Case of the petitioner, in brief, is that pursuant to<\/p>\n<p>     the advertisement dated 22\/05\/2005 (Annexure P\/2), the<\/p>\n<p>     petitioner made an application for allotment of Kisan Seva<\/p>\n<p>     Kendra (for short &#8220;KSK&#8221;).  After having considered the<\/p>\n<p>     application of the petitioner at length the petitioner was<\/p>\n<p>     found successful.  Accordingly, in the list of short<\/p>\n<p>     listed candidates for allotment of KSK at Kota, Block Mal<\/p>\n<p>     Kharod, Distt.-Janjgir-Champa, the petitioner was placed<\/p>\n<p>     serial No.1 vide selection list dated 22\/08\/2005 (Annexure<\/p>\n<p>     &#8211; P\/8).  Thereafter, without affording an opportunity of<\/p>\n<p>     hearing, the impugned order dated 19\/12\/2005 was passed<\/p>\n<p>     canceling the allotment of KSK at Kota on the ground that<\/p>\n<p>     there are certain complaints against the merit panel of<\/p>\n<p>     candidates.  It further states that during the course of<\/p>\n<p>     investigation it was found that the petitioner was not<\/p>\n<p>     fulfilling the conditions\/suppressed the facts about his<\/p>\n<p>     residence certificate, therefore, re-interview for all<\/p>\n<p>     eligible candidates for the subject location as per the<\/p>\n<p>     policy guidelines was ordered.\n<\/p>\n<p>2.   The petitioner, after having been found selected as<br \/>\nNo.1, was not given the allotment letter, thus, the<br \/>\npetitioner filed a petition before this Court being W.P.<br \/>\nNo. 4501\/2005.  The said petition was disposed of by this<br \/>\nCourt on 19\/09\/2005 (Annexure P\/10) with an observation<br \/>\nthat the petitioner may send a notice for demand of<br \/>\njustice to the respondents and in turn, the respondents to<br \/>\ntake decision on the same within a reasonable time.  It<br \/>\nwas further observed that if the petitioner feels<br \/>\ndissatisfied, a liberty was reserved to the petitioner to<br \/>\napproach this Court.\n<\/p>\n<p>3.   In meantime, after issuance of legal notice, the<br \/>\nimpugned order dated 19\/12\/2005 (Annexure P\/1) was passed.<br \/>\nBeing aggrieved the petitioner preferred the instant<br \/>\npetition seeking a direction that the impugned letter<br \/>\ndated 19\/12\/2005 may be quashed and the respondents may be<br \/>\ndirected to allot KSK of Indian Oil Corporation for<br \/>\nlocation of Kota, Block-Mal Kharod, District-Janjgir-<br \/>\nChampa, to the petitioner.\n<\/p>\n<p>4.   This Court by order dated 27\/04\/2007 granted interim<br \/>\nrelief to the extent that if the disputed petrol pump is<br \/>\ngranted to some other person, that would  be subject to<br \/>\nfinal decision of the case.\n<\/p>\n<p>5.   Shri Shrivastava, learned counsel appearing for the<\/p>\n<p>     petitioner, submits that the petitioner fulfilled all the<\/p>\n<p>     conditions and he has not suppressed the material facts<\/p>\n<p>     with regard to his residential certificate.  All the<\/p>\n<p>     allegations  have  been made without  affording  an<\/p>\n<p>     opportunity of hearing to the petitioner.\n<\/p>\n<p>6.   According to Shri Kinger, learned counsel  for  the<\/p>\n<p>     respondent, the respondent corporation did not proceed<\/p>\n<p>     with the interview in view of the above stated order<\/p>\n<p>     passed by this Court.  Thus, the KSK in dispute was not<\/p>\n<p>     allotted to any person and the same remains available even<\/p>\n<p>     today.   Shri Kinger further submits that the petitioner<\/p>\n<p>     was short listed and was placed at serial No.1, but the<\/p>\n<p>     petitioner has not acquired any right for allotment.  Even<\/p>\n<p>     otherwise, by impugned letter it was found that re-\n<\/p>\n<p>     interview of all eligible candidates for the subject<\/p>\n<p>     location would be done.  Thus, there is no prejudice to<\/p>\n<p>     the petitioner.\n<\/p>\n<p>7.   I have heard learned counsel appearing for the<br \/>\nparties, perused the pleadings and the documents appended<br \/>\nthereto.\n<\/p>\n<p>8.   From the impugned letter, it appears that once the<br \/>\npetitioner has been found to have not fulfilled all the<br \/>\nconditions\/suppressed the fact about the residence<br \/>\ncertificate, the petitioner became disentitled for the<br \/>\nsubsequent interview, which was under contemplation under<br \/>\nthe impugned letter dated 19\/12\/2005.  Thus, declaring the<br \/>\npetitioner that he has not fulfilled all the conditions or<br \/>\nsuppressed the facts with regard to residence certificate<br \/>\ncaused prejudice to the petitioner as it appears that all<br \/>\nthe papers were examined before the interview and before<br \/>\nshort listing the candidates.  Thereafter, there was no<br \/>\noccasion to investigate on the basis of some complaint<br \/>\nwithout affording an opportunity of hearing to the<br \/>\npetitioner.\n<\/p>\n<p>9.   Having regard to the fact situation of the case and<br \/>\nfor the reasons mention hereinabove, the impugned letter<br \/>\ndated 19\/12\/2005 (Annexure P\/1) deserves to be quashed.<br \/>\nIf after selection of the petitioner, his candidature has<br \/>\nbeen quashed on account of certain allegation, the<br \/>\npetitioner is entitled to be afforded an opportunity of<br \/>\nhearing.  Accordingly, if the respondent corporation<br \/>\ndecides not to allot the KSK as per the list of selected<br \/>\ncandidates, the petitioner is entitled opportunity of<br \/>\nhearing before a prejudicial order condemning the conduct<br \/>\nof the petitioner is passed.\n<\/p>\n<p>10.  In normal course a person is not entitled to the<br \/>\nallotment order on the basis that his name found place in<br \/>\nthe select list when allotment was not made to any other<br \/>\nperson.  However, in the facts of the case wherein the<br \/>\nallotment could not be made on the ground of certain<br \/>\nallegations, according to the petitioner, unfounded<br \/>\nallegations.  Fundamental principle of the maxim audi<br \/>\nalteram partem is that &#8216;no man shall be condemned<br \/>\nunheard&#8217;.  The said maxim is squarely applicable to the<br \/>\nfacts of the case, as the impugned letter dated 19\/12\/2005<br \/>\ncanceling the candidature of the petitioner was on the<br \/>\nbasis of certain allegations.\n<\/p>\n<p>11.  In the result, the impugned letter dated 19\/12\/2005<br \/>\nis quashed and the writ petition is allowed to the extent<br \/>\nindicated above.
