Basant, J.\n<\/p>\n
     The 2nd respondent before the Family Court – the mother-in-<\/p>\n
law, in an O.P. filed by the daughter-in-law, is the appellant<\/p>\n
before us. The respondent herein, the wife had filed the said<\/p>\n
O.P., O.P.No.118\/08 against her husband and mother-in-law.<\/p>\n
The claim was for money being the value of gold ornaments.<\/p>\n
Both the husband and his mother, the appellant herein were set<\/p>\n
ex parte in the said O.P.    An ex parte decree was passed. The<\/p>\n
appellant\/mother-in-law promptly filed an application to set aside<\/p>\n
the ex parte order. That petition was returned with the direction<\/p>\n
to re-prsent the same along with copy of the impugned ex parte<\/p>\n
order. The appellant re-presented the petition, but out of time.<\/p>\n
An application was filed to condone the delay in re-presenting<\/p>\n
such application.\n<\/p>\n
     2.   When the matter came up for hearing on 9.1.2009, for<\/p>\n
the reason that batta had not been paid, the application to set<\/p>\n
aside the ex parte decree, filed by the appellant was dismissed.<\/p>\n

The appellant filed an application for restoration, which also<\/p>\n
happened to be dismissed by the impugned order.<\/p>\n
     3.    The learned counsel for the appellant submits that<\/p>\n
there was no wilful default or contumacious lapse on the part of<\/p>\n
the appellant. A lenient view may be taken, the impugned order<\/p>\n
may be set aside, the application to set aside the ex parte order<\/p>\n
may be allowed and the ex parte order may be set aside subject<\/p>\n
to any reasonable and appropriate conditions, it is prayed.<\/p>\n
     4.    The learned counsel for the respondent opposes the<\/p>\n
application. But, notwithstanding the opposition, we are satisfied<\/p>\n
that subject to appropriate conditions, which shall ensure that the<\/p>\n
appellant is not invoking the right of appeal merely for the<\/p>\n
purpose of protraction of the proceedings, the appeal can be<\/p>\n
allowed and appropriate directions issued:<\/p>\n
     5.    In the result:\n<\/p><\/blockquote>\n
     (a)   this appeal is allowed subject to conditions.<\/p>\n<\/blockquote>\n
     (b)   the impugned order shall stand set aside, the<\/p>\n
           application to set aside the ex parte order shall<\/p>\n
           stand allowed after condoning the delay and the<\/p>\n
           ex parte order passed in so far as it relates to<\/p>\n

           the appellant shall stand set aside on condition<\/p>\n
           that the appellant furnishes security to the<\/p>\n
           satisfaction of the court below for the entire<\/p>\n
           amount due under the impugned ex parte<\/p>\n
           decree as on this date, within a period of 60<\/p>\n
           days from this date.<\/p><\/blockquote>\n
     6.    The parties shall appear before the Family Court on<\/p>\n
18.1.2010. If security is not furnished by that date as directed,<\/p>\n
the Family Court shall make record of that fact and thereupon the<\/p>\n
impugned ex parte decree shall continue to remain in force.<\/p>\n
     7.    It is further made clear that this judgment or the<\/p>\n
course adopted by this Court of setting aside the impugned ex<\/p>\n
parte order in so far as it relates to the appellant shall not in any<\/p>\n
way fetter the rights of the respondent\/decree holder to proceed<\/p>\n
in execution against her husband, the first respondent in the O.P.<\/p>\n

Basant, J.\n<\/p>\n
      Heard. This petition is to condone the delay of 45 days in<\/p>\n
filing an appeal.      The appeal in turn challenges an order<\/p>\n
dismissing an application for restoration of an application to set<\/p>\n
aside an ex parte order.\n<\/p>\n
      2.   The application is opposed. After hearing both sides,<\/p>\n
we are satisfied that the delay can be condoned subject to<\/p>\n
appropriate conditions.\n<\/p>\n
      3.   In the result:\n<\/p>\n
      (a)  this petition is allowed.\n<\/p>\n
      (b)  the delay shall stand condoned on          condition<\/p>\n
           that the appellant deposits before the court<\/p>\n
           below or pays to the respondent an amount of<\/p>\n
           Rs.1,500\/-     (Rupees     One     Thousand      Five<\/p>\n
           Hundred only) as costs within a period of 30<\/p>\n
