Shri\u00a0Kumaresh\u00a0Pathak,\u00a0learned\u00a0Dy.\u00a0Govt.\u00a0Advocate\u00a0for\u00a0the\u00a0\nrespondents.<\/pre>\n<p>       On \u00a0 consent \u00a0 of \u00a0 the \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 parties \u00a0 the\u00a0<br \/>\nmatter\u00a0is\u00a0finally\u00a0heard.\n<\/p>\n<p>       This \u00a0 intra\u00adcourt \u00a0 appeal \u00a0 has \u00a0 been \u00a0 preferred \u00a0 against \u00a0 the\u00a0<br \/>\norder\u00a0dated\u00a024\u00ad9\u00ad2009\u00a0passed\u00a0by\u00a0he\u00a0learned\u00a0Single\u00a0Judge\u00a0in\u00a0W.P.\u00a0<br \/>\nNo.299\/2006(S).\n<\/p>\n<p>       The\u00a0facts\u00a0giving\u00a0rise\u00a0to\u00a0filing\u00a0of\u00a0the\u00a0instant\u00a0appeal,\u00a0briefly\u00a0<br \/>\nstated, \u00a0 are \u00a0 that \u00a0 the \u00a0 appellant \u00a0 is \u00a0 employed \u00a0 as \u00a0 Sub\u00adEngineer\u00a0<br \/>\n(Civil) \u00a0 in \u00a0 Water \u00a0 Resources \u00a0 Department \u00a0 of \u00a0 the \u00a0 State \u00a0 of \u00a0 M.P.\u00a0<br \/>\nJuniors\u00a0of\u00a0the\u00a0appellant\u00a0were\u00a0promoted\u00a0on\u00a0the\u00a0post\u00a0of\u00a0Assistant\u00a0<br \/>\nEngineer \u00a0 on \u00a0 5\u00ad04\u00ad2003. \u00a0 \u00a0 Being \u00a0 aggrieved \u00a0 by\u00a0 his \u00a0 supersession\u00a0<br \/>\nthe\u00a0appellant\u00a0filed\u00a0the\u00a0writ\u00a0petition\u00a0before\u00a0this\u00a0Court.\u00a0 \u00a0During\u00a0<br \/>\nthe \u00a0 pendency \u00a0 of \u00a0 the \u00a0 writ \u00a0 petition \u00a0 before \u00a0 this \u00a0 Court \u00a0 a \u00a0 review\u00a0<br \/>\nDPC\u00a0was\u00a0held\u00a0on\u00a07\u00ad6\u00ad2007\u00a0in\u00a0which\u00a0the\u00a0case\u00a0of\u00a0the\u00a0appellant\u00a0as\u00a0<br \/>\nwell\u00a0as\u00a0three\u00a0other\u00a0candidates\u00a0was\u00a0considered\u00a0for\u00a0promotion.\u00a0<br \/>\nThe\u00a0appellant\u00a0was\u00a0found\u00a0 fit\u00a0 for\u00a0promotion.\u00a0 \u00a0The\u00a0review\u00a0DPC\u00a0<br \/>\nrecommended \u00a0 promotion \u00a0 of \u00a0 the \u00a0 appellant \u00a0 with \u00a0 effect \u00a0 from\u00a0<br \/>\n5\u00ad4\u00ad2003.\u00a0 \u00a0However,\u00a0the\u00a0aforesaid\u00a0fact\u00a0could\u00a0not\u00a0be\u00a0noticed\u00a0by\u00a0<br \/>\nthe\u00a0learned\u00a0Single\u00a0Judge\u00a0and\u00a0the\u00a0writ\u00a0petition\u00a0preferred\u00a0by\u00a0the\u00a0<br \/>\nappellant \u00a0 was \u00a0 disposed \u00a0 of \u00a0 with \u00a0 certain \u00a0 directions. \u00a0 \u00a0 Being\u00a0<br \/>\naggrieved\u00a0 by\u00a0the \u00a0 aforesaid \u00a0 order, \u00a0 the\u00a0 appellant \u00a0 preferred \u00a0this\u00a0<br \/>\nwrit\u00a0appeal.\n<\/p>\n<p>       Learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 appellant \u00a0 submitted \u00a0 that \u00a0 the\u00a0<br \/>\naction \u00a0 of \u00a0 the \u00a0 respondents \u00a0 in \u00a0 not \u00a0 giving \u00a0 effect \u00a0 to \u00a0 the\u00a0<br \/>\n recommendations \u00a0 of \u00a0 the \u00a0 review \u00a0 DPC, \u00a0 dated \u00a0 7\u00ad6\u00ad2007 \u00a0 is\u00a0<br \/>\npatently\u00a0arbitrary\u00a0and\u00a0illegal.\n<\/p>\n<p>       On\u00a0 the\u00a0 other\u00a0 hand,\u00a0 Shri\u00a0 Kumaresh\u00a0 Pathak,\u00a0 learned\u00a0 Dy.\u00a0<br \/>\nAdvocate\u00a0General\u00a0fairly\u00a0submitted\u00a0that\u00a0the\u00a0case\u00a0of\u00a0the\u00a0appellant\u00a0<br \/>\nhas\u00a0been\u00a0considered\u00a0by\u00a0the\u00a0review\u00a0DPC\u00a0held\u00a0on\u00a07\u00ad6\u00ad2007\u00a0and\u00a0<br \/>\nthe \u00a0 DPC \u00a0 has \u00a0 recommended \u00a0 that \u00a0 the \u00a0 appellant \u00a0 be \u00a0 promoted\u00a0<br \/>\nwith\u00a0effect\u00a0from\u00a05\u00ad4\u00ad2003,\u00a0i.e.,\u00a0date\u00a0his\u00a0juniors\u00a0were\u00a0promoted.\n<\/p>\n<p>       We \u00a0 have \u00a0 considered \u00a0 the \u00a0 submissions \u00a0 on \u00a0 both \u00a0 sides. \u00a0 It\u00a0<br \/>\nappears \u00a0 from \u00a0 the \u00a0 order\u00adsheet \u00a0 that \u00a0 the \u00a0 respondents \u00a0 were\u00a0<br \/>\ngranted\u00a0several\u00a0opportunities\u00a0to\u00a0seek\u00a0instructions\u00a0in\u00a0the\u00a0matter.\u00a0<br \/>\nHowever,\u00a0the\u00a0State\u00a0Government\u00a0has\u00a0failed\u00a0to\u00a0file\u00a0reply.\u00a0\u00a0Learned\u00a0<br \/>\nDy.\u00a0Advocate\u00a0General\u00a0is\u00a0not\u00a0 in\u00a0a\u00a0position\u00a0to\u00a0make\u00a0statement\u00a0<br \/>\nbefore\u00a0us\u00a0whether\u00a0recommendations\u00a0made\u00a0by\u00a0the\u00a0review\u00a0DPC\u00a0<br \/>\nhave\u00a0been\u00a0implemented\u00a0or\u00a0not.\n<\/p>\n<p>       However,\u00a0in\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0of\u00a0the\u00a0case\u00a0and\u00a0<br \/>\ntaking\u00a0into\u00a0account\u00a0the\u00a0nature\u00a0of\u00a0the\u00a0controversy\u00a0involved\u00a0in\u00a0<br \/>\nthe\u00a0appeal\u00a0and\u00a0as\u00a0agreed\u00a0to\u00a0be\u00a0by\u00a0the\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0<br \/>\nparties,\u00a0the\u00a0instant\u00a0writ\u00a0appeal\u00a0is\u00a0disposed\u00a0of\u00a0with\u00a0the\u00a0direction\u00a0<br \/>\nto\u00a0the\u00a0respondents\u00a0to\u00a0consider\u00a0the\u00a0recommendations\u00a0made\u00a0by\u00a0<br \/>\nthe\u00a0review\u00a0DPC,\u00a0dated\u00a07\u00ad6\u00ad2007\u00a0in\u00a0proper\u00a0perspective\u00a0and\u00a0to\u00a0<br \/>\ngrant\u00a0promotion\u00a0to\u00a0the\u00a0appellant\u00a0as\u00a0well\u00a0as\u00a0to\u00a0award\u00a0him\u00a0all\u00a0the\u00a0<br \/>\nconsequential \u00a0 benefits. \u00a0 \u00a0 The \u00a0 aforesaid \u00a0 exercise \u00a0 shall \u00a0 be\u00a0<br \/>\ncompleted \u00a0 within \u00a0 a \u00a0 period \u00a0 of \u00a0 one \u00a0 month \u00a0 from \u00a0 the \u00a0 date \u00a0 of\u00a0<br \/>\nproduction \u00a0 of \u00a0 certified \u00a0 copy \u00a0 of \u00a0 this \u00a0 order. \u00a0 However, \u00a0 if \u00a0 on\u00a0<br \/>\naccount \u00a0 of \u00a0 some \u00a0 legal \u00a0 impediment \u00a0 it \u00a0 is \u00a0 not \u00a0 possible \u00a0 for \u00a0 the\u00a0<br \/>\nrespondents \u00a0 to \u00a0 grant \u00a0 promotion \u00a0 to \u00a0 the \u00a0 appellant, \u00a0 the\u00a0<br \/>\nrespondents\u00a0shall\u00a0pass\u00a0a\u00a0reasoned\u00a0order\u00a0and\u00a0communicate\u00a0the\u00a0<br \/>\nsame\u00a0to\u00a0the\u00a0appellant\u00a0within\u00a0a\u00a0 \u00a0period\u00a0of\u00a0four\u00a0weeks\u00a0from\u00a0the\u00a0<br \/>\ndate\u00a0of\u00a0production\u00a0of\u00a0certified\u00a0copy\u00a0of\u00a0this\u00a0order.\n<\/p>\n<p>                With \u00a0 the \u00a0 aforesaid \u00a0 directions, \u00a0 the \u00a0 writ \u00a0 appeal \u00a0 stands\u00a0<br \/>\n      finally\u00a0disposed\u00a0of.\n<\/p>\n<p>
