Justice S.S.SATHEESACHANDRAN\n\n Dated :18\/01\/2010\n\n O R D E R\n                  S.S.SATHEESACHANDRAN, J.\n                 ----------------------------------------\n                     W.P.(C).No.996 OF 2010\n                     --------------------------------\n          Dated this the 18th day of January 2010\n         ----------------------------------------------------------\n                              JUDGMENT\n<\/pre>\n<p>     The writ petition is filed seeking the following reliefs.<\/p>\n<p>     i) Set aside Ext.P2 order passed by the Sub Judge&#8217;s<br \/>\nCourt, Attingal.\n<\/p>\n<p>     ii) Direct the court below to refund the Stamp Duty<br \/>\nremitted by the petitioners in their 2\/3 share within the time<br \/>\nlimit fixed by this Hon&#8217;ble Court, in the light of Article 42 of<br \/>\nKerala Stamp Act.\n<\/p>\n<p>     Iii) Grant such other relief that this Hon&#8217;ble Court deem<br \/>\nfit and proper in the circumstances of the case.<\/p>\n<p>     2. Challenge raised in the writ petition is against Ext.P2<\/p>\n<p>order passed by the learned Sub Judge dismissing an<\/p>\n<p>application moved by the petitioners for refund of the court<\/p>\n<p>fee, which, according to them, was paid by mistake in<\/p>\n<p>respect of the share alloted to them under a compromise<\/p>\n<p>decree passed in a suit for partition. The parties entered<\/p>\n<p>into a compromise by which petitioners were provided 2\/3 of<\/p>\n<p>the plaint property and the defendant 1\/3 share in that<\/p>\n<p>property.     Previously compromise petition filed by the<\/p>\n<p>parties as indicated above was refused to be accepted by<\/p>\n<p>W.P.(C).No. 996 OF 2010       Page numbers<\/p>\n<p>the court holding that the parties have to file a fresh suit to<\/p>\n<p>give effect to that compromise. Final decree application was<\/p>\n<p>dismissed by the court taking note of the compromise<\/p>\n<p>agreement produced by the parties.           That order was<\/p>\n<p>challenged before this court and vide Ext.P1 judgment.<\/p>\n<p>Setting aside the order the court below it was directed to<\/p>\n<p>reexamine the matter afresh and dispose of the final decree<\/p>\n<p>proceedings passing appropriate orders on the compromise<\/p>\n<p>petition produced by the parties.     Pursuant thereto, it is<\/p>\n<p>submitted by the learned counsel for the petitioner, the<\/p>\n<p>court below has passed an &#8216;order&#8217; but not a judgment<\/p>\n<p>accepting the terms of the compromise incorporating them<\/p>\n<p>final decree. No direction was also given in the order as to<\/p>\n<p>what should be the stamp fee to be paid by the respective<\/p>\n<p>sharers\/plaintiffs and defendant in the suit.     The learned<\/p>\n<p>counsel for the petitioners handed over to me a copy of the<\/p>\n<p>order dated 21\/08\/2009 passed by the court disposing the<\/p>\n<p>final decree proceedings. Clearly the court has overlooked<\/p>\n<p>the provisions of law which mandate for the passing of a<\/p>\n<p>final judgment closing the final decree proceedings. It is<\/p>\n<p>W.P.(C).No. 996 OF 2010           Page numbers<\/p>\n<p>also seen that the court has given a go by to Rule 236 of the<\/p>\n<p>Civil Rules of Practice which mandates that in a final<\/p>\n<p>judgment in a partition suit, direction should be given by the<\/p>\n<p>court as to the deposit of the amount required for purchase<\/p>\n<p>of the nonjudicial stamp paper to engross the final decree in<\/p>\n<p>proportion to the value of their shares stipulating that in the<\/p>\n<p>event of default by one or the other party, it may be a<\/p>\n<p>charge on the property alloted to the party who tenders the<\/p>\n<p>entire amount due for purchasing the stamp paper.<\/p>\n<p>However, as the challenge canvassed in the present writ<\/p>\n<p>petition is confined to the declining of the request made by<\/p>\n<p>the petitioners for refund of the amount tendered by them<\/p>\n<p>towards purchase of the stamp paper in respect of their 2\/3<\/p>\n<p>share, I need not pass any direction with respect to the<\/p>\n<p>order passed by the court disposing of the final decree<\/p>\n<p>proceedings.        It will be open to the petitioners to file a<\/p>\n<p>review petition before the court below bringing to its notice<\/p>\n<p>the relevant provisions of law mandating the passing of a<\/p>\n<p>final judgment complying with the rules.           If any such<\/p>\n<p>application is filed, the court below shall consider it taking<\/p>\n<p>W.P.(C).No. 996 OF 2010          Page numbers<\/p>\n<p>note of the observations made above and dispose it in<\/p>\n<p>accordance with law. Petitioners contend that in a partition<\/p>\n<p>suit, after a decree is passed, they need only pay the<\/p>\n<p>requisite amount for the lesser share alloted in the decree<\/p>\n<p>and not in respect of the major share alloted to any of the<\/p>\n<p>sharers. The case so canvassed by the petitioners has to be<\/p>\n<p>accepted in the light of Article 42 of the Kerala Stamp Act.<\/p>\n<p>In the present case, petitioners have been alloted 2\/3 share<\/p>\n<p>under the compromise entered by the parties, which had<\/p>\n<p>been accepted by the court, 2\/3 share, and the respondent,<\/p>\n<p>1\/3 share. Stamp fee for the lesser share ie, 1\/3 share alone<\/p>\n<p>need     be     paid   for engrossing    the  final decree as<\/p>\n<p>contemplated under Rule 236 of the Civil Rules of Practice.<\/p>\n<p>It is noticed that the petitioner, relying on the above rule,<\/p>\n<p>has sought for refund of the entire amount which was<\/p>\n<p>tendered by them for purchasing the stamp paper.          That<\/p>\n<p>cannot be.       Petitioners are also bound to pay 2\/3 of the<\/p>\n<p>amount due in respect of the stamp fee payable on the 1\/3<\/p>\n<p>share alloted to the defendant.         In &#8220;A.L.Sivaraman and<\/p>\n<p>others v The State of Kerala&#8221;(AIR 1993 KERALA 17) this court<\/p>\n<p>W.P.(C).No. 996 OF 2010          Page numbers<\/p>\n<p>has held that the parties to the partition deed have to meet<\/p>\n<p>the expenses for purchasing the stamp paper in proportion<\/p>\n<p>to their respective shares in the whole property partitioned.<\/p>\n<p>Petitioners had contended that they are not liable to pay the<\/p>\n<p>amount due from them in respect of the lesser share though<\/p>\n<p>it has been alloted in favour of the respondent.           The<\/p>\n<p>petitioners are also liable to pay the required amount in<\/p>\n<p>respect of the stamp papers purchased for engrossing the<\/p>\n<p>final decree. The order passed by the learned Sub Judge<\/p>\n<p>challenged in the writ petition is set aside and he is directed<\/p>\n<p>to take note of the observations made above and pass<\/p>\n<p>appropriate orders.        If the court finds that any excess<\/p>\n<p>amount was paid by the petitioners over and above the sum<\/p>\n<p>which has to be paid by them, appropriate orders are to be<\/p>\n<p>passed enabling them to claim refund.
