The appellant Lajpat Rai, who was working as a<br \/>\nPatwari, in the revenue circle of Jhotiwala was convicted<br \/>\nby the learned Special Judge, Faridkot, vide judgment<br \/>\ndated 7.6.1990 as he was found guilty of the offence<br \/>\npunishable under Section 13(2) of the Prevention of<br \/>\nCorruption Act, 1989, hereinafter referred to as the Act,<br \/>\nand was sentenced to undergo rigorous imprisonment for a<br \/>\nperiod of 1.5 years and to pay a fine of Rs. 500\/-, in<br \/>\ndefault thereof, to further undergo rigorous imprisonment<br \/>\nfor two months. Challenge in the present appeal is to the<br \/>\nconviction and sentence awarded to the appellant-accused.\n<\/p>\n<p> 2. As per the case of the prosecution, Jit Singh<br \/>\nPW 1 is resident of village Burj Masta. He and his other<br \/>\nthree brothers had purchased the land measuring about 15<br \/>\nkanals 18 marlas in 1982. They also purchased land<br \/>\nmeasuring 4 kanals 17 marlas for a consideration of<br \/>\nRs. 14,000\/- from Arjan Singh son of Narain Singh and<br \/>\nJaswinder Singh son of Jalaur Singh. The mutations had<br \/>\nnot been sanctioned in respect of the two purchases. The<br \/>\ncomplainant went to the Patwari who in turn demanded a sum<br \/>\nof Rs. 500\/- but agreed to accent Rs. 300\/- from them for<br \/>\nentering the mutations. This was demanded on 10.4.1989.<br \/>\nThe amount was demanded as illegal gratification, which<br \/>\nwas promised to pay by the complainant. The complainant<br \/>\nalong with Babu Singh PW went to the office of the<br \/>\nVigilance Bureau at Faridkot, Gurbachan Singh, Inspector<br \/>\nmet him in the office. Statement of complainant was<br \/>\nrecorded. Then Jit Singh produced three currency notes of<br \/>\nRs. 100\/- each. Phenolphthalein powder was applied to the<br \/>\nnotes and no other material was permitted to remain with<br \/>\nJit Singh. These notes were handed over to Jit Singh. A<br \/>\ndemonstration regarding the solution of powder was also<br \/>\ndone. A scheme was prepared, according to which after<br \/>\nreaching near the vegetable shops, Jit Singh was to go<br \/>\nahead and on demand by the accused, was to make the<br \/>\nrequisite payment. According to the scheme Jit Singh PW1<br \/>\npaid a sum of Rs. 300\/- to the accused and thereafter<br \/>\nagreed signal was given by Babu Singh. The Inspector<br \/>\nalong with the members of the raiding party reached the<br \/>\nroof. Accused came out from the Chaubara. The Inspector<br \/>\ndisclosed his identity. Then glass of water was taken and<br \/>\nsodium carbonate was put into the same. Hands of the<br \/>\naccused were got washed in the said solution. The colour<br \/>\nof the solution changed to pink. Then solution was put<br \/>\ninto a nip and was duly sealed and taken into possession.<br \/>\nBefore conducting the raid, Gurcharan Singh, Clerk, Office<br \/>\nof the S.D.O.Drainage, Faridkot was also joined. He was<br \/>\nintroduced to the witnesses and scheme was told to him.<br \/>\nRecovery of three currency notes of Rs. 100\/- each was<br \/>\neffected. Numbers of the notes were tallied and<br \/>\nultimately challan was filed along with relevant<br \/>\ndocuments. Report of the Forensic Science Laboratory and<br \/>\nthe opinion given by the expert were filed with the<br \/>\nchallan.\n<\/p>\n<p> 3. A charge under Section 13(2) of the Act was<br \/>\nframed on 27.9.1989. The appellant-accused did not plead<br \/>\nguilty and was subjected to trial. After the prosecution<br \/>\nevidence was concluded, the statement of the accused under<br \/>\nSection 313 Cr.P.C. was recorded in which he pleaded not<br \/>\nguilty as well as stated that he has been falsely<br \/>\nimplicated in the case. As already noticed, the learned<br \/>\nSpecial Judge, found the appellant guilty of the offence<br \/>\nand convicted him by awarding the afore-mentioned sentence.\n<\/p>\n<p> 4. Learned counsel for the accused-appellant has<br \/>\nmainly thrust on two submissions, firstly that there are<br \/>\nserious contradictions in the statements of the material<br \/>\nwitnesses and secondly that PW 1 is not a reliable witness<br \/>\ninasmuch as he has, on oath, stated falsehood which is<br \/>\nconfirmed by the statement of PW 2 itself. Lastly, it was<br \/>\nsubmitted that the prosecution has failed to prove its<br \/>\ncase beyond a reasonable shadow of doubt.\n<\/p>\n<p> 5. PW 1 Jit Singh complainant was asked a simple<br \/>\nquestion in his cross-examination whether he knew and<br \/>\naddressed Babu Singh PW 2 as his   Fuffar.  This question<br \/>\nwas answered by him in the negative. However, PW 2 in his<br \/>\ncross-examination stated as under:-\n<\/p>\n<p>  &#8220;It is correct that I and Kaka Singh were<br \/>\ngod brothers and Jit Singh PW addresses me as<br \/>\nFuffar. I started from the village at 8 A.M.<br \/>\nI had come to purchase articles. I do not<br \/>\nremember what I was to purchase on that day.&#8221;\n<\/p>\n<p> 6. The above contradiction does show that PW 1 was<br \/>\nnot stating correct facts even on oath before the Court.<br \/>\nThere was no occasion for him to deny relationship which<br \/>\nwas known to all concerned. Another material<br \/>\ncontradiction between the statements of PW 1 and PW 2 is<br \/>\nwith regard to material part of the trap laid by the<br \/>\npolice party. According to PW 1, &#8220;Patwari&#8221; (the accused)<br \/>\ncame out of his office in order to make water and while<br \/>\nleaving he promised that after making water he will make<br \/>\nthe entries regarding the mutations&#8221;. When he came out of<br \/>\nthe office, the vigilance staff was present and the<br \/>\nInspector disclosed his identity but the accused kept on<br \/>\nstanding there. The powder was mixed into a glass of<br \/>\nwater and with the same the colour of the water did not<br \/>\nchange. On the other hand, PW2 in his examination in<br \/>\nchief itself stated that the accused was caught in his<br \/>\noffice by the police inside the Chaubara. The Inspector<br \/>\ntold the accused that he had taken the money and that the<br \/>\naccused kept silent. The Inspector took a glass of water<br \/>\nand put the powder in the same and the colour of the water<br \/>\nchanged.\n<\/p>\n<p> 7. The version given by these two witnesses is at<br \/>\nconsiderable variance in regard to one and the same event,<br \/>\nwhich is the main plank of the prosecution case. Further<br \/>\nmore, Babu Singh PW 2 did not support the case of the<br \/>\nprosecution any further and was permitted to be<br \/>\ncross-examination by the learned Public Prosecutor on the<br \/>\nsame day. PW 3 Gurcharan Singh, who was the only<br \/>\nindependent witness, also did not support the case of the<br \/>\nprosecution and has declared hostile and permitted to be<br \/>\ncross-examination by the learned trial Judge. PW 3 stated<br \/>\nthat he did not see any signal and according to him also<br \/>\nthe accused was sitting in his office when the Inspector<br \/>\nwent to him. According to him Jit Singh pointed towards<br \/>\nthe pant which was lying inside his office and the money<br \/>\nwas taken out from the said pant.\n<\/p>\n<p> 8. Learned counsel appearing for the State<br \/>\ncontended that the hands of the accused were washed and<br \/>\nthat part of the prosecution case remains unrebutted and<br \/>\nin fact is supported by three witnesses. But, this by<br \/>\nitself, would not sufficient to convict the appellant.<br \/>\nThe prosecution is obliged to prove its complete story and<br \/>\nparticularly with regard to the event of trap laid for<br \/>\nrecovering the money from the appellant which was<br \/>\nallegedly paid as bribe to him. However, it is correct<br \/>\nthat minor discrepancies or even contradictions per se<br \/>\nwould not be sufficient to throw out the case of the<br \/>\nprosecution, but where the discrepancies or contradictions<br \/>\nare serious and demolish the case of the prosecution<br \/>\nitself, in that event, advantage must go to the accused.\n<\/p>\n<p> 9. For the reasons afore-stated, this appeal is<br \/>\nallowed.
