Justice ANTONY DOMINIC\n\n Dated :19\/06\/2007\n\n O R D E R\n                               K.S.Radhakrishnan\n\n                                            &amp;\n\n                              Antony Dominic, JJ.\n\n                 ========================\n\n                             W.A.No.2035 of 2003\n\n                 ========================\n\n\n                Dated this the 19th  day of June, 2007.\n\n\n                                     JUDGMENT\n<\/pre>\n<p>Radhakrishnan,J.\n<\/p>\n<\/p>\n<p>       Writ Appeal is filed against the finding of the learned single Judge<\/p>\n<p>that when persons possessing higher academic qualifications than what<\/p>\n<p>is required for a post in the lowest rung of the service which involves<\/p>\n<p>only  manual  labour,  are   appointed,  it is  almost  certain  that  they   will<\/p>\n<p>not   stick   on   to   the   job   but   vacate   the   same   as   early   as   possible.<\/p>\n<p>Notification specifically states a pass in IV standard is the qualification<\/p>\n<p>for the post and it is further stipulated that the candidate should not<\/p>\n<p>pass   X   standard.     Admittedly,   petitioners   have   passed   S.S.L.C.   and<\/p>\n<p>hence, they are not eligible to apply for the post of Mazdoors.  Learned<\/p>\n<p>single Judge rightly held so.
