In compliance of directions issued earlier<\/p>\n<p>                 appointment letter contained in memo no. 2914 dated<\/p>\n<p>                 9-7-2011 has been produced before the court showing<\/p>\n<p>                 that all the 20 candidates recommended by the<\/p>\n<p>                 Commission for appointment to the post of Motor<\/p>\n<p>                 Vehicles Inspector in pursuance of advertisement no.<\/p>\n<p>                 2607\/2007 have been offered appointment and they can<\/p>\n<p>                 join the post within one week or at the maximum within<\/p>\n<p>                 one month.\n<\/p>\n<p>                            3. Learned counsel for the petitioners have<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>taken strong objection to the stipulation in Clause 7 of<\/p>\n<p>the appointment letter in which reference has been made<\/p>\n<p>to LPA nos. 905, 906 and 910 of 2010 and, particularly,<\/p>\n<p>to order passed on 1-9-2010.\n<\/p>\n<p>          4. According to learned counsel for the State,<\/p>\n<p>since this court granted liberty in the order dated<\/p>\n<p>21-5-2010 passed in the aforesaid Letters Patent Appeals<\/p>\n<p>that as an additional measure to ensure that no fake<\/p>\n<p>claims are allowed to succeed relating to driving license,<\/p>\n<p>driving test should also be held. According to him this<\/p>\n<p>would be related to those who had already been selected<\/p>\n<p>and found fit by the Commission but according to<\/p>\n<p>learned counsel for the petitioners it stands clarified by<\/p>\n<p>further observations in the same paragraph that<\/p>\n<p>`Prapatra-ii&#8217; cannot be ignored in view of rules of<\/p>\n<p>advertisement and, hence, &#8220;the dispute relating to driving<\/p>\n<p>license may again be re-scrutinized by the Commission\/<\/p>\n<p>Committee&#8221;.\n<\/p>\n<p>          5. Prima facie only the candidatures who were<\/p>\n<p>under dispute on account of doubt in respect of their<\/p>\n<p>driving   license       could   be   re-scrutinized   by   the<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>Commission\/ Committee and the observation that as an<\/p>\n<p>additional measure driving test may also be held relates<\/p>\n<p>only to the candidates whose driving licenses were under<\/p>\n<p>dispute. This aspect, according to learned counsel for the<\/p>\n<p>petitioners, has been clarified by this court on more than<\/p>\n<p>one occasion but again such condition has been imposed<\/p>\n<p>by the Transport Secretary, Government of Bihar in<\/p>\n<p>Clause 7 of the appointment letter and not as an<\/p>\n<p>independent decision of the State Government to hold<\/p>\n<p>such driving test but as an obligation allegedly arising<\/p>\n<p>out of orders of this court.\n<\/p>\n<p>           6. According to petitioners whatever tests were<\/p>\n<p>required under the rules or advertisement had to be taken<\/p>\n<p>by the Bihar Staff Selection Commission and there was<\/p>\n<p>no provision in the advertisement or in the rules to<\/p>\n<p>subject the recommended candidates to further driving<\/p>\n<p>test as is being done under Clause 7 of the appointment<\/p>\n<p>letter.\n<\/p>\n<p>           7. Clearly, a dispute has arisen as to whether<\/p>\n<p>afresh conditions can be added beyond the rules or the<\/p>\n<p>terms of advertisement by the State or not and whether<br \/>\n<span class=\"hidden_text\">                    4<\/span><\/p>\n<p>the requirement of selecting appropriate candidates<\/p>\n<p>would be duty of the Commission or of the State.<\/p>\n<p>          8. According to learned counsel for the<\/p>\n<p>Commission only the driving license had to be looked<\/p>\n<p>into and verified which was done by the Commission in<\/p>\n<p>the case of 20 successful candidates recommended for<\/p>\n<p>appointment. He submits that any further test beyond the<\/p>\n<p>rules and advertisement will open Pandora&#8217;s box and<\/p>\n<p>Commission should not be called upon to take up the<\/p>\n<p>cases of the recommended candidates afresh for<\/p>\n<p>subjecting them to any further test.\n<\/p>\n<p>          9. In the facts of the case, before deciding the<\/p>\n<p>issues raised above, one way or the other, we would like<\/p>\n<p>to know the stand of the State Government as regards<\/p>\n<p>necessity of holding the test in respect of 20<\/p>\n<p>recommended candidates and whether this shall be a<\/p>\n<p>standard procedure for subjecting all the candidates for<\/p>\n<p>future recruitment or is it by way of one time measure<\/p>\n<p>only in respect of 20 selected candidates. We would also<\/p>\n<p>like to have a clear stand of the State Government as to<\/p>\n<p>who, according to them, is competent to take the test, if it<br \/>\n<span class=\"hidden_text\">                            5<\/span><\/p>\n<p>        is permissible, the Transport Department or the<\/p>\n<p>        Commission. A clear stand on both the issues should be<\/p>\n<p>        presented before this court within two weeks.<\/p>\n<p>                   10. Put up under the same heading after two<\/p>\n<p>        weeks.\n<\/p>\n<p>                   11. In the meantime, proposed test shall be<\/p>\n<p>        kept in abeyance but if the candidates make themselves<\/p>\n<p>        available, they shall be allowed to join their posts.<\/p>\n<p>                   12.
