No.11101 of 2009\n                         RANJEET TELI son of Nepali Sah\n                                      Versus\n                                STATE OF BIHAR\n                                     -----------\n<\/pre>\n<p>11\/   22.06.2010              Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                  The petitioner seeks bail in a case instituted for the<\/p>\n<p>                    offence under section 364-A of the Indian Penal Code.<\/p>\n<p>                                  Submission is that the petitioner is not named in the First<\/p>\n<p>                    Information Report and subsequently even though he was named by<\/p>\n<p>                    the victim but there is nothing specific against him.<\/p>\n<p>                                  In view of the nature of allegation, I am not inclined to<\/p>\n<p>                    grant bail to the petitioner.\n<\/p>\n<p>                                  Prayer for bail is rejected.\n<\/p>\n<p>                                  The trial court is directed to expedite the trial in view of<\/p>\n<p>                    the serious nature of the offence.\n<\/p>\n<p>                                  Perused the report of the Chief Judicial Magistrate,<\/p>\n<p>                    Muzaffarpur, stating therein that the petitioner was not being produced<\/p>\n<p>                    from Ara Jail despite orders due to which the trial of petitioner is being<\/p>\n<p>                    hampered.\n<\/p>\n<p>                                  It is desirable that the petitioner be brought to<\/p>\n<p>                    Muzaffarpur on a fixed date so that police papers can be supplied to<\/p>\n<p>                    him on the said date and the matter can be committed to the Court of<\/p>\n<p>                    sessions even by separating his trial, if required. On the next date on<\/p>\n<p>                    commitment, charges shall be positively framed against the petitioner<\/p>\n<p>                    and thereafter the petitioner may be sent back to Ara Jail for his trial in<\/p>\n<p>                    other cases, if required.\n<\/p>\n<p><span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>                    The petitioner undertakes to file an application under<\/p>\n<p>       section 317 Cr. P. C. on the dates falling after charge so that the trial<\/p>\n<p>       can be held even in his absence but in presence of his advocate as<\/p>\n<p>       required in law. On the date the prosecution requires the petitioner to<\/p>\n<p>       be present in court for his identification, the authorities concerned<\/p>\n<p>       shall ensure the attendance of the petitioner so that no party is<\/p>\n<p>       prejudiced during trial.\n<\/p>\n<p>                    Let this order be communicated to the I.G.
