M\/s Gulab Chand Bhanwarlal &amp; ors.)\n\nDate of Order ::    2nd September 2008\n\n      HON'BLE MR. JUSTICE DINESH MAHESHWARI\n\nMr.Ramit Mehta for the appellant\n                        ....\n\n\n      Learned counsel for the defendant-appellant submits\n\nthat though the appellant has extended verbal information that\n\ncompromise has been arrived at between the parties but,\n\ndespite request, has not sent a written communication in that\n\nregard.\n\n      Having examined the record of the case, this Court is\n\nsatisfied that the instant appeal is not required to be kept\n\npending any further and deserves to be dismissed.\n\n      This appeal has been preferred against the judgment\n\nand decree dated 20.01.1988 as passed by the Additional\n\nDistrict Judge No.1, Udaipur in Civil Suit No.210\/1983\n\nwhereby the suit as filed by the respondent No.1 firm with\n\nrespondents Nos.2 to 4 as its partners was decreed against\n\nthe defendants allowing a sum of Rs.17,953\/- together with\n\ninterest on the principal amount at the rate of 1% per month\n\nfrom the date of filing of the suit.\n\n      This appeal, preferred by the defendant No.4 in the suit,\n\nwas admitted for consideration on 20.05.1988. Though notices\n                                  2\n\nin the stay application were also ordered to be issued but then,\n\non 11.05.1993, after hearing learned counsel for the parties,\n\nthis Court rejected the stay application with the observations\n\nthat if the amount under the decree had not been recovered,\n\nthe appellant would be free to deposit the same in the Court\n\nand that could be paid to the decree-holders on their\n\nfurnishing solvent security for restitution, in case so required.\n\n        It appears that the matter came up for hearing before\n\nthe Court on 21.03.2007 and was adjourned for four weeks;\n\nand then, was adjourned              for another two weeks on\n\n01.05.2007. However, on 17.05.2007, this Court noticed that\n\nthe counsel earlier representing the respondents had since\n\nbeen elevated to the Bench and, none else being present for\n\nthe respondents, fresh notices were ordered to be issued to\n\nthem.\n\n        The reports were received on the notices so issued in\n\nthe manner that the respondents Nos.2 to 7 have expired\n\nwhereas notices meant for respondent No.1 were returned\n\nunserved with the noting by the person to whom notices were\n\noffered that the parties had already compromised the matter.\n\n        The matter was thereafter processed in the office for the\n\nreason that     fresh notices were not filed in relation to the\n\nrespondent No.1 and steps were not taken in relation to the\n\nrespondents Nos.2 to 7.        In the said state of record, on\n                                  3\n\n21.08.2008 this Court found that the appeal had already\n\nabated qua the respondents Nos.2 to 7. As the counsel for\n\nthe appellant prayed for time to complete his instructions, the\n\nmatter was adjourned in the interest of justice but, looking to\n\nthe noting as made on the notices sent to the respondent\n\nNo.1, with last opportunity.\n\n      Fresh notices have not been filed in relation to the\n\nrespondent No.1 yet and, as noticed at the outset, counsel for\n\nthe appellant states having received oral communication that\n\nthe matter has since been compromised between the parties.\n\n      For the appellant having failed to take steps in relation\n\nto the respondents Nos.2 to 7, the appeal has already abated\n\nqua them and then, for the appellant having failed to take\n\nsteps for service of the respondent No.1, this appeal is\n\nrequired to be dismissed against the respondent No.1 also\n\nand is, therefore, required to be dismissed in toto.\n\n      Even otherwise, on merits too, there does not appear\n\nany ground for the appellant to urge in this appeal.       The\n\nlearned Trial Court, with reference to the evidence on record,\n\nhas found the commercial dealings between the parties and\n\nhas found that ultimately an amount of Rs.17,430.18 remained\n\ndue in the defendants.         This appeal has essentially been\n\npreferred with the submissions that the appellant-defendant\n\nNo.4 was unnecessarily entangled in the present case and\n                                     4\n\n     he was not the partner of the defendant No.1 firm. Issue No.6\n\n     was framed in that regard but the learned Trial Court has\n\n     noticed that no any evidence was adduced by the defendants\n\n     and also found from the document Ex.4 that the appellant had\n\n     been incharge of the affairs of the defendant No.1 firm.\n\n           Perusal of the judgment under appeal makes out that no\n\n     evidence was at all led on behalf of the defendants including\n\n     the appellant.\n\n           Taking into comprehension all the facts of the case and\n\n     the surrounding circumstances, this Court is clearly of opinion\n\n     that there is no justification to continue with this appeal any\n\n     further that remains bereft of merit; and so also for the reason\n\n     that the parties appear to have entered into a settlement; and\n\n     further for the reason that the appellant has failed to take\n\n     requisite steps.\n\n           For all the reasons aforesaid, this appeal is dismissed.\n\n\n\n                                    (DINESH MAHESHWARI),J.\n<\/pre>\n<p>MK\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Satya Narain vs M\/S Gulab Chand Bhanwar Lal on 2 September, 2008 1 S.B.CIVIL FIRST APPEAL NO.36\/1988 (Satya Narain Vs.
