KRUTI M\nSHAH for Applicant(s) : 1, \nMR JK SHAH, APP for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 12\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRULE.\n<\/p>\n<p>Learned APP Mr.Shah waives service of rule for and on behalf of the<br \/>\nState.\n<\/p>\n<p>\tThis<br \/>\nApplication has been filed under Section 439 of the Code of Criminal<br \/>\nProcedure, praying for regular bail, in connection with I-CR<br \/>\nNo.24\/2010 registered with Sheth-Vadara Police Station, District<br \/>\nJamnagar, for the offences punishable under Sections 307, 323, 504,<br \/>\n506(2), 120B of the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned advocate Ms.Kruti M.Shah for the applicant-accused and<br \/>\nlearned APP Mr.J.K.Shah for the State.\n<\/p>\n<p>\tHaving<br \/>\nregard to the rival contentions of the respective counsel, I am<br \/>\npersuaded to exercise discretion in favour of the applicant-accused,<br \/>\ntaking into consideration the following aspects :-\n<\/p>\n<p>the<br \/>\n\tinvestigation is over;\n<\/p>\n<p>charge-sheet<br \/>\n\tis filed;\n<\/p>\n<p>injured<br \/>\n\tis discharged long time back from the hospital;\n<\/p>\n<p>there<br \/>\n\tis no other antecedents; and<\/p>\n<p>the<br \/>\n\tapplicant-accused is a permanent resident of Jamnagar city and is in<br \/>\n\tjail since 24th December 2010.\n<\/p>\n<p>\tIn<br \/>\nthis view of the matter, the applicant-accused Kamlesh @ Karshan @<br \/>\nKamo Jivabhai Makwana is ordered to be released on bail in<br \/>\nconnection with I-CR No.24\/2010 registered with Sheth-Vadara Police<br \/>\nStation, District Jamnagar, for the offences punishable under<br \/>\nSections 307, 323, 504, 506(2), 120B of the Indian Penal Code, on his<br \/>\nexecuting bond in the sum of Rs.15,000=00 (Rupees Fifteen Thousand<br \/>\nOnly) with one solvent surety of the like amount to the satisfaction<br \/>\nof the lower Court and subject to the conditions that he shall,<\/p>\n<p>(a)<br \/>\nnot take undue advantage of or misuse the liberty;\n<\/p>\n<p>(b)<br \/>\nmaintain law and order and should co-operate with the investigating<br \/>\nofficer;\n<\/p>\n<p>(c)<br \/>\nnot act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(d)<br \/>\nsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>(e)<br \/>\nnot leave the local limits of the State of Gujarat without prior<br \/>\npermission of the Sessions Judge concerned;\n<\/p>\n<p>(f)<br \/>\nshall mark his presence before the concerned Police Station twice in<br \/>\na month on every 2nd and 4th Sunday till the<br \/>\nfiling of the charge-sheet;\n<\/p>\n<p>(g)<br \/>\nfurnish the address of his residence at the time of execution of the<br \/>\nbond and shall not change the residence without prior permission of<br \/>\nthis Court.\n<\/p>\n<p>\tThe<br \/>\nauthorities will release the applicant only if he is not required in<br \/>\nany other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>\tRule<br \/>\nmade absolute.
