then submitted that<\/p>\n<p>learned Magistrate may be directed to dispose the case<\/p>\n<p>CRMC 2603\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>expeditiously.
