     Heard learned counsel for the parties.\n<\/p>\n
     The petitioner was dismissed from the service only<\/p>\n
because of the reason that petitioner was convicted in a<\/p>\n
criminal case under Section 302 IPC vide judgment dated<\/p>\n
2.8.1983.   No departmental inquiry was conducted by the<\/p>\n
respondents against the petitioner and as stated above, he<\/p>\n
was dismissed from service only because of his conviction<\/p>\n
dated 2.8.1983.      The petitioner’s appeal against the<\/p>\n
conviction i.e., DB Cr. Appeal no.303\/1983 was allowed on<\/p>\n
5th Sept., 2007 (Annex.7) and petitioner was acquitted from<\/p>\n
the charge referred above.\n<\/p>\n
     The petitioner’s contention is that the very cause on<\/p>\n
the basis of which, the petitioner’s service was terminated<\/p>\n
itself has fallen to the ground and, therefore, the order of<\/p>\n
termination of service of the petitioner (Annex.3) deserves<\/p>\n
to be set aside and in fact, that order should have been<\/p>\n
withdrawn by the respondents.\n<\/p>\n
     Learned counsel for the respondents could not dispute<\/p>\n
this fact that no departmental inquiry was held for taking<\/p>\n
any disciplinary action against the petitioner and he was
\n                               2<\/span><\/p>\n
dismissed from service only because of the reason that<\/p>\n
petitioner was convicted vide judgment and order dated<\/p>\n
2.8.1983. However, this fact is also clear from the Annex.3<\/p>\n
itself. Learned counsel for the respondents in that situation<\/p>\n
submitted that even if the order dated 22.8.1983 dismissing<\/p>\n
the petitioner from service (Annex.3) is set aside even then<\/p>\n
the petitioner is not entitled to any back wages because of<\/p>\n
the   reason that   prosecution   was   not    lodged   by the<\/p>\n
respondents and, therefore, the prayer of the back wages<\/p>\n
may be denied.\n<\/p>\n
      I considered the submissions of learned counsel for the<\/p>\n
parties and perused the facts of the case.\n<\/p>\n
      From Annex.3 it is clear that petitioner was dismissed<\/p>\n
from bank services w.e.f. 2.8.1983 i.e., from the date of the<\/p>\n
conviction of the petitioner.     It is admitted case that<\/p>\n
petitioner has not been punished in departmental inquiry<\/p>\n
because of any of the misconduct and he has been<\/p>\n
straightway   dismissed   from    service     because   of   his<\/p>\n
conviction only. That conviction has been set aside by the<\/p>\n
judgment of this court dated 5th Sept., 2007 delivered by<\/p>\n
the Division Bench of this Court. Therefore, the very basis<\/p>\n
for the order dated 22.8.1983 has come to an end with the<\/p>\n
acquittal of the petitioner on 5th Sept., 2007. The order of<\/p>\n
dismissal of the petitioner, therefore, cannot be sustained<\/p>\n
and deserves to be set aside.           However, since the<\/p>\n
prosecution was not lodged by the respondents-employer,
\n                                3<\/span><\/p>\n
therefore, the respondents-employer cannot be held guilty<\/p>\n
for preventing the petitioner from discharging his duties<\/p>\n
and, therefore, the respondents cannot be burdened with<\/p>\n
the back wages of the petitioner from 2.8.1983 to 5th Sept.,<\/p>\n
2007, the date on which, the petitioner was acquitted by the<\/p>\n
Division Bench of this Court in a criminal case.<\/p>\n
      In view of the above reasons, the writ petition of the<\/p>\n
petitioner is allowed. The order dated 22.8.1983 (Annex.3)<\/p>\n
dismissing the petitioner from bank service is set aside.<\/p>\n
However, the petitioner shall not be entitled to any back<\/p>\n
wages from 2.8.1983 to 5th Sept., 2007.         The petitioner<\/p>\n
shall be entitled to other notional benefits and continuity of<\/p>\n
service as well as other monitory benefits, which can be<\/p>\n
granted as per the rules of the respondents. The petitioner’s<\/p>\n
claim for promotion may also be considered by the<\/p>\n
respondents and if found eligible only then the petitioner<\/p>\n
can be granted that promotion. It is made clear that<\/p>\n
petitioner has already attained the age of superannuation<\/p>\n
before acquittal, therefore, the petitioner shall not be<\/p>\n
entitled to seeking reinstatment now. The respondents are<\/p>\n
directed to    complete the process within a period of 4<\/p>\n
months from today as according to learned counsel for the<\/p>\n
petitioner, the petitioner is cancer patient.<\/p>\n
