Respondent \n\t\t\n\n\tOriginal Application No.7548 of 1995 was filed before the Tamil Nadu Administrative Tribunal, Madras Bench praying to call for the records of the respondent in RC No.62323\/B1\/90 dated 23.5.95 and quash the same and direct the respondent to reinstate the applicant in service.  Since the Tamilnadu Administrative Tribunal was abolished, the O.A. Was received by transfer and numbered as Writ Petition. \n\n\n\tFor petitioner      : Mr.Kolandaivelu\t\n\n\tFor respondents  : Mr.S.Sivashanmugam,\n\t\t\t Government Advocate\n\n                            -----                              \n\n\n\nO R D E R\n<\/pre>\n<p>\tOriginal Application No.7548 of 1995 was filed before the Tamil Nadu Administrative Tribunal, Madras Bench praying to call for the records of the respondent in RC No.62323\/B1\/90 dated 23.5.95 and quash the same and direct the respondent to reinstate the applicant in service.  Since the Tamilnadu Administrative Tribunal was abolished, the O.A. was received by transfer and numbered as Writ Petition.\n<\/p>\n<p>\t2. The petitioner was found guilty and sentenced to one year imprisonment together with fine in a sum of Rs.1,000\/-.  The petitioner was suspended and thereafter dismissed from service.\n<\/p>\n<p>\t3.  The only ground that is canvassed in the writ petition is that the order of dismissal is now under challenge stating that against the judgement of the lower authority convicting him in the criminal case, an appeal has been filed.  In the appeal stay has been granted.\n<\/p>\n<p>\t4.  Learned counsel for the petitioner is, however, unable to state as to the status  of the criminal appeal.   It is further  stated that the petitioner has in the meanwhile  superannuated.   If the criminal appeal said to have been filed by the petitioner goes in favour of the petitioner, the petitioner can make a representation to the appropriate authority for reconsidering the order of the dismissal. The larger relief sought for in the writ petition cannot be granted for the above said reason.   The writ petition stands disposed off with the above observation.
