It is confirmed by the GIDC that the Corporation<br \/>\n\thas executed lease deed dated 26.12.1975 in favour of Hemant<br \/>\n\tPulverising Mills on 26.12.1975 and thereafter, Deed of Assignment<br \/>\n\twas executed in favour of the present applicant on 23.05.1995.\n<\/p>\n<p>It<br \/>\n\tis the say of the applicant that the property was hypothecated<br \/>\n\tand\/or mortgaged with the three Secured Creditors, namely, United<br \/>\n\tWestern Bank Limited, Canara Bank and State Bank of Hyderabad by<br \/>\n\tjoint Deed of Hypothecation dated 09.11.1995.  A charge was also<br \/>\n\tregistered with the Registrar of Companies.  It is the say of the<br \/>\n\tapplicant that the said charge is still continued.\n<\/p>\n<p>The<br \/>\n\trelevant document for our purpose is, therefore, the Deed of<br \/>\n\tAssignment dated 23.05.1995 and Deed of Hypothecation dated<br \/>\n\t9.11.1995.
