GOVERNMENT PLEADER\nfor\nPetitioner(s) : 1 - 2. \nMR PREMAL S RACHH for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAVI R.TRIPATHI\n\t\t\n\t\n\n \n\nDate\n: 05\/08\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard<br \/>\nleaned AGP, Mr. Neeraj Soni, for the petitioner No.1-State of Gujarat<br \/>\nthrough the Circle Forest Officer, Normal Range, Jam-Khambhalia,<br \/>\nJamnagar and petitioner No.2-Deputy Forest Officer, Normal Range,<br \/>\nJamnagar.\n<\/p>\n<p>2.\t\tThe<br \/>\npetitioners are before this Court, being aggrieved by the award and<br \/>\norder dated 10.08.2010, passed by the learned Judge, Labour Court<br \/>\nNo.2, Jamnagar, in Reference (L.C.J.) No. 287\/2000, whereby the<br \/>\nlearned Judge was pleased to partly allow the reference and ordered<br \/>\nreinstatement of the respondent-workman on his original post with<br \/>\ncontinuity of service, with 10 per cent back wages from 27.04.2005<br \/>\ni.e. the day on which his deposition was recorded in the Labour<br \/>\nCourt.\n<\/p>\n<p>3.\t\tLearned<br \/>\nAGP tried to assail the award and order of the Labour Court and<br \/>\nsubmitted that the learned Judge committed an error in awarding<br \/>\nreinstatement with continuity of service on the original post, with<br \/>\n10 per cent back wages.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAdvocate, Mr. Rachh, for the respondent workman submitted that, in<br \/>\nfact, it was for the respondent-workman to make grievance that only<br \/>\n10 per cent back wages are awarded and that is also from 27.04.2005.<br \/>\nLearned Advocate for the respondent rightly submitted that the<br \/>\nlearned Judge has tried to mention that the respondent-workman is<br \/>\nresponsible for not getting the Reference heard for 10 long years, as<br \/>\nif it was his choice.\n<\/p>\n<p>5.\t\tThis<br \/>\nCourt is in agreement with the submission made by the learned<br \/>\nAdvocate for the respondent that the learned Judge has tried to<br \/>\nattribute the entire period, during which the Reference could not be<br \/>\nheard, to the respondent-workman, which is not in the fitness of the<br \/>\nthings.
