JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tIn<br \/>\nthis appeal, the appellant &#8211; original petitioner challenges judgment<br \/>\nand order dated 21.2.2011 passed by learned Single Judge in SCA No.<br \/>\n2077 of 2011, whereby the learned Single Judge rejected the petition<br \/>\nconfirming the order passed by Revisional Authority &#8211; Secretary<br \/>\n(Appeals), Revenue Department, State of Gujarat, dated 29.6.2010,<br \/>\npassed in Revision Application No. MVV\/HKP\/PCHM\/6\/07.\n<\/p>\n<p>2.\tThe<br \/>\nfacts relevant for the purpose of deciding this petition can be<br \/>\nsummarized as under:-\n<\/p>\n<p>2.1\tThe<br \/>\ndispute substantially relates to mutation of entries in the Revenue<br \/>\nrecord.  Mutation entry No. 824 came to be recorded in the Revenue<br \/>\nrecord relating to land bearing survey No. 226\/paiki-2, Moje:<br \/>\nCharangam (Namnar), Tal. Lunavada, some time in the year 1989-90.<br \/>\nThis mutation of entry came to be challenged by the appellant herein<br \/>\nafter a period of 22 years.  It also appears that with respect to the<br \/>\nvery land in question, Civil Suit is also pending in the Court of<br \/>\nCivil Court at Lunawada, being Regular Civil Suit No. 22 of 2007,<br \/>\nfiled by the appellant herein for a declaration and injunction.  The<br \/>\nauthorities below, taking into consideration the fact that an entry<br \/>\nmutated as far back as in the year 1989-90 cannot be challenged after<br \/>\na period of almost two decades, refused to grant any relief to the<br \/>\nappellant.  Aggrieved by the order passed by the Collector,<br \/>\nPanchmahals in RTS Appeal No. 10 of 2007 and the order passed by the<br \/>\nRevisional Authority, Secretary (Appeals), Revenue, appellant &#8211;<br \/>\noriginal petitioner preferred SCA No. 2077 of 2011, challenging the<br \/>\nsame.\n<\/p>\n<p>3.\tLearned<br \/>\nSingle Judge took notice of two important aspects, namely &#8211; (i) delay<br \/>\nof almost 22 years in challenging the mutation entry and (ii) that<br \/>\nthe very same dispute is pending before the Civil Court at Lunawada,<br \/>\nin the form of Regular Civil Suit No. 22 of 2007.\n<\/p>\n<p>4.\tIn<br \/>\nour opinion, if learned Single Judge having noticed these two aspects<br \/>\nrejected the petition, then no error is said to have been committed,<br \/>\nmuch less an error of law, warranting any interference in this<br \/>\nappeal.\n<\/p>\n<p>5.\tIt<br \/>\nis a settled law that mutation of entries in the record of rights is<br \/>\nonly for fiscal purposes.  By mutation of an entry, no right, title<br \/>\nor interest is created in favour of any party and by deletion of the<br \/>\nsame also, no right, title or interest, if any, can be said to have<br \/>\nbeen extinguished.  Any issue as regards right, title and interest in<br \/>\na property can only be decided by a competent Civil Court and it is<br \/>\nonly after the competent Civil Court adjudicates and passes a decree<br \/>\ndetermining the rights of the parties with respect to a property in<br \/>\nquestion that the entry can be mutated as per the decree passed by<br \/>\nthe competent Civil Court.\n<\/p>\n<p>6.\tIn<br \/>\nthe above view of the mater, and in the absence of any merit in the<br \/>\nappeal, the same is hereby dismissed with no order as to costs.\n<\/p>\n<p>\t\t\t\t\t\t(A.L.\n<\/p>\n<p>Dave, Actg.
