Feeling\u00a0aggrieved\u00a0by\u00a0the\u00a0order\u00a0passed\u00a0by\u00a0the\u00a0learned\u00a0Single\u00a0<br \/>\nJudge\u00a0in\u00a0W.P.\u00a0No.12825\/2010\u00a0(S),\u00a0dated\u00a010\u00ad9\u00ad2010\u00a0whereby\u00a0he\u00a0has\u00a0<br \/>\nobserved \u00a0 that \u00a0 selection \u00a0 in \u00a0 question \u00a0 shall \u00a0 be \u00a0 provisional \u00a0 and\u00a0<br \/>\nsubject \u00a0 to \u00a0 final \u00a0 decision \u00a0 of \u00a0 the \u00a0 writ \u00a0 petition \u00a0 the \u00a0 petitioner\u00ad<br \/>\nappellant\u00a0has\u00a0preferred\u00a0this\u00a0intra\u00adcourt\u00a0appeal\u00a0under\u00a0Section\u00a02(1)\u00a0<br \/>\nof \u00a0 the \u00a0 M.P. \u00a0 Uchcha \u00a0 Nyayalaya \u00a0 (Khand \u00a0 Nyaypeeth \u00a0 ko \u00a0 Appeal)\u00a0<br \/>\nAdhiniyam,\u00a02005\u00a0[for\u00a0brevity\u00a0`the\u00a0Act&#8217;].\n<\/p>\n<p>         The \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 appellant \u00a0 has \u00a0 vehemently\u00a0<br \/>\ncontended\u00a0that\u00a0the\u00a0selection\u00a0of\u00a0the\u00a0appellant\u00a0is\u00a0only\u00a0for\u00a0a\u00a0period\u00a0<br \/>\nof \u00a0 one \u00a0 year \u00a0 and, \u00a0 therefore, \u00a0 in \u00a0 the \u00a0 absence \u00a0 of \u00a0 interim \u00a0 order\u00a0<br \/>\nrestraining\u00a0the\u00a0appointment\u00a0the\u00a0appellant\u00a0shall\u00a0suffer\u00a0irreparable\u00a0<br \/>\nloss.\n<\/p>\n<p>         We\u00a0are\u00a0not\u00a0impressed\u00a0with\u00a0the\u00a0submission\u00a0for\u00a0the\u00a0reason\u00a0<br \/>\nthat\u00a0the\u00a0appeal\u00a0against\u00a0an\u00a0interim\u00a0order\u00a0is\u00a0not\u00a0maintainable\u00a0under\u00a0<br \/>\nthe\u00a0provisions\u00a0of\u00a0the\u00a0Act\u00a0in\u00a0view\u00a0of\u00a0the\u00a0law\u00a0laid\u00a0down\u00a0by\u00a0the\u00a0Full\u00a0<br \/>\nBench\u00a0decision\u00a0of\u00a0this\u00a0Court\u00a0in \u00a0Arvind\u00a0Kumar\u00a0Jain\u00a0vs.\u00a0State\u00a0of \u00a0<br \/>\nM.P.,\u00a0ILR\u00a02007\u00a0(MP)\u00a01017\u00a0wherein\u00a0it\u00a0has\u00a0been\u00a0held\u00a0as\u00a0under:\n<\/p>\n<blockquote><p>                &#8220;From \u00a0 the \u00a0 aforesaid \u00a0 enunciation \u00a0 of \u00a0 law \u00a0<br \/>\n        there \u00a0 remains \u00a0 no \u00a0 scintilla \u00a0 of \u00a0 doubt \u00a0 that\u00a0<br \/>\n        interlocutory \u00a0 orders \u00a0 on \u00a0 certain \u00a0 circumstances\u00a0<br \/>\n        could \u00a0 be \u00a0 appealed \u00a0 against \u00a0 under \u00a0 the \u00a0 Letters \u00a0<br \/>\n        Patent.\u00a0Despite\u00a0the\u00a0fact\u00a0that\u00a0they\u00a0are\u00a0interlocutory\u00a0<br \/>\n        in\u00a0nature\u00a0they\u00a0can\u00a0be\u00a0put\u00a0into\u00a0the\u00a0compartment\u00a0of \u00a0<br \/>\n        judgment \u00a0 if \u00a0 it \u00a0 affects \u00a0 the \u00a0 merits \u00a0 of \u00a0 the \u00a0 case\u00a0<br \/>\n        between\u00a0the\u00a0parties\u00a0by\u00a0determining\u00a0some\u00a0rights\u00a0or\u00a0<br \/>\n        liabilities. \u00a0 \u00a0 There \u00a0 can \u00a0 be \u00a0 three \u00a0 categories \u00a0 of \u00a0<br \/>\n        judgments,\u00a0final\u00a0judgment,\u00a0preliminary\u00a0judgment \u00a0<br \/>\n               and \u00a0 intermediary \u00a0 judgment \u00a0 or \u00a0 interlocutory\u00a0<br \/>\n              judgment.\u00a0If\u00a0the\u00a0order\u00a0finally\u00a0decides\u00a0the\u00a0question\u00a0<br \/>\n              and\u00a0directly\u00a0affects\u00a0the\u00a0decision\u00a0in\u00a0the\u00a0main\u00a0case \u00a0<br \/>\n              or\u00a0an\u00a0order\u00a0which\u00a0decided\u00a0the\u00a0collateral\u00a0issue\u00a0or\u00a0<br \/>\n              the\u00a0question\u00a0which\u00a0is\u00a0not\u00a0the\u00a0subject\u00admatter\u00a0of\u00a0the\u00a0<br \/>\n              main \u00a0 case \u00a0 or \u00a0 which \u00a0 determines \u00a0 the \u00a0 rights \u00a0 and \u00a0<br \/>\n              obligation \u00a0 of \u00a0 the \u00a0 parties \u00a0 in \u00a0 a \u00a0 final \u00a0 way \u00a0<br \/>\n              indubitably\u00a0they\u00a0are\u00a0appeallable.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>               However, \u00a0 it \u00a0 would \u00a0 be \u00a0 open \u00a0 to \u00a0 the \u00a0 appellant \u00a0 to \u00a0 move \u00a0 an\u00a0<br \/>\n      application \u00a0 before \u00a0 the \u00a0 learned \u00a0 Single \u00a0 Judge \u00a0 in \u00a0 the \u00a0 writ \u00a0 petition\u00a0<br \/>\n      itself\u00a0with\u00a0the\u00a0prayer\u00a0to\u00a0fix\u00a0the\u00a0matter\u00a0at\u00a0an\u00a0early\u00a0date\u00a0for\u00a0early\u00a0<br \/>\n      hearing \u00a0 of \u00a0 the \u00a0 writ \u00a0 petition. \u00a0 \u00a0 Learned \u00a0 Single \u00a0 Judge \u00a0 is, \u00a0 however,\u00a0<br \/>\n      requested \u00a0 \u00a0that\u00a0in\u00a0the \u00a0event \u00a0such \u00a0an\u00a0application\u00a0is \u00a0filed \u00a0by\u00a0 the\u00a0<br \/>\n      appellant\u00adpetitioner\u00a0the\u00a0same\u00a0may\u00a0be\u00a0considered\u00a0looking\u00a0to\u00a0the\u00a0<br \/>\n      urgency \u00a0of\u00a0the \u00a0matter \u00a0at\u00a0an\u00a0early \u00a0date,\u00a0subject\u00a0to\u00a0business\u00a0 and\u00a0<br \/>\n      convenience\u00a0of\u00a0the\u00a0Court.\n<\/p><\/blockquote>\n<blockquote><p>               With\u00a0the\u00a0above\u00a0observation\u00a0the\u00a0writ\u00a0appeal\u00a0is\u00a0dismissed.\n<\/p><\/blockquote>\n<blockquote><p>
