The respondents have been served with notice and they have<\/p>\n<p>entered appearance. They have also filed their counter affidavit.<\/p>\n<p>              (3). During the pendency of this contempt case, the Government<\/p>\n<p>have passed an order in G.O.(Rt) No.5365\/07\/G.Edn. dated 24-11-2007. Fax Message No.CCC\/474\/07 dated 23-11-2007 from<br \/>\n                  Shri.M.P.Sreekrishnan, Senior Government Pleader,<br \/>\n                  Advocate General&#8217;s Office, Ernakulam.<\/p><\/blockquote>\n<pre>\n\n<span class=\"hidden_text\">COC No.474\/2007                     -2-<\/span>\n\n\n\n                                   ORDER\n\n                    In   the   judgment    dated   23\/3\/2006   in    OP\n<\/pre>\n<blockquote><p>     No.21448\/01, the Hon&#8217;ble High Court has directed the<br \/>\n     respondents to grant interest at the rate of 8% from 1-4-95 till the<br \/>\n     actual disbursement of pension and pensionary benefits and the<br \/>\n     same shall be done within a period of three months from the<br \/>\n     date of production of a copy of the judgment.         Against the<br \/>\n     direction in the judgment, Government have filed WA 1982\/06<br \/>\n     and the same was dismissed on 8-11-2006 by the Hon&#8217;ble High<br \/>\n     Court upholding the judgment in OP No.21448\/01.\n<\/p><\/blockquote>\n<blockquote><p>                    After examining the case in detail, as per G.O.<br \/>\n     read as 2nd paper above, Government have directed the<br \/>\n     Assistant Educational Officer, Thrissur West to comply with the<br \/>\n     direction as opined by the Hon&#8217;ble High Court.        Accordingly<br \/>\n     interest at the rate of 8% at pension and pensionary benefits for<br \/>\n     the period from 1995 till the disbursement of actual pension have<br \/>\n     been released by the Assistant Educational Officer to the<br \/>\n     petitioner.\n<\/p><\/blockquote>\n<blockquote><p>                    Meanwhile in the Fax message dated 23-11-2007,<br \/>\n     the Senior Government Pleader, Shri.M.P.Sreekrishnan has<br \/>\n     informed that the petitioner&#8217;s claim is that she has not been<br \/>\n     given the interest on subsequent revision in pensionary benefits<br \/>\n     and Dearness Allowance till the actual disbursement of pension<br \/>\n     and if an order to that effect is not passed, the Secretary will<br \/>\n     have to appear before the court and face contempt proceedings<br \/>\n     for the non compliance of the judgment. the message has the<br \/>\n     approval of the Advocate General, Ernakulam.              In the<br \/>\n     circumstances reported by the Advocate General, Government<br \/>\n     are pleased to direct the Assistant Educational Officer, Thrissur<br \/>\n     West to sanction interest on subsequent revision in pension plus<br \/>\n     Dearness Allowance if any occurred at the rate of 8% from<br \/>\n     1-4-1995 till the      actual     disbursement    of pension to<br \/>\n     Smt.V.K.Leela, LPSA (Retired), Thrissur.<\/p><\/blockquote>\n<p>                                    By Order of the Governor,<\/p>\n<p>                                   T.SYAMALAKUMARY AMMA<br \/>\n                                 Deputy Secretary to Government<\/p>\n<p><span class=\"hidden_text\">COC No.474\/2007                     -3-<\/span><\/p>\n<p>             (4). In view of the subsequent development that has taken place<\/p>\n<p>during the pendency of the contempt case, we are of the opinion that this<\/p>\n<p>contempt petition need not be proceeded further. Accordingly, the contempt<\/p>\n<p>proceedings is dropped for the present.<\/p>\n<p>             (5).
