Civil Application No.37 of 2002. The said Misc. Civil<br \/>\nApplication was filed for condonation of delay in preferring the<br \/>\nappeal against the judgment and order passed by the learned Extra<br \/>\nAssistant Judge, Rajkot in H.M.P. No.31 of 1983 dated 29.6.1983.<br \/>\nBrief facts of the case are as under :-\n<\/p>\n<p>2.\tThe<br \/>\ncase of the petitioner is that he was married with the respondent<br \/>\naccording to Hindu rites and their caste custom on 2.2.1975 at<br \/>\nVillage Derdi Kumbhaji. After the marriage, they resided as husband<br \/>\nand wife from February 1975 to June 1976 at Rajkot. Thereafter, they<br \/>\nresided at Bombay from July 1976 to May 1977 and thereafter, they<br \/>\nresided again at Rajkot from June 1977 to July 1977. It is averred by<br \/>\nhim that on 24.7.1977, the respondent without the knowledge and<br \/>\nconsent of the petitioner and without any reasonable excuse left the<br \/>\nhouse and went to stay with her father. Since then, the petitioner<br \/>\nmade several attempts from 1981 to bring back the respondent to stay<br \/>\nwith him but she refused to come and stay with him under one pretext<br \/>\nor the other. Therefore, the respondent has left the matrimonial<br \/>\nhome. The learned Extra Assistant Judge, Rajkot vide order dated<br \/>\n29.6.1983 allowed H.M.P. No.31 of 1983 holding the marriage dissolved<br \/>\non the ground of desertion under Section 13(1)(1-b) of the Hindu<br \/>\nMarriage Act. Being aggrieved by the aforesaid order dated 29.6.1983,<br \/>\nthe respondent preferred Regular Civil Misc. Appeal No.2 of 2004<br \/>\nbefore the District Judge, Rajkot praying to quash and set aside the<br \/>\norder dated 29.6.1983 passed by the Extra Assistant Judge, Rajkot.<br \/>\nAfter more than delay of 15 years, the respondent preferred appeal<br \/>\nalong with the delay condonation application i.e. Civil Misc.<br \/>\nApplication No.37 of 2002 on 10.6.2002 before the Joint District<br \/>\nJudge, Rajkot and the learned Judge has allowed the said application<br \/>\nvide order dated 9.1.2004. Hence this Revision Application.\n<\/p>\n<p>3.\tIt<br \/>\nis submitted by Mr Mrugen K Purohit, learned advocate for the<br \/>\npetitioner that H.M.P. No.31 of 1983 was filed by the petitioner for<br \/>\ndecree of divorce on 30.3.1983. As the respondent was not present,<br \/>\nthe learned Judge decided to proceed ex-parte on 13.6.1983. After<br \/>\nrecording the evidence, the Trial Court has passed the decree of<br \/>\ndivorce on 29.6.1983. It is submitted by learned advocate Mr. Purohit<br \/>\nthat during this period, the present petitioner married with Maltiben<br \/>\nPrabhudas Trivedi on 9.12.1985 and out of the said wedlock, the<br \/>\npetitioner has three daughters. At present all the three daughters<br \/>\nare major. Without considering this aspect, the District Court has<br \/>\nallowed the application though no sufficient cause was made out for<br \/>\ncondoning the delay.\n<\/p>\n<p>4.\tHeard<br \/>\nthe learned advocates for the parties at length. In this case<br \/>\npeculiar facts are there. It is submitted that after passing the<br \/>\ndecree of divorce, the present petitioner married with another lady<br \/>\nand during the said wedlock, the petitioner has three daughters who<br \/>\nat present are major and they are residing together. It is also an<br \/>\nadmitted fact that decree of divorce was passed on 29.6.1983 and the<br \/>\npresent respondent has preferred the appeal along with the delay<br \/>\ncondonation application on 10.06.2002 i.e. after about 19 years. This<br \/>\nCourt has gone through the delay condonation application preferred by<br \/>\nthe present respondent. No sufficient cause for condoning the delay<br \/>\nof 19 years is made out. Only it is mentioned in the application that<br \/>\nshe was not aware about the decree of divorce passed by the learned<br \/>\nTrial Court and therefore, she could not file appeal against the said<br \/>\njudgment and order. Except this contention, no other reasons have<br \/>\nbeen found from the application which led this Court to condone the<br \/>\ndelay. Even assuming that this is sufficient, then also as discussed<br \/>\nabove, if we allow this application then also multiple problems will<br \/>\nbe arose as the present petitioner is settled in his life with his<br \/>\nwife along with three major daughters. The Appellate Court without<br \/>\nconsidering the above aspect condoned the delay and thereby committed<br \/>\nan error. In view of the above, this Revision Application is allowed.<br \/>\nThe order passed by the Joint District Judge, Rajkot in Misc. Civil<br \/>\nApplication NO.37 of 2002 is hereby quashed and set aside. No order<br \/>\nas to costs.\n<\/p>\n<p>5.\tAs<br \/>\nfar as the maintenance part is concerned, a remedy is available to<br \/>\nthe respondent wife to file an appropriate application before the<br \/>\nappropriate Court for enhancing the maintenance.
