Wadhwa, learned counsel for the\npetitioner.\n\n      Shri Puneet Shroti, learned Panel Lawyer for\nrespondents No.1 to 4\/State.<\/pre>\n<p>      Challenging the gradation list dated 07\/06\/2002,<br \/>\nshowing respondent Nos.5 &amp; 6, senior to the petitioner in<br \/>\nthe cadre of Peons and further challenging the order dated<br \/>\n06\/01\/2003, granting promotion to respondent Nos.5 &amp; 6<br \/>\non the post of Asst. Grade-III, ignoring the claim of<br \/>\npetitioner, petitioner has filed this writ petition.\n<\/p>\n<p>2.    It is the case of petitioner that petitioner and<br \/>\nrespondent Nos.5 &amp; 6 were recruited in the office of<br \/>\nrespondent No.4 together on 01\/07\/1986, in the order<br \/>\nannexure P-1 dated 01\/07\/1986 name of petitioner<br \/>\nappears at Sr. No.15, that of respondent No.5 at Sr. No.13<br \/>\nand respondent No.6 at Sr. No.22. It is stated that even<br \/>\nthough all of them were appointed together, but vide<br \/>\norder dated 04\/07\/1988, respondent No.3 regularized<br \/>\nrespondent Nos.5 &amp; 6 on the post of Peon in the regular<br \/>\npay-scale     Rs.725-900\/-    vide    annexure     P-2   dated<br \/>\n04\/07\/1988, whereas the petitioner was regularized only<br \/>\n<span class=\"hidden_text\">                                                               2<\/span><\/p>\n<p>vide   order    dated       10\/08\/1992   on    the   basis   of<br \/>\nrecommendation of the Screening Committee in the said<br \/>\npay-scale vide annexure P-3. It is stated that while in<br \/>\nservice   petitioner    has     passed   the   High    School<br \/>\nExamination and when the gradation list dated 07\/06\/02<br \/>\nwas published vide annexure P-5, petitioner&#8217;s name did<br \/>\nnot find place. Subsequently, he represented when he was<br \/>\nappointed as a regular peon, but respondent Nos.5 &amp; 6<br \/>\nhave been granted further promotion on the post of Asst.<br \/>\nGrade-III vide order annexure P-12 dated 06\/01\/03.<br \/>\nContending that petitioner is senior to respondent Nos.5<br \/>\n&amp; 6 on the basis of seniority, as per the initial date of<br \/>\nappointment, and ignoring his claim respondents have<br \/>\nbeen shown senior and granted further promotion,<br \/>\npetitioner seeks interference into the matter.\n<\/p>\n<p>3.     Shri K.S. Wadhwa, learned counsel for the<br \/>\npetitioner emphasized that when petitioner and the other<br \/>\nrespondents were appointed on the same date, then<br \/>\npetitioner cannot be discriminated and treated differently<br \/>\nin the matter of grant of seniority and promotion,<br \/>\naccordingly, seeking correction of the gradation list and<br \/>\nconsideration of his case for promotion petitioner has<br \/>\nfiled this writ petition.\n<\/p>\n<p><span class=\"hidden_text\">                                                            3<\/span><\/p>\n<p>4.    Respondents have objected to the claim of<br \/>\npetitioner and it is pointed out by them that in the<br \/>\nseniority list of daily wages employee, as on 31\/12\/87,<br \/>\nname of respondent Nos.5 &amp; 6 appeared at Sr. No.50 &amp;<br \/>\n84 respectively, and that of petitioner at Sr. No.101. Each<br \/>\nand every daily wages employee was regularized as per<br \/>\nhis entitlement on the basis of seniority after screening by<br \/>\na committee and as respondent Nos.5 &amp; 6 were<br \/>\nregularized in the year 1988 and petitioner was only<br \/>\nregularized when his turn came in the year 2002, as per<br \/>\nhis seniority it is stated that petitioner cannot claim any<br \/>\nbenefit, accordingly, respondents resists the claim of<br \/>\npetitioner.\n<\/p>\n<p>5.     Having heard learned counsel for the parties and<br \/>\non consideration of the facts that has come on record it is<br \/>\nclear that even though petitioner and respondents were<br \/>\nappointed together on 01\/07\/86 vide annexure P-1, but on<br \/>\n04\/07\/88 vide annexure P-2, respondent Nos.5 &amp; 6 were<br \/>\nregularized in the regular service in the pay scale<br \/>\nRs725-900\/-     according    to   the   respondents     this<br \/>\nregularization was done according to the seniority of<br \/>\nemployees and as petitioner was at Sr. No.101 of<br \/>\nseniority list and respondents were at Sr. No.50 &amp; 84<br \/>\nrespectively, they were regularized on an earlier date.\n<\/p>\n<p><span class=\"hidden_text\">                                                          4<\/span><\/p>\n<p>After respondent Nos.5 &amp; 6 were regularized on<br \/>\n04\/07\/88, petitioner was brought in the work-charge<br \/>\nestablishment vide annexure P-3 on 10\/08\/92. When the<br \/>\nrespondents were regularized in the year 1988 and when<br \/>\npetitioner was only brought in the work-charge<br \/>\nestablishment on 10\/08\/92 petitioner did not object, he<br \/>\nwas extended the said benefit and it was only in the year<br \/>\n2002 that petitioner was brought in the regular<br \/>\nestablishment in the pay-scale vide annexure P-7 on<br \/>\n28\/10\/02, it is, therefore, clear that respondent Nos. 5&amp;6<br \/>\nwere regularized in the regular establishment on<br \/>\n04\/07\/88, whereas petitioner was not regularized, on<br \/>\n10\/08\/92 that he was only brought in the work-charge and<br \/>\ncontingency   paid    establishment   and   subsequently<br \/>\nregularized in the regular service and pay-scale vide<br \/>\nannexure P-7 on 28\/10\/02, when respondents were<br \/>\nregularized in the year 1988 and when petitioner was not<br \/>\ngranted these benefits, petitioner did not object to the<br \/>\nsame and once petitioner has regularized in the work-<br \/>\ncharge establishment in the year 1992 vide annexure P-3<br \/>\nand in the regular establishment on 28\/10\/02 after due<br \/>\nscreening, petitioner cannot claim himself to be senior to<br \/>\nrespondent Nos.5&amp;6 by virtue of their earlier engagement<br \/>\nas a daily wages employee on 04\/07\/88 vide annexure<br \/>\n<span class=\"hidden_text\">                                                             5<\/span><\/p>\n<p>P-2. Petitioner cannot rank senior when he was<br \/>\nregularized only in the work-charge establishment in the<br \/>\nyear 1992 and cannot claim seniority over these persons,<br \/>\nwho were appointed on regular establishment before him.<br \/>\nPetitioner having not challenged the regularization of<br \/>\nrespondents when ordered on 04\/07\/88 within time,<br \/>\ncannot now have any grievance when seniority is fixed in<br \/>\naccordance to dates of regularization.\n<\/p>\n<p>6.    Accordingly, finding the respondents to be senior to<br \/>\npetitioner and promoted earlier on the basis of seniority<br \/>\nin the regular cadre and finding the claim made by the<br \/>\npetitioner to be devoid of merit for the reasons indicated<br \/>\nhereinabove, this petition is dismissed.\n<\/p>\n<p>                                         (Rajendra Menon)<br \/>\n                                              Judge<br \/>\nss*\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madhya Pradesh High Court Anil Kumar Pare vs The State Of M.P.
