DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tHeard<br \/>\nlearned counsel for the parties.\n<\/p>\n<p>\tAt<br \/>\nthe outset, it is submitted by learned counsel for the private<br \/>\nparties that the petitioner and respondent No.2 have entered into an<br \/>\namicable settlement and complainant on oath by filing affidavit dated<br \/>\n8th February, 2011 has declared that the grievances raised<br \/>\nin the complaint was the result of misunderstanding and the<br \/>\ncomplainant, who is present in the court, reiterates the contents of<br \/>\nthe affidavits and apologizes for filing a false complaint.\n<\/p>\n<p>\tIt<br \/>\nis further submitted by learned counsel for the private parties that<br \/>\nsince the matter is settled, the impugned complaint is required to be<br \/>\nquashed.\n<\/p>\n<p>\tHaving<br \/>\nheard learned counsel for the parties, on perusal of the record of<br \/>\nthe case, including the affidavit dated 8th February,<br \/>\n2011, I am of the considered opinion that  by quashing and setting<br \/>\naside the impugned complaint, ends of justice would be met.<br \/>\nAccordingly, impugned complaint is hereby quashed and set aside.\n<\/p>\n<p>\tThis<br \/>\npetition is allowed to the aforesaid extent only.\n<\/p>\n<p>[Anant<br \/>\nS.
