SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/04\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>RULE.\n<\/p>\n<p>\tMs.Sangeeta Vishen, learned Assistant Government Pleader waives the<br \/>\n\tservice of notice of rule on behalf of the respondent Nos.1 and 2<br \/>\n\tState and Mr.D.G. Shukla, learned advocate waives the service of<br \/>\n\tnotice of rule on behalf of the respondent No.3   GPSC, in each of<br \/>\n\tthe applications.\n<\/p>\n<p>With<br \/>\n\tthe consent of the learned advocates appearing on behalf of the<br \/>\n\trespective parties, all these applications are taken up for final<br \/>\n\thearing today.\n<\/p>\n<p>In<br \/>\n\tall these applications, the respective applicants have prayed to<br \/>\n\tmodify the judgement and order dtd.28\/1\/2010 passed in the Civil<br \/>\n\tApplication No.13093 of 2009, by directing the respondents to<br \/>\n\tcontinue the appointment of the applicants  as ad-hoc lecturer till<br \/>\n\tregularly GPSC selected candidates are available by making available<br \/>\n\tto the applicants the benefit of extension of time granted to the<br \/>\n\trespondents vide order dtd.28\/1\/2010 passed in Civil Application<br \/>\n\tNo.13093 of 2009 and not to fill up the post of lecturers by<br \/>\n\tappointing another set of ad-hoc lecturers-Class-II, in lace of the<br \/>\n\trespective applicants and further in the event of the availability<br \/>\n\tof regularly selected candidates of the respective applicants may<br \/>\n\tnot be terminated until the principle of  Last Come First Go  .\n<\/p>\n<p>Mr.P.R.\n<\/p>\n<p>\tNanavati, learned advocate appearing on behalf of the respective<br \/>\n\tapplicants does not press the rest of the reliefs prayed in these<br \/>\n\tapplications except  their prayer to continue them as<br \/>\n\tad-hoc on the same terms and conditions as ordered by this Court<br \/>\n\tvide aforesaid judgement and order dtd.30\/6\/2009, till 31\/12\/2010 or<br \/>\n\t till the regularly selected candidates from GPSC are available,<br \/>\n\twhichever is earlier.  Mr.P.R.\n<\/p>\n<p>\tNanavati, learned advocate appearing on behalf of the respective<br \/>\n\tapplicants has also declared at the bar that none of the applicants<br \/>\n\thave initiated any<br \/>\n\tproceedings before this Court and\/or any other Court for the relief<br \/>\n\tsought in the present applications.\n<\/p>\n<p>Mr.P.R.\n<\/p>\n<p>\tNanavati, learned advocate appearing on behalf of the respective<br \/>\n\tapplicants has stated at the bar that the respective applicants be<br \/>\n\tcontinued on ad-hoc on the same terms and conditions as per the<br \/>\n\tjudgement and order  dtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters, more particularly para 19 of the aforesaid judgement and<br \/>\n\torder dtd.30\/6\/2009 and they shall not raise any grievance in<br \/>\n\tfuture.\n<\/p>\n<p>Having<br \/>\n\theard Mr.P.R. Nanavati, learned advocate appearing on behalf of the<br \/>\n\trespective applicants, Mr.Kamal Trivedi, learned Advocate General<br \/>\n\tappearing on behalf of the respondent Nos.1 and 2   State and<br \/>\n\tMr.D.G. Ghukla, learned advocate appearing on behalf of the<br \/>\n\trespondent No.3 &#8211; GPSC, considering the judgement and order<br \/>\n\tdtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters and subsequent order dtd.28\/1\/2010 passed by this Court in<br \/>\n\tCivil<br \/>\n\tApplication No. 13093 of 2009, by which the State<br \/>\n\tGovernment has been granted further time to make appointment of<br \/>\n\tlecturers on regular basis in the Government Engineering and<br \/>\n\tPolytechnic Colleges in the State of Gujarat on or before<br \/>\n\t31\/12\/2010, the prayer of the respective applicants herein  to<br \/>\n\tcontinue them as ad-hoc on the same terms and conditions as per the<br \/>\n\tjudgement and order  dtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters, till 31\/12\/2010 and\/or<br \/>\n\ttill regularly GPSC selected candidates  are available, can be<br \/>\n\tconsidered, otherwise there will be chaos and vacuum, which will not<br \/>\n\tbe in the interest of the students and education, as observed in the<br \/>\n\tearlier judgement and order  dtd.30\/6\/2009 passed by this Court in<br \/>\n\tSpecial<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances and for the reasons stated above, all these<br \/>\n\tapplications are allowed to the extent that all the respective<br \/>\n\tapplicants be continued as ad-hoc lecturers or the post held by them<br \/>\n\ton ad-hoc on the same terms and conditions as per the judgement and<br \/>\n\torder dtd.30\/6\/2009 passed by this Court in Special<br \/>\n\tCivil Application No.5797 of 2009 and other allied<br \/>\n\tmatters, till 31\/12\/2010 or till the  regularly GPSC selected and<br \/>\n\tappointed candidates are available, whichever is earlier. All these<br \/>\n\tapplications are accordingly allowed to the aforesaid extent only.<br \/>\n\tFor rest of the relief\/prayer, the respective applications  are<br \/>\n\tdismissed as not pressed. Rule is made absolute to the aforesaid<br \/>\n\textent in each of the applications.
